REGULAR MEETING SEPTEMBER 16. 1980 The Ci~i:y Council of the City of Lynwood met in a regular session in the City Hall, 11330 Bullis Road, on above date, at 7:30 p.m. Mayor Green in the chair. Councilmen Byork, Morris, Rowe, Thompson and Green answered the roll call. Also present were City i?ranager Davis and City Attorney Murphy. SCHEDULED MATTERS It was moved by Councilman Byork, seconded by Councilman Thompson, and carried, that minutes of the adjourned regular meeting of September 2, 1980, and the regular meeting of September 2, 198G be approved. as ~rritten. The Mayor announced the time had arrived for public hearing on abatement of nuisance at 2958 Oakwood Avenue. The City Manager presented a report reviewing the actions taken by the Building Department in attempting to have removed from the subject premises the accumulation of lawn mowers, lawn mower parts and motors stored on the property, and informed Council that Notice of Public Hearing had been posted and also mailed to the affected property owner. The City Clerk administered the Oath for testimony before the City Council. The Mayor inquired if there was anyone present who wished. to speak in favor of the proposed abatement. Mr. Richard Stiles, Code Enforcement Officer, identified the property and testified that the photographs on display ~--- accurately describe and depict conditions of the premises ~ ~ and, in his professional opinion, they constitute a nuisance q within the meaning of the City Code. Photographs of subject premises were made a part of the record. Pub.Hrg. Nuis.Abate. 2258 Oakwoo The Mayor inquired if there was anyone present who wished to speak in opposition to the proposed abatement. Mr. Lee Randolph 2958 Oakwood .Avenue, testified in opposition to the proposed abatement, stating that six of the lawn mowers have been re- moved and that the remainder will be removed on Saturday. Mr. Randolph stated that he is the husband of the legal owner of the property, Mrs. Ludie Randolph. The Mayor inquired if there were any others wishing to speak. As there was no response, the. hearing was closed. RESOLUTION No. 80-99 entitled: "A RESOLUTION. OF 7.'HE CITY COUNCIL OF THE CITY OF LYNWOOD DETERMINING THAT A NUISANCE IS ~_ 80-99 BEING MAINTAINED ON CERTAIN PROPERTY AND DIRECTING THE ABATE- MENT THEREOF. " was presented with the recommendation that Abate rduis. Paragraph 4 of Section 3 be deleted. It was moved by 2258 Oakv~oo Councilman Morris, seconded by Councilman Rowe, and carried, that ti'1e resolution be adopted, as amended. The Mayor announced the time had arrived to conduct public Pub.Hrg. ~"' hearing on a proposed Conditional Use Permit to operate a C/U/P coin-operated car wash in a C-2A Zone on Lot 1030, Tract 3025, 11233 commonly know~z as 11233 Long Beach Boulevard. The City Manager Long Bch.. reported on the recommendations of the Planning Commission. Blvd. The Mayor inquired if there was anyone present who wished to speak in favor of, or in opposition to, the proposed Con- ditional Use Permit. Mr. Samuel Arbuthnot, General Contractor spoke in favor of the Conditional Use Permit and stated that the car wash will be an asset to the community. The Mayor inquired if there were any others wishing to speak. As there was no response, the hearing was closed. It was moved by Councilman Byork, seconded by Councilamn Thompson, and carried, that the resolution be adopted. ~. Hrn The Mayor announced the time had arrived to conduct public C~/p g~ hearing on a proposed Conditional Use Permit to operate a 4301 Carlin Pre-school on a currently existing church site (International Foursquare Church) in an R-3 Zone on Lot 35, J. J. Bullis Tract No. 30140, commonly known as 4301 Carlin Avenue. The City Manager reported on the recommendations of the Planning Commission. The Mayor inquired if there was anyone present who wished to speak in favor of, or in opposition to, the proposed Conditional Use Permit. Reverend Steve Overton, represent- ing Reverend and Mrs. Paul Hackett, spoke in favor of the Conditional Use Permit and stated that the pre-school has complied with requirements. The Mayor inquired if there were any others wishing to speak. As there was no response, the hearing was closed. RES. 80-105 RESOLUTION No. 80-105 entitled: "A RESOLUTION OF THE CITY