HomeMy Public PortalAboutM 1981-08-18 - CC~,~~ REGULAR MEETING AUGUST 18, 1981 The City Council of the City of Lynwood met in a regular session in the City Hall, 11330 Bullis Road, on above date, at 7:30 p.m. Mayor Byork in the chair. Councilmen Green, Morris, Rowe, Thompson and Byork answered the roll call. Also present were City Manager Weaver and City Attorney McEwen. SCHEDULED MATTERS It was moved by Councilman Morris, seconded by Councilman Green, and carried, that minutes of the regular meetings of July 21, 1981 and August 4, 1981, be ap~roved. The City Manager reported on the property at 2719 Fernwood, stating that disabled vehicles are in the driveway and that although the property is zoned R-1., it is being used for income purposes. A garage and storage rooms have been con- verted to illegal living quarters. Authority exists under Chapter 21 of the City Code for the Council to declare such property a public nuisance. On June 1, 1981., a 30-day notice was mailed to Mr. Gurule advising him to.`vacate and convert back to a garage. The structure is va~ga~#~ed, but no attempts have been made to .correct any of the vi'~Zlations. Since all attempts to abate this alleged nuisance'°have failed the City must take other measures and at the last Council meeting a public hearing was set for this meeting. Mr. Richard Stiles, Code Enforcement Officer for the City, was introduced, who narrated an audio-visual presentation of -.~ violations on this property. ~~~ The City Manager recommended that Council introduce and waive further reading a Resolution entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA, DETERMINING THAT A NUISANCE IS BEING MAINTAINED ON CERTAIN PROPERTY AND DIRECTING THE ABATEMENT THEREOF." The Mayor inquired if anyone present wished to speak in favor of or in opposition to the property being declared a nuisance. 2719 FezT~x~od Nuisance Mr. Gurule, owner of the property, stated that the presentation MR. GURUL was correct but that the property has been corrected now and OWNER OF he has disconnected the things he was told to disconnect. He ABOVE was told that the garage could be used for guest quarters NUISANCE only, not rental property. The driveway is a long 3-car COMMENTS driveway, and the back houses are in the same condition now they were when he purchased the property. He stated he doesn't want to rent any more, all he wants to do is improve the property so he can sell it. Mr. John Lucas, 11638 Louise, stated that the addition has J. The matter was REPORTED directed to Code Enforcement who inspected the property and referred it to the Building Department. Councilman Green said the owner has a definite misunderstand- ing, because he is working on the front house and it is the rear property we are concerned about. It was moved by Councilman Rowe, seconded by Councilman Thompson, ABOVE and carried, that this matter be held over until the next ITEM Council meeting. Code Enforcement and the Building Department TABLED should state clearly to Mr. Gurule what corrections should be completed by the September 1 Council meeting. ~- NEW BUSINESS The City Manager reported that a hearing date of September 1 , 1981, 7:30 p.m. in the Council Chambers be set for hearing ob- ~, jections to weed abatement on certain properties. He stated 81_113 that the City Attorney has reviewed this procedure, as wail as ~~ RESOLUTION No. 81-113 entitled: "A RESOLUTION OF INTENTION TO Abatement ABATE DRY AND DRYING WEEDS ON CERTAIN PARCELS OF LAND IN THE CITY OF LYNWOOD." which he recommended be adopted after which notice will be mailed to the owners of the property informing them of the public hearing. It was moved by Councilman Morris , seconded by Councilman Green, and carried, that this Resolution be adopted. Ly=~,~ The City Manager reported that the Lynwood Unified School Unified District is leasing land from the City on which a relocatabie School classroom has been set to house the Junior High Opportunity Dist Class, and they are desirous of continuing this lease. Since . Agreement the City is desirous of continuing to make available said land to the Board of Education, he recommended that Council authorize the Mayor to execute the Agreement between the City and the Lynwood Unified School District, which has incorporated into it the revisions recommended by the City Attorney. It was moved by Councilman Thompson, seconded by Councilman Green, and carried, that this request be granted. The City Manager presented an amendment to the employee classi- fication and position plan, stating that the purpose of this action is to include descriptions for Aquatics Director; RES. Accounting Technician; Assistant to the City Manager; and to 81-ll4 delete Director of General Services title. He stated that AMEND RES. Resolution No. 81-49 adopted the Plan on April 7, 1981, follow- TO INCLUDE ed by Resolution No. 81-94, FY 1981-82 Budget adopted July 7, AQ. DIRECTOR 1981• In the FY 1981-82 Budget, the classified position of ASST TO C/M Aquatics Director and the civil service exempt positions of ACCTG TECH. Assistant to the City Manager and Accounting Technician were DELETE approved, with the position of Director of General Services DIR OF GENL eliminated.. The proposed Aquatics Director classification, SERVICES with only a minor revision,. was .a.ncluded in the 1974 Classi- fication Plan and approved by the Personnel Board at that time. The exempt Accounting Technician is identical to the one in the classified section. The Assistant to the City Manager is a new statement reflecting this is a staff rather than a line