LYNWOOD CITY COUNCIL
SPECIAL MEETING
NOVEMBER 19, 2001 ,
� The City Council of the City of Lynwood met in a Special Meeting at 11330 Bullis
' Road on the above date at 9:10 a:m. �
Mayor Richards presiding.
I Councilmen Byrd, Rea, Reyes, Sanchez and Richards answered the joint rofl call
� . ` for all agencies.
Also present were City Manager Davis, City Attorney Thever, Office Assistant
Munoz, and City Treasurer Pygatt. -

Office Assistant Munoz announced that the agenda had been posted in
accordance with the Brown Act.

Mark Kudler – 7699 Pine Street - stated that there are changes on the Bulletin
� Display Agreement that never had any amendments added to it. The Business •
and Profession Code is being violated, these are very serious issues. Also stated
' that when Council or any one issues any changes to any agreement it should be
darified.

Item #4: AMENDMENT TO THE CLASSIFICATION PLAN, TN�
MANAGEMENT SALARY SCHEDULE AND THE
RECLASSIFICATION/UPGRADES OF IDENTIFIED POSITIONS
Councilman Reyes stated he would like to make the hourly employees full time.
It was moved by Councilman Byrd, seconded by Mayor Pro Tem Sanchez and
carried to adopt Resolution: ' �

Item #5: PROPOSED SCHEDULE FOR FOUR-YEAR TREE TRIMMING
CONTRACT
Councilman Reyes stated he does not agree with the four year Tree Trimming
Contract.
Mayor Pro Tem Sanchez stated that the Council should have the tree frimming � i
done for the whole City instead of only partial parts of the City, believes it would '"`"
s�tisfied the City and the residents. �
It was movea 4Y Councilman Byrd, seconded by Mayor Richards to start the tree
trimming in Area i�;o. 3.

Item #6: AMENDMENT TO THE LEASE ��REEMENTS fOR REGENCY

It was moved by Councilman Byrd, seconded by Mayor Pro ; em Sanchez and
carried to adopt Resolution:

` Councilman Reyes stated that the 105 Freeway is calied a Landscape Freeway �
which prohibits billboards. Believes that if 4his is a fact then the City Council
should not vote on this Item.

� Mark Kudler – stated that by approving the Plan Amendment and Zone Change .
the Council is �making an illegal move. Stated Assistant City Attorney Glen
; Calsada mislead the Planning Commission and also questioned the City Council �
if they were going to allow these Billboards to come in to the City without a State
Business License.
Itwas moved by Councilman Reyes, seconded by Councilman Byrd and carried
to c(ose Public Hearing.
� , ` It was rnoved by Councilman Byrd, seconded by Mayor Pro Tem Sanchez to
adopt the Resolution waive reading and introduce Ordinance for first reading and
- certify this mitigated negative declaration. �
° _ ORDINANCE fIRST READING:
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD,
APPROVING ZONE CHANGE NO. 2001- 2002 WITH RESPECT TO EXCESS
CALTRANS PARCELS LOCATED ALONG AND ADJACENT TO THE NORTH
SIDE OF `THE I-105 (CENTURY) FREEWAY BEGINNING AT THE
SOUTHEAST CORNER . OF IMPERIAL HIGHWAY AND FERNWOOD
AVENUE, RUNNING�EAST TO THE SOUTHWEST CORNER OF ATLANTIC
AVENUE AND FERNWOOD AVENUE. THE ZONING DESIGNATION WOULD
BE AMENDED FROM "NO ZONING" TO C-2 (LIGHT COMMERCIAL).

' Councilrnan Reyes stated he is concern about the Billboards, would really like to
know if this procedure is legai, stated he cannot support staffs recommendation
, at this tirne. `
Councilman Rea stated he agrees with Councilman Reyes and he is also against
the Plan Amendment and Zone Ghange:
City Attorney Thever stated he has investigated the Plan Amendment and Zone
Change and we do stand on legal ground. . ,
Assistant City Attorney Calsada explained to the Council that we are not
' requesting a rezoning change, this is a no Zone. .
Mayor Richards questioned the Assistant City Attorney in regards to the Planning 4
Commission was it mislead.
�� Assistant City Attorney Calsada stated that the planning Commission was not
,—� mislead in any way, and also stated that the posting of the Agendas are posted in
there designated areas.

Item #11: SUSPENStON / REVOCATION OF TWO (2) BUSINESS LICENSE
FOR EL FARALLON �
It was moved by Councilman Reyes, seconded by Councilman Byrd and carried
to open. Public Hearing.
Mayor Richards stated he would like to continue this Public Hearing Item to
December 11, 2001 for further discussion.
City Clerk Hooper read a number of letters in favo� of the suspension revocation � I
of the Business License. . I

Michael Montgomery stated he would like for the City Council to continue thi§
Item.
Lorna Hawkins stated the residents are tired of the loud noise from EI Farallon,
believes the city should work with this business so they can come up with some
anderstanding.
Reverend Joe Mendez stated he is against the EI Farallon Restaurant, believes
the Council should revoke the license.
Lorain Reed stated she virouid like the staff to identified the Agenda Ifems in
more detail.
Gerardo Gonzales is against the Farallon Restaurant; stated there is to.rriuch
loud music and the business owners are selling alcohol to minors.
John Grave is against the Farallon Restaurant, stated it has caused to many•
problems in the City and for the residents also. ' '

Helen Luster is against the Farallon Restaurant, stated to the Council that it has i�
� gotten worse, this Restaurant should have never been built in a residential area �
Ted Namey stated to the Council that the residents a�e just blaming the Farallon
Restaurant for everything. , -
It was moved by Councilman Reyes, seconded by Councilman Byrd and carried
to close Public Hearing.
Mayor Richards stated he believes that some of the kids are jusf using the
cruising as an entertainment, and are causing problems for the City.
Michael Montgomery stated that it is true about the cruising happening in the
parking lot of EI Farallon Restaurant, but inside the Restaurant we have not'had
any problems. •
Ted Namey stated they are trying very hard to control the cruising and parking
violation issues. ' •
Mayor Richards stated these issues have to be taken care of as soon as
possible; there has been too much debate over the same issues. �

Ted Namey stated that Mc Emilio Franco is trying very hard to accommodate I �
everyone he is also willing to hire a couple of sheriffs to heip control the cruising
and parking issues.
It was moved by Councilman Byrd, seconded by Councilman Reyes to continue
this Item for further discussion.
Mayor Pro Tem Sanchez stated he believes we have enough proof to close the
Farallon Restaurant, and to also put some of the employees in jail for selling

alcohol to minors. The Council should stop debating and make a decision today.
" The Farallon Restaurant has brought drugs and prostitution to our Community. I
will not support the continuation of this Item.
Mayor Richards stated it is only fair for the City Council to give the
representatives of EI Farallon Restaurant and residents a chance to express their
� concerns and opinions.
� Councilman Rea stated the City Council should have never allowed this kind of
{ 1 problems into our City.

Councilman Rea stated it has been an honor to serve the City of Lynwood for -
over 12 years. I am grateful"with my staff and with the Council Members.
-. Councilman Byrd stated it has been a pleasure to serve with Councilman Rea,
and admires Councilman Sanchez because he stands to what he believes. .
Councilman Reyes wishes the Community a Happy Thanksgiving. �
Mayo� Richards stated it is amazing how much we have accomplished by
sticking together as Council Members. We have been loyal and dedicated to our
work and,our Community. I also admire and respect Councilman Sanchez and
Councilman Rea.
