HomeMy Public PortalAbout2005-041 Resolution Approving Finat Plat & Dev Agreement for Bohland Medina Meadows LLCMember Weir introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.2005-41 APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR BOHLAND MEDINA MEADOWS LLC FOR PROPERTY LOCATED WEST OF WILLOW DRIVE AND SOUTH OF THE MEDINA MORNINGSIDE NEIGHBORHOOD WHEREAS, BOHLAND MEDINA MEADOWS LLC has requested final approval of the Plat for "Keller Estates" on property legally described on Exhibit A attached hereto; and WHEREAS, the City has prepared a development agreement covering the improvements related to said plat; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF MEDINA, MINNESOTA, that it should and hereby does approve the final plat for BohLand Medina Meadows, LLC for Keller Estates; and FURTHER, that the development agreement for said final plat be approved, and that the Mayor and City Administrator be authorized to execute the development agreement on behalf of the City; and FURTHER, that the following conditions be met prior to recording the final plat: 1. A final plat is approved in accordance with the plans received by the City on December 2, 2004 and revisions received on January 3, 2005, April 12, 2005, May 13, 2005 and June 2, 2005, except as amended by this resolution. 2. The development agreement must be executed by the developer and the City, the terms and conditions of which are incorporated herein. FURTHER, that the following conditions be met prior to issuance of building permits: 1. A storm water taxing district must be approved by the City. 2. The HOA documents must be filed at Hennepin County. 3. The plans shall be revised to meet the conditions noted within the memo from the City Engineer dated June 14, 2005, including the comments from Lance Hoff dated June 10, 2005 and June 2, 2005. Resolution No. 2005-41 July 5, 2005 1 4. The applicant must place signage on the edge of the wetland buffer to provide for homeowner awareness. 5. The applicant must comply with the conditions of approval of the Minnehaha Creek Watershed Management Commission as noted in the May 25, 2005 letter of approval. 6. The plans shall meet the conditions of approval for the wetland permit application letter dated May 5, 2005. 7. Park dedication fees must be paid at the time of the first building permit issuance for a total of $63,948. 8. The final plat must be filed with the County Recorder within 60 days of the date of the City Council resolution granting final approval or the final plat shall be considered void, unless a written request for time extension is submitted by the applicant prior thereto and approved by the City Council. 9. The applicant shall provide to the City a digital copy of the approved plans. 10. The applicant shall pay to the City a fee in an amount sufficient to reimburse the City for the cost of reviewing the plat and related documents. Keller and Bonnie Keller, husband and wife, fee owners of the following described property situated in the County of Hennepin, State of Minnesota, to wit: The East 444.44 feet of the South Half of the South Half of the Northeast Quarter of Section 28, Township 118, Range 23, lying south of the south line of Medina Momingside. And Bohland Medina Meadows, LLC., a Minnesota limited liability company, fee owner of the following described property situated in the County of Hennepin, State of Minnesota, to wit: That part of the South Half of the Northeast Quarter of Section 28, township 118, Range 23, described as follows: Commencing at the southwest comer of the East 444.44 feet of the South Half of the South Half of said Northeast Quarter; thence north along the west line thereof to the south line of the plat of Medina Momingside; thence westerly along the south line of said plat to the southeast comer of Lot 1, Block 4 of said plat; thence southerly, along the extension of the east line of said Lot 1 a distance of 71.13 feet; thence westerly to the southeast comer of Lot 2, Block 4, of said plat; thence continuing along the southerly line of said Block 4 to the southwest comer of Lot 8, said Block 4; thence northerly along the west line of said Lot 8 a distance of 85.08 feet; thence northwesterly parallel with the southwesterly line of Lot 9, said Block 4 to its intersection with the northwesterly line of said Lot 9 extended thence northeasterly along said extended line to the southwest comer of said Lot 9; thence northwesterly to the southwest comer of Lot 1, Block 4, Medina Momingside First Addition; thence southwesterly to the most southerly corner of Lot 2, Block 4, Medina Momingside First Addition; thence southerly parallel with and 651.4 feet east from the west line of said South Half, thence southerly along said parallel line to the south line thereof; thence easterly to the point of beginning.
