REGULAR MEETING DECEMBER 15, 1981
The City Council of the City of Lynwood met in a regular
session in the City Hall, 11330 Bullis Road, on above date
at 7:30 p.m.
Mayor Byork in the chair.
Councilmen Green, Morris, Rowe, Thompson and Byork answered
the roll call.
Also present were City Manager Weaver and City Attorney McEwen.
It was moved by Councilman Morris, seconded by Councilman Green
and carried, that the minutes of the Adjourned Regular Meeting
of November 24, 1981, be approved as corrected, and minutes of
the Regular Meeting of December 1, 1981 and Special Meeting of
December 8, 1981, be approved as written.
SCHEDULED MATTERS

Lt. Ken Chausse, Lynwood Sheriff's Station, was present to
accept a copy of the proclamation. It was moved by .Councilman

PUB HEARING The Mayor announced that the time had arrived to conduct public

Opposition Mr. Joe Quevedo, 10801-10815 Long Beach Boulevard, spoke in op-

being held in abeyance. Mr. Quevedo stated that he wishes to
appeal the decision on the basis that there are other body
shops in the area and that his shop is in a commercial zone.

repair shops within the City; that statistics indicate 12 vehi-
cles a week are stolen, and that stolen automobiles are repainted,
reworked, and repaired.

Councilman Green commented that a neighboring city requires Councilman

Mr. Sammy Hill, 11720 Bullis Road, spoke in favor of the pro- Speaks in
posed ordinance stating that the outside realtors have an favor
unfair advantage over local realtors in that they do not ordinance
adhere to the City Code. He recommended the ordinance be
amended to allow signs on two corners and two main thorough-
fares. