HomeMy Public PortalAboutM 1981-01-06 - CCe ~; i REGULAR MEETING JANUARY 6, 1981 The City Council of the City of Lynwood met in a regular session in the City Hall, 11330 Bullis Road, on above date at 7:30 p.m. Mayor Green in the chair. Councilmen Byork, Morris, Rowe, Thompson and Green answered the roll call. Also present were City Manager Weaver and City Attorney Murphy. SCHEDULED MATTERS It was moved by Councilman Byork, seconded by Councilman Thompson, and carried, that the minutes of the regular meet- ing of December 16, 1980 be approved as written. Pub.Hrg. The Mayor announced that the time had arrived to conduct 'Weed Abate. public hearing on proposed abatement of weeds at the follow- ing locations: Lot 6, Tract 14551; Lot 40, License Survey- or's Map; Lot 72, Tract 4936 and Lot 73, Tract 4936. The City Manager presented his report and informed Council that notices of public hearing had been mailed to the affected property owners. The Mayor inquired if anyone present wished to speak for or against the proposed abatement. Mr. Bob Downs, 3920 Carlin Avenue, stated that the weed abatement program has been a failure, particularly in the area in which he resides. He stated he has complained on several occasions regarding the lack of weed abatement on Mr. DeWitt's property. Mr. Downs expressed dissatisfaction with the City Administration's public relations. The Mayor inquired if anyone else wished to speak in favor of or in opposition to the proposed abatement. There was no response and the hearing was closed. Res. 81-1 RESOLUTION N0. 81-1 entitled: "A RESOLUTION PASSING UPON °Direct.Weed OBJECTION AND DIRECTING THE SUPERINTENDENT OF STREETS TO Abate. ABATE THE NUISANCE OF DRY AND DRYING WEEDS THAT EXIST ON CERTAIN PARCELS OF LAND IN THE CITY OF LYNWOOD." was presented. It was moved by Councilman Thompson, seconded by Councilman Byork, and carried, that the resolution be adopted. NEW BUSINESS Tractor The City Manager reported that two bids were received for Loader pur. Tractor Loader (Project 8-185-803) and recommended that bid app'd award be made to the low bidder, Case Power & Equipment, Bid award for $22,022.56. It was moved by Councilman Byork, seconded Case Power by Councilman Thompson, that Council concur with the & Eqpt. recommendation. Roll Call: Ayes: Councilmen Byork, Morris, Rowe, Thompson, Green. Noes: None. Absent: None. Dump truck The City Manager reported that five bids were received for pur. app'd Dump Truck (Project 8-185-802) and recommended that bid Bid award award be made to the low bidder, Downey Ford Center, for Downey Ford $22,795.00. It was moved by Councilman Thompson, seconded by Councilman Morris, that Council concur with the recommenda- tion. Roll Call: Ayes: Councilmen Byork, Morris, Rowe, Thompson, Green. Noes: None. Absent: None. The City Manager recommended that Council approve a policy of compensating each City Commissioner the sum of $15.00 per meeting attended, not to exceed two meetings per month. The City Manager recommended that the position of Building Maintenance Supervisor be deleted from the General Employees' portion and added to the Management portion of the Salary resolution and presented RESOLUTION N0. 81-2 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING RESOLUTION N0. 80-66, THE SALARY RESOLUTION." Ord. 1114 ORDINANCE N0. 1114 entitled: "AN ORDINANCE REPEALING Repealing SECTION 4-2 OF THE LYNWOOD MUNICIPAL CODE (ORDINANCE N0.703) Pinball ord. PERTAINING TO PINBALL MACHINES." was presented. Councilman Rowe inquired about the legality of repealing an initiative ordinance. It was moved by Councilman Byork, seconded by Mayor Green, that Council read by title only and adopt Ordinance No. 1114. Roll Call: Ayes: Councilmen Byork, Morris, Rowe, Thompson,Green. Noes: None. Absent: None. Lynwood Serv.The City Manager presented a letter from Lynwood Services Corp. Corporation requesting the City to enter into a formal discussion agreement for certain services. Councilman Morris recom- mended that staff be directed to prepare a contract with Lynwood Services Corporation setting forth the terms and conditions under which certain services would be rendered and specifying a dollar amount. Councilman Rowe recommended that the $.42,000 shortfall could be obtained by deferring expenditure of $255,000 budgeted for seven items which are not high priority items. Councilman Thompson stated.he'_.had concerns about expending $42,000 over the next nine months. He further stated he is not in favor of using revenue shar- ing funds for ongoing expenses. It was moved by Councilman Morris, seconded by Councilman Rowe, to direct the City Manager to prepare a contract between the City and Lynwood Services Corporation outlining the various types of services that Lynwood Services Corporation would undertake for the City. Councilman Thompson recommended that Council be provided with additional information regarding Lynwood Services Cor- poration program before a contract is prepared. Councilman Byork requested information regarding the nature and cost of a program. ~.~ .,~. The Mayor recommended that Council authorize a resolution in support of District Attorney John Van De Kamp's request for 80 additional deputies. Absent: None. An application fora special permit from Circus Vargas to conduct a carnival on March 10, 11 and 12 was presented. It was moved by Councilman Byork, seconded by Councilman Thompson, and carried, that the special permit be approved. Councilman Rowe also advised that the Lynwood Chamber of of City & Commerce will celebrate its 35th Birthday on March 4, 1981. Chamber 35t Councilman Rowe read a letter from Bion Gregory, Legislative Coun.Rowe r Counsel of California, to Senator Ralph C. Dills, dated Opinion fro December 15, 1980, in which the Legislative Counsel gives Legis.Coun. an Opinion that an initiative ordinance adopted by the voters ?"~` of the City of Lynwood may not be amended by the governing ~ body of the city without the approval of the voters. ~_. Councilman Rowe inquired if Council is willing to accept the Opinion. The City Attorney explained his :~n;~erpre.fation:~ a~__-Go~rernment C©de Section: 4013.'' Councilman Rowe: recommended that the issue be tested in court and court costs be borne by the City. The Mayor stated that Council-has no problem. Councilman Rowe advised that he will have the issue resolved by the court.