position, which position replaces the former position of Director of General Services, with no modification in salary. RESOLUTION No. 81-114 entitled: "A RESOLUTION OF T.HE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING RESOLUTION idO. 81-49, THE EMPLOYEE CLASSIFICATION AND POSITION PLAN, TO INCLUDE AQUATICS DIRECTOR, ASSISTANT TO THE CITY MANAGER, ACCOUNTING TECHNICIAN, AND TO DELETE DIRECTOR OF GENERAL SERVICES." was presented. It was moved by Councilman Green, and seconded by Councilman Thompson that this Resolution be adopted. Roll Call: Ayes: Councilmen: Green, Morris, Thompson, Byork. Noes: Councilman: Rowe. Absent: None. The City Manager reported on a Civil Service exclusion, stating EXCLUDE THREE that the purpose of this action is to designate three positions POSITIONS as excluded from the Classified Personnel System. Ordinance FROM CLASSI- No. 110b amended Section 24-32 of the City Code to permit these FIED SYSTEM exclusions, and further resolutions have designated certain ASST TO C/M other positions exempt. He stated that a reorganization D 1 R. OF COMM approved by the Council has established the positions of DEV/ASST C/M Assistant to the City Manager, Director of Public Works/City DIR. OF PUB Engineer, and Director of Community Development/Assistant City WKS/CITY ENG. Manager. The individuals involved are unclassified, as their previous positions were exempted from the Civil Service System. ~. It was moved by Councilman Morris, and seconded by Councilman Green, that this Resolution be adopted. Roll Call: Ayes: Councilmen: Green, Morris, Thompson, Byork. Noes: Councilman: Rowe. Absent: None. The City Manager reported that Resolution No. 81-86, the Salary Resolution, was adopted at the Council meeting of June 23, 1981. Resolution No. 81-94, the City of Lynwood's Budget for FY 1981-82, was adopted by Council July 7, .1981. The management civil. service exempt portion of the salary schedule should be amended to delete Economic Development Analyst and RES. move the Water Billi~ig Supervisor from lEM to the 2EM salary 81-11.6 range, as approved in the FY 1981-82 Budget. The general AMENDING employees portion should. be revised to include Aquatics Director NO 81-8i at the 11G range. The general civil service exempt portion should be amended to add the title of Accounting. Technician. After deleting Economic Development Technician and its salary range, the Accounting Technician can be inserted as 2EG. RESOLUTION No_ 81-116 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING RESOLUTION N0. 81-86, THE SALARY RESOLUTION." was presented. COUNCIL OF THE CITY OF LYNWOOD ALLOWING AND APPROVING THE gl-ll7 DEMANDS PRESENTED AND ORDERING WARRANTS DRAWN THEREFOR." was ~ presented. ' 1~G The City Manager reported that the City had been. awarded a Dial A Grant from Caltrans Secretary's Discretionary Funds in the Ride (2) amount of $38,944 for the purchase of two Dial-A-Ride vans to provide transportation for i Vans sen or citizens within the City. Requests for bids were advertised Two r purchase . esponses were re- ceived - $50,008.80 and $40,836.50, from Creatira Transportation Systems, Inc. and Superior Trans-Med respectively. All guide- lines provided by Cal trans have been addressed,. reviewed and approved, as per agreement. The bids were for more than the Grant provided, so he recommended that Council accept the low bid of $40,836.50 from Superior Trans-Med for the two vans , and appropriate funds to cover the shortfall of Grant funds from the Garage fund. After discussion it was moved by Councilman .Green, seconded by Councilman Morris, and approved, that Council accept Superior Trans-Med's bid of $40,836.50 for the two Dial-A-Ride Vans. INFORMATION ITEMS The City Manager presented an Agreement on Animal Control ~~ services from the DepartTnent of Animal Care and Control, Control County of Los Angeles, to compare their services with that of services the Southeast Area Animal Control Authority. He explained the methodology used in estimating costs to cities. Af ter dis- cussion, it was moved by Councilman Thompson, and seconded by Councilman Green, to continue the contract with SEAACA, re- ducing the service to 2400 patrol hours, to be specified by us in the contract. Absent: None. .ouncilman In response to Councilman Rowe's inquiry at the August 4 2c~re re Council meeting regarding carpeting purchase, the City Manager :~,^pe,~ng presented invoices and explained that this project was rot ~~~~ considered by Staff to be one project for carpeting the entire City Hall because of the method in which the remodeling jobs were completed. Councilman Rowe stated that this report does not answer his original question and that this matter is not closed. COUNCIL ORAL COMMUNICATIONS =ouncilman It was moved by Councilman Morris, and seconded by Councilman Morris re Green, to amend the City Council minutes of August 4, 1981 to =~Pe~g indicate that Councilman Rowe refused to divulge his source of a lower carpeting bid from a Lynwood vendor. Mayor St'ork's Councilman Morris commented on Mayor Byork's recent trip made '~Y• re" to Washington, D.C. at the invitation of Mr. R. A. Barnhart, =ognition/ Federal Highway Administrator. On behalf of the entire Council council he presented the Mayor with a plaque signed by all four members ?lie of the Council, as well as Jim Weaver, City Manager, in re- cognition of his service, calling him the "Father of the Century Freeway." ~,~~. Councilman Morris commented on a letter received from Dr. C. MORRIS Gaines, 3542 Imperial Highway, regarding a situation in the