HomeMy Public PortalAboutM 1981-04-07 - CCf , e-~ {~ REGULAR MEETING OF APRIL 7, 1881 The City Council of the City of Lynwood met in a regular session in the City Ha11,11330 Bullis Road, on above date, at 7:30 p.m. Mayor Green in the chair. Councilmen Byork, Morris, Rowe, Thompson and Green answered the roll call. Also present were City Manager Weaver and City Attorney Murphy. SCHEDULED MATTERS It was moved by Councilman Byork, seconded by Councilman Morris, and carried, that the minutes of the regular meeting of March 17, 1881 be approved as written. The Mayor proclaimed the period of April 20 to April 26, "Fifth Ann. 1881 "Fifth Annual Forgotten Victims Week." Mrs. Carmen Forgotten Hernandez, member of the Crime Committee, was present to Victims Wk" accept a copy of the proclamation. The Mayor announced that the time had arrived for public Public Hrgs. hearings to ascertain whether nuisances are being main- Nuisances tamed on certain properties. The oath for testimony before the City Council was administered by the City Clerk. The City Manager presented a report reviewing actions Nuisance at taken by the Building Department to have the condition of 11316 Atlan- the property at 11316 Atlantic Avenue corrected. Mr. Richard Stiles, Code Enforcement Officer for the City of Lynwood, identified the property and testified that the slides shown accurately depict the condition of the premises as of this date and that, in his professional opinion, they constitute a nuisance within the meaning of the Lynwood City Code. The Mayor again inquired if anyone else wished to be heard. There was no response and-the public hearing was closed. RESOLUTION N0. 81-~3 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA, DETERMINING THAT A NUISANCE IS BEING MAINTAINED ON CERTAIN PROPERTY AND DIRECTING THE ABATEMENT THEREOF." was presented. It was moved by Councilman Byork, seconded by Councilman Thompson, and carried, that the resolution be adopted. It was moved by Councilman Thompson, seconded by Councilman Morris, and carried, that the resolution be adopted. COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA DETERMINING THAT A NUISANCE IS BEING MAINTAINED ON CERTAIN PROPERTY AND DIRECTING THE ABATEMENT THEREOF." was presented. It was moved by Councilman Morris, seconded by Councilman Byork, and carried, that the resolution be adopted. Nuisance at The City Manager presented a report reviewing actions 4220 Shirley Ave .taken by the Building Department to have the condition of the property at 4220 Shirley Avenue corrected. The Mayor inquired if anyone present wished to speak in favor of or in opposition to the proposed abatement. Mr. Richard Stiles identified the property and testified that the slides shown accurately depict the condition of the premises as of this date and that, in his profes- sional opinion, they constitute a nuisance within the meaning of the Lynwood City Code. The Mayor again inquired if anyone else wished to be heard. Councilman Morris inquired what could be done to prevent the owner from allowing the nuisance to recur. The City Attorney discussed the various alternatives available under the law. There being no one else wishing to be heard, the hearing was closed. ?RES. 81-46 RESOLUTION N0. 81-46 entitled: "A RESOLUTION OF THE ,Direct. Abate. It was moved by Councilman Morris, seconded by Councilman Thompson, and carried, that the resolution be adopted. NEW BUSINESS An Ordinance entitled: "ORDINANCE OF THE CITY OF LYNWOOD AMENDING VARIOUS SECTIONS OF THE :~YNWOOD CITY CODE AND ORDINANCE N0. 570 RELATIVE TO NUISANCE ABATEMENT AND PREVENTION." was presented for first reading. It was moved by Councilman Thompson, seconded by Councilman ~""'" Byork, and carried, that the ordinance be read by title only and introduced. A RESOLUTION N0. 81-48 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AUTHORIZING SUB- MISSION OF AN APPLICATION FOR FUNDS AVAILABLE THROUGH THE STATE OF CALIFORNIA DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT." was presented. It was moved by Councilman Byork, seconded by Councilman Thompson, and carried, that the resolution be adopted. The City Manager recommended that Council authorize execution of an agreement with California Contract Cities Association to hire Mr. Dick Huntington, EBASCO, Inc., for a fee of One Thousand Dollars ($1,000) to perform a fire insurance feasibility study and assessment. The City Manager reported on bids received for Equipment Bid award Washing System and recommended that bid award be made