App. C/U/P COUNCIL OF THE CITY OF LYNWOOD APPROVING A CONDITIONAL USE 4301 Carlin PERMIT TO OPERATE A PRE-SCHOOL IN AN R-3 ZONE ON PROPERTY DESCRIBED AS LOT 35, J. J. BULLIS TRACT NO. 30140, SPECI- FICALLY KNOWN AS 4301 CARLIN AVENUE, LYNWOOD." was presented. It was moved by Councilman Byork, seconded by Councilman Morris, and carried, that the resolution be adopted. Pub. Hrng. The Mayor announced the time had arrived for public hearing C/U/P on a Conditional Use Permit to operate an automobile and 122p6 So. furniture upholstery shop on Lot 13, Tract 12035, commonly Atlantic known as 1226 South Atlantic Avenue. The City Manager re- ported that although the Planning Commission has denied the Conditional Use Permit, it is Staff's recommendation that Council approve a Conditional Use Permit for a 6-month period, in view of proponent's attempts to up-grade the property. The Mayor inquired if anyone present wished to speak in favor of, or in opposition to, the proposed Conditional Use Permit. Mr. Gustavo Reygadas, 12424 Atlantic Avenue, spoke in favor of the Conditional Use Permit and stated he has already complied with certain requirements to clean up the property and plans to meet other conditions imposed. There being no one wishing to speak in opposition, the hearing was closed. The City Manager reported on the recommendations of the Planning Commission. The Mayor inquired if anyone present wished to speak in favor of, or in opposition to, the proposed Conditional Use Permit. There being no response, the hearing was closed. Mr. John Bell, 3325 Tecumseh Avenue, spoke in favor of the pro- posed Conditional Use Permit. There being no one wishing to speak in opposition, the hearing was closed. It was moved by Council- Blvd. man Byork, seconded by Councilman Morris, and carried, that the resolution be adopted. The Mayor announced the time had arrived for public hearing ~. Hrng. on a proposed variance to sell alcoholic beverages at 12006 Variance South Atlantic Avenue. The City Manager reported on the re- 12006 S. commendations of the Planning Commission. Atlantic The Mayor inquired if there was anyone present wishing to speak in favor of, or in opposition to, the proposed variance. ~ Mr. Raul Ornelas, 12006 Atlantic Avenue, spoke in favor of the proposed variance and stated that he purchased subject property with the intention of operating a restaurant. Councilman Morris stated he is not in favor of granting a variance to sell alcoholic beverages at the subject location in view of the fact that there are children residing on the same property. The Planning Director stated that staff is awaiting final plans from proponent. The Mayor. inquired if anyone else wished to speak in favor of, or in opposition to, the proposed variance. There being no response, the hearing was closed. It was moved by Councilman Morris, seconded by Councilman Rowe, and carried, to continue the public hear- ing to the next regular meeting, to provide Mr. Ornelas time to submit final plans. NEW BUSINESS The City Manager recommended that Council approve a program Trash bin to provide Block Watch groups with large trash bins for am clean-up purposes. It was moved by Councilman Rowe, seconded arod. by Councilman Thompson, and carried, that Council concur pp with the recommendation. ROUTINE ITEMS Permit app'd. It was moved by Councilman Morris, seconded by Councilman Lynwood Child Rowe, and carried, that the request for permission and tax & Fam. Dev. exempt business license from the Lynwood Child and Family Ctr. sale Development Center, Inc., to conduct an outdoor sale at the Alpha Beta parking lot on October 11, 1980, from 6:00 a.m. to 9:00 p.m. be approved. COUNCIL ORAL COMMUNICATIONS C. ~ pro_ Councilman Rowe submitted a sketch of proposed median for posed median Carlin Avenue, drawn as a result of a suggestion from Carlin Ave. Robert Downs at the last Council meeting. The plan provides for a 7 foot grass median in the center of Carlin Avenue from Bullis Road to Atlantic Avenue, with east and west roadways 34 feet wide, and parkways 12.5 feet wide. The preliminary cost estimate is $95,000-$100,000. Councilman Rowe stated that the proposed median would provide safer pedestrian crossings, better traffic control, area beauti- fication, and enhancement of