The city Manager r e- ported that the Earle M. Jorgensen Company had petitioned the City to vacate the easement for purposes of expan- sion, The Mayor inquired if anyone present wished to speak in favor of the proposed vacation of easement. `.?'here was no response. The City Manager reported that the City has received pre- liminary approval from the Solid Waste management Board for a grant of X33,000 to conduct a feasibility study on removal of scrap tires at the Desser Property. Councilman Rowe commended Chief s Johnson and Lathrope for assembling the data on buildings and contents. Councilman Rowe stated that Ordinance No. 1039 although adopted on June ?9, 197 remains on a standby basis and that people are coned about how and when it will be enforced. Councilman Rowe noted that although the ordinance was enacted to raise revenue for employeesY retirement, he recommends that the ordinance be repealed and and ot.her• source of revenue be f"ound. The Mayor stated that the Fire Service Committee Report has not been formally presented to Council and has not been made a part of the budget for fiscal year 1979-80. He further stated that the ordinance provides that the Fire Chief' shall file with the City Clerk no later than October. 1 of each year, a statement on fire service fees due and payable for the January 1 calendar year. The Mayor requested the City Manager to submit a report with respect to Ordinance No. 1039. Councilman Higgins stated that the earliest date the fire service fee could be im- plemented would be 1981. Councilman Byork recommended that the ordinance remain on the books until such time as it is no longer needed. Pastor Gray recommended that the speed limit on Abbott Road and Carlin Avenue be increased to 35 miles per hour; he also recommended that potho=~Les on !'""` Imperia"1 Highway west of Atlantic Avenue be corree.ted. It was moved by Councilman Byork, seconded by Council- man Rowe, and carried,-that Councilmen Higgins' and Morris' absence be excused. The City Attorney inquired if Council wished to con- sider holding an adjourned regular meeting prior to October 2, 1979 in View of the fact that the parties to the Consent Decree will be reporting back to Judge Pregerson at l.p.m, on October 2, 1979. After discussion it-was the consensus of Council that an adjourned regular meeting be conducted at 10 a.m, on October 2, 1979 for the purpose of instructing Attorney Sorenson.