to Hotsy Eqpt. It was moved by Councilman Byork, seconded by Councilman Morris, and carried, that the resolution be adopted. The Mayor recommended that service chgs. Council vote "NO" on the proposed service charges with disapproved the stipulation that the District be requested to submit a new proposal that might be more equitable for the citizens of Lynwood. It was moved by Councilman Rowe, seconded by Councilman Byork, that Council vote "NO" on the proposed service charge with the stipulation that the District be requested to submit a new proposal. OF THE STATE OF CALIFORNIA AND THE STATE DIRECTOR OF TRANSPORTATION TO TAKE IMMEDIATE POSITIVE ACTION TOWARD RENEWING THEIR VIGOROUS INTEREST FOR CONSTRUCTION OF THE I-105 CENTURY FREEWAY." It was moved by Councilman Morris, seconded by Councilman Thompson, and carried, that the resolution be adopted. Councilman Rowe asked where the company is located and whether it has a contract record. COUNCIL ORALS Coun. Morris It was moved by Councilman Byork, seconded by Councilman Thompson, that the following written statement by Councilman Morris be made part of the record. Roll Call: Ayes: Councilmen Byork, Morris, Rowe, Thompson, Green Noes: None Absent: None "Mr. Mayor, I would like a few minutes of Council's time to speak to an item that appears in Council's minutes of the last two meetings and hopefully put the item to rest. Mr. Robert Downs, on these two items of question and as a representative of "Concerned Citizens of Lynwood" has attempted to reprimand City Council for the resignation of Mr. Rocky Johnston. I have here an explanation of events that have a bearing upon that resignation.' The City Manager after being appointed, observed dis- crepancies with invoices and payroll as they applied to the HCD program. Within a few weeks, the County Housing and Community Development contacted the City Manager in regards to an investigation being performed regarding the rehabilitation program. They indicated that they were not receiving the administrative support of the then HCD Administration. At this point, the City Manager initiated discussion with Council regarding the problem in the """ administration of the HCD program. This information included facts in regards to the investigation, all cor- respondence to County administration, and problems on the lack of cooperation and apparent lack of leadership brought about by the director of HCD. In regards to the director, the City Manager informed Council on an individual basis that he would be asking for the director's resignation. The City Manager discussed with Rocky Johnston the need to sever his relationship with the City... that if he wanted to submit his resign- ation, it would be accepted. Just prior to that evening's Council meeting, the City Manager received Mr. Johnston's letter of resignation. This letter was xeroxed and placed into all Councilmen's mailboxes. While it is not my practice to check my mailbox just prior to the Council Meeting, a couple of councilmen did receive their copy and therefore knew of his resignation. The City Manager proceeded to provide the county with the information requested regarding the investigation. He also submitted progress reports to the Director of County HCD Program, Don Galloway. I have a letter from Mr. Galloway dated March 26, 1981 commending the City Manager and the Council for the action taken to satisfy the requirements of the Block Grant Program. Concurrently, the County initiated an audit for a period covering the: last eighteen months. This audit has just been made available to the City indicating the disallowed expend- itures in amount of some $164,000. Hopefully this amount can be lowered through negotiations with the County of L.A. Additional audits performed by the City have identified payments to employees for work performed while they were out of state. It is unfortunate that I bring these issues ~. out in this manner, however, I feel that the Council has sat back long enough and listened to allegations that the City Manager has acted in a disruptive manner and that the Council is ineffective." Byork Council Chamber. re Chamber Councilman Thompson expressed concern about the inter- Coun.Thompson pretation of the City Manager type of government in the re Sec. 2-23 City of Lynwood. He recommended that members of Council adhere to the provisions of Code Section 2-23 in the interests of unity and cooperation in working to solve the problems of the City. He stated that if any member of Council needs more