SITUATION community existing at Highland Manor Guest Home.. Apparently, AT HIGHLAND tenants become quite inebriated, then throw bottles into MANOR neighbors yards; go into his office berating patients, etc. World Savings ~ Loan Association used to serve free coffee and doughnuts but do not any more because of these patients taking advantage of this situation. Couldn`t something be done to protect our citizens, store owners, etc.? The patients don't have to be incarcerated at the moment, but he blames the State for closing up too many of the mental institutions. The Sheriff's Department can't do anything with the patients because they don't have the authority, all they can do is take them back to Highland Manor. The City Attorney reported that the situation is apparently out CITY of control and the City needs to investigate conditions under ATTORNEY which, and what type of permit it is doing business . It's a difficult situation to deal with. Staff should commence investigation re conditions imposed on the facility. The City Manager was asked to pursue the matter. Councilman Rowe inquired whether the ballot statement for the C. ROWS purpose of the November 3 election would be ready by the dead- POSTING line at 5:00 p.m. tomorrow. All statements will be posted PARAMEDIC for 20 days, whether for or against the Paramedics. STATEMENTS Councilman Green reported on his concern about Highland Manor. Councilman Green moved advocating "no smoking" signs in the Council Chamber to include Council members also, but it died for lack of a second. Councilman Morris felt there should perhaps be the "smoking" and "no smoking" sections but not complete restrictions against smoking.. Councilman Rowe asked about his pipe smoking, and replies .from the audience agreed with Councilman Green, so Councilman Rowe assured everyone he would discontinue his pipe smoking. Councilman Thompson stated that perhaps Councilman. Rowe was in- formed incorrectly, that the Board of Supervisors in no way had to receive communication from Mr. Bussiere (SEAACA) or the County concerning the $l~ million from the general funds on animal control, because he (Thompson) is sure they have re- ceived copies from the Grand Jury stating this. GREEN RE "SMOKINI AND "NON- SMOKING" COMMUNICA- TION FROM BOARD OF SUPERVISOR RE ANIMAL CONTROL Mayor Byork reported on the letter we received from Mayor Wilson COMMENDATI Santa Fe Springs, thanking the Fire Fighters for their help FIRE DEPT July 10 and 11, and they will receive a copy of the letter. FR SANTA F SPRINGS Mayor Byork also commented on various letters of thanks we have been receiving regarding the new chairs in Bateman Hall. BATSMAN CHAIRS Mayor Byork thanked Council again for the plaque. THANK YOU C:~.ty Manager Weaver distributed an ordinance draft on Cable T/V FR MAYOR and proposed that at the September 1 meeting a public hearing be held to discuss the contents and introduce it as an ordinance, PUB HEAR stating that California Cablesystems, Inc. will have someone ING FOR present at that meeting to answer any questions. CABLE TV The City Manager reported on the passing away of Traffic and COMMISSION Parking Commissioner Gray. GRAY DEMIS Councilman Morris reported on the article in the paper regard- CABLE TV ing the cable system in the City of LaMirada. MACY RE- Mary Ann Macy addressed Council stating that she was not a PORT ON resident of Lynwood but that she does animal work in Los Angeles ANIMAL and is concerned about action taken here tonight, because she CONTROL thinks there is misinformation on both sides. FRANCE REQUEST FOR ASSISTANCE- DISABLED RESIDENTS SOUTHEAST AREA Ernie France, Director of Community Resources, Downey, requested $2,000 emergency assistance funding from our City towards their programming for disabled residents of the Southeast area. The City Attorney replied that any donation would have to be for the direct benefit to the citizens of Lynwood, taking care cf a service that the City would not otherwise provide. A meeting was arranged for them to meet with the City Manager Friday at 9:30 a.m. G. MORGAN Gilbert Morgan, 3643 Virginia, has lived here since 1976 and is WAY THINGS amazed at the way things are run here in the City. Regarding our streets, he has been trying to get his fixed be- cause he cannot get grass to grow. "What .does it take to gPt anything done here in the City instead of getting excuses about not enough tax money?" All the ~-trees near him are pruned, but not on his street. The street lights are no good, yet a lot of money is spent for this because of no pruned trees which cover the lights up. "Vandalism" is not the answer to the problems he has brought up here tonight; "minorities" is a cop-out in many cities, he feels. D. RICHMAN Dave Richman, 11068 Benwell Drive, commented on the newspaper ARTICLE RE articles regarding the SEAACA investigation. They use an SEAACA I N- archaic method of killing dogs . He doesn' t care if they aet VEST I GAT I ON the contract or not, but wants us to get services we ask for . "Shouldn't Council be interested in obtaining citizens input?" He wonders what the result would be if we find out some of these incidents are true. C. THOMPSON Councilman Thompson reported that he has done a considerable REMARKS amount of talking, checking and reading, with people in the "HOMEWORK" community about these things and has received input from citizens with hom he talks. When he makes his decision re will feel confident about it in his own mind, because he does his home work before arriving at~decisions made here in this room. D.
