ADJOURNED REGULAR MEETING SEPTEMBER 26 1978
The City Council of the City of Lynwood met in an adjourned
regular session in the City Hall, 11330 Bullis Road, on
above date at 7:30 p.m.
Mayor Higgins in the chair.
Councilmen Byork, Green, Morris, Rowe, and Higgins answered
the roll call.
Also present were City Attorney Murphy and City Manager
Valliere.
The City Manager reported that $471,735.85 is required to
cover retirement costs for fiscal year 1978-79, thereby
necessitating a tax levy of $0.46 per 100 of assessed valu-
ation. He explained that the legality of the levy for
voter-approved retirement costs will be determined by the
courts. RESOLUTION NO. 78-105 entitled:
"A RESOLUTION OF THE INCORPORATED CITY OF LYNWOOD FIXING
THE RATES OF TAXES AND LEVYING TAXES FOR THE FISCAL YEAR
BEGINNING JULY 1, 1978 AND ENDING JUNE 30, 1979." was pre-
sented. It was moved by Councilman Byork, seconded by
Councilman Morris, that Resolution No. 78-105 be adopted.

Ayes: Councilmen Byork, Morris, Rowe, Higgins.
Noes: Councilman Green.
Absent: None.
The City Manager recommended Council extend prior service
funding for Public Employees' Retirement System to reduce
the City's contribution rate and presented RESOLUTION NO.
78-106 entitled: RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF LYNWOOD EXTENDING THE PRIOR SERVICE FUNDING TO 1985
~,..,, WITH THE PUBLIC EMPLOYEES RETIREMENT SYSTEM." It was moved
E by Councilman Morris, seconded by Mayor Higgins, that
Resolution No. 78-106 be adopted.

moved by Councilman Morris, seconded by Councilman Byork,
and carried, that the ordinance be read by title only. It
was moved by Councilman Byork, seconded by Councilman Morris,
that the ordinance be introduced.

Absent: None.
It was moved by Councilman Green, seconded by Councilman
Byork, that the ordinance be amended to state: "the rate
shall be $0.30 per 100 cubic feet per month effective
October 1, 1978" because I feel that any future increases
be held off until the actual cost of 100 cubic feet of water
is determined.

Absent: None.
Council directed the City Manager to investigate the actual
cost of water and report back with the information.

It was moved by Councilman Byork, seconded by Councilman
Morris, and carried, to direct staff to refrain from
collecting the $0.45 per 100 cubic feet per month rate for
water as set forth in a previous order.
Res. 78-107 RESOLUTION NO. 78-107 entitled: "AUTHORIZING THE MAYOR AND
Auth.agrt. CITY CLERK TO EXECUTE ON BEHALF OF THE CITY OF LYNWOOD AN
H.DeLeeuw AGREEMENT WITH HARVEY DE LEEUW FOR THE PERFORMANCE OF
SERVICE, FUNCTIONS AND DUTIES FOR THE CITY OF LYNWOOD, DE- ~`
PARTMENT OF CITY CLERK, COPY OF WHICH AGREEMENT IS ON FILE IN
THE OFFICE OF THE CITY CLERK." was presented by the City
Manager with the recommendation that Council authorize
execution of agreement for temporary services. It was
moved by Councilman Green, seconded by Councilman Morris,
that Resolution No. 78-107 be adopted.

Res.78-108 RESOLUTION N®. 78-108 entitled: "A RESOLUTION OF THE CITY
Demands COUNCIL OF THE CITY OF LYNWOOD ALLOWING AND APPROVING THE
DEMANDS PRESENTED AND ORDERING WARRANTS DRAWN THEREFOR."
was presented.. It was moved by Councilman Green, seconded
by Councilman Byork, that Resolution No. 78-108 be adopted.

Noes: None.
Absent: None.
Coun.Byork The Mayor commended Councilman Byork for his contributions
ended in connection with I-105 freeway.
PUBLIC BUSINESS FROM THE FLOOR

cisions.