property values. It was moved by Councilman Rowe, seconded by Councilman Thompson, and carried, that staff be instructed to conduct a feasibility study and ascertain if funds for the project are available from Economic Development Administration. Norris - prop. @ bong Beach & Century Mayor Green - Position Paper Councilman Morris commented on the unsightliness of proper- ty at the southeast corner of Long Beach and Century Boulevards, and recommended that Code Enforcement contact the owners of the property. The Mayor recommended that Council adopt as City policy, position paper entitled: "Barriers to Progress/Action for Progress in Lynwood." It was moved by Councilman Morris, seconded by Councilman Thompson, that Council concur with the recommendation. Roll Call: Ayes: Councilmen Byork, Morris, Thompson, Green. Noes: Councilman Rowe. Absent: None. The Mayor proposed that Council approve formation for an ad hoc committee to be named "Citizens' Committee for a Safer Lynwood" and recommended that the following individuals be N~yor Green - appointed to serve on the committee: Gary Cox, Carl Sherman, ~ Hoc Carmen Hernandez, Richard Torres, and Walter Laney. It was Committees moved by Councilman Byork, seconded by Councilman Morris, and carried, that Council concur with the recommendation. The Mayor recommended that two additional ad hoc committees be established for commercial and industrial issues, and City image. The Mayor requested Council to submit names of possible appointees by the next regular meeting. The Mayor recommended that Council refer issues designated as "Barriers I through VIII" in the position paper to the following committees and Commissions and assign staff to serve as liaison: ~ .~ I. PUBLIC ORAL COMMUNICATIONS Mr. George Martini, 10760 Alexander Avenue, addressed Council G.Martini rE to state he is in favor of Councilman Rowe's proposal to median & install a median on Carlin Avenue. With respect to the ad hoc committees committees discussed earlier in the meeting, Mr. Martini re- commended that Council appoint long-time community residents to serve on the committees. ~,..•-. Mr. Sal Ledesma, 3646 Lynwood Road, addressed Council to S.Ledesma inquire about the status of Lindberg Park. The City Manager re Lindberg stated the matter will be on the agenda for the November 4 Park meeting. Ms. Lavonne Weaver, 11244 Apricot Street, addressed Council L. Weaver rE to ask whose responsibility it is to abate weeds in the free- weeds, crimE way corridor; to comment on the high crime rate in the City; and to request a copy of "Barriers to Progress/Action for & position Progress in Lynwood." Per Mr. Frank Hinze, 3592 Mulford Avenue, addressed Council to complain about grass clippings left on the West side of Birch Avenue since July; to complain about burned out street lights on the East side of Birch Street; to complain about high weeds in the freeway corridor; and to request that something be done about cars parked on lawns. Councilman Rowe recommended that City Staff tour the City to see what needs to be done. Mr. Hinze complained about the lack of response by the Sheriff's Department regarding enforcement of the City Code. Mr. Walter Laney, 3667 Cedar Avenue, commended Council for instituting the trash bin program for Block Watch groups. He commented that there is a street sweeping problem on "'"" Cedar Avenue due to parked cars. Mrs. Camille Whitley, 11530 Virginia Avenue, addressed Council to complain about excessive speed by Sheriff's cars on Carlin Avenue; to recommend that adequate parking space be provided for Council meetings; to recommend that the trees in the parking lot be trimmed to afford better visi- bility at night; to complain about lack of information re- garding two recent crimes; to complain about slow response time from the Sheriff on a recent complaint about drag racing; to request more frequent patrol on Virginia Avenue; to complain that the relocation of a single family house and 4-car garage at 11579 Virginia Avenue is in violation of the City Code, as space requirements between buildings has not been met. It was moved by Councilman Morris, seconded and carried, .... that the meeting be adjourned to September 17, 1980, 7:00 p.m., at 11331 Plaza, for a joint meeting with the School Board.