information beyond the point of inquiry, it should be through the City Manager. Council- man Thompson requested Council to respond to his statement at a future date. Councilman Rowe responded that such an approach will change a long-standing tradition in the City. He stated that a city councilman is elected to represent the people and that he is not elected to deal strictly through the City Manager. PUBLIC ORAL COMMUNICATIONS Joy Feryanitz, 10851 Alexander Avenue, addressed Council J.Feryanitz to commend the Mayor on his record of accomplishment, Mayor Green specifically the Hot Meal and Dial-A-Ride programs; to state that the public should be made aware of the fact that the Mayor is a man of sensitivity, a family man and a member of the Methodist Church. Mrs. Feryantiz praised the Mayor for having done an excellent job in office. Adele Kropp, 5422 Olanda Avenue, addressed Council to A.Kropp - commend the City Manager for the courtesy he has shown corrmiendation to the public. Katie Miller, 11.350 Hulme Avenue, addressed the Council K.Miller - to commend the City Manager for assisting members of the commendation Block Watch groups, and to state that Mr. Weaver is doing a fine job . Edward Castro, 4542 Arlington Avenue, addressed Council E.Castro to commend the Sheriff's Department for solving a parking commendation problem and to commend the City Manager. Bob Downs, 3920 Carlin Avenue, addressed Council to inquire why there are five Sheriff's cars in the parking lot; to complain about overgrown weeds on a vacant lot across the street from his home; to advise that over- grown weeds on property owned by Sam Menlo on Atlantic Avenue is a fire hazard; and to inquire if the City plans to put the Newsletter out for bid. B.Downs - Sheriff's car: weeds, new- letter Thelma Brooks, 3351 Virginia Avenue, addressed Council to T.Brooks - state that she has seen an improvement in the City in the corrnnendation last year and to commend the City Manager for his efforts in putting a new face on the City. Beverly Hopkins, 11279 Pope Avenue, addressed Council to B.Hopkins--- request that dead trees in the City Park be removed. trees Lucille Davidson, 4537 Cardwell Avenue, addressed Council L.Davidson - to commend the City Manager for his cooperation in commendation solving problems of street lights and street sweeping in her neighborhood. She stated that members of her Block Watch group have signed a statement expressing confidence 1 in the City Manager. C.Hernandez - Carmen Hernandez, 11516 Pope Avenue, addressed Council to commendation state that she has been a resident of the City for more than ~0 years and that she considers Lynwood to be a beautiful city; to commend Council for supporting the City Manager; to state that lack of a college degree should not be an impediment to office; to state that people are pleased with the City Manager's performance and to observe that the City Manager is a person of intelligence and sincerity. P.Brown - Percy Brown, 11221 Pine Avenue, addressed Council to commendation state that he was shocked to learn that the City Manager's position is in jeopardy and to state that he has the highest regard for the City Manager. S.Grayer - Stanley Grayer, 11130 Elm Street, addressed Council to commendation commend the City Manager. A.Hooper - Andrea Hooper, 119~IO Lindbergh Avenue, addressed Council Highland Manor on behalf of the Compton-Lynwood Realty Board, to ask what could be done about the problem of Highland Manor residents who wander into local offices and businesses requesting food, water and money. Councilman Morris recommended that the State legislators, State and County Health Departments be contacted to see what can be done to remedy the problem. J.Watkins - John Watkins, Senior Vice President of Jorgensen Steel City problems Company, addressed Council to state that Jorgensen Steel & commendation is concerned about the problems facing the City; to ex- press concern about graffiti and the deterioration it signifies; to comment that Jorgensen Steel has supported graffiti removal programs; to urge that all join together and work together to solve problems; to state Jorgensen Steel has a stake in the City; to advise that Western Gear is working to buy property that Young People of Lynwood now rent; to state that Jorgensen Steel is inter- ested in seeing that the youth program continue and to commend the City Manager on his performance in office. Executive sess. Council adjourned to Executive Session for discussion of personnel matters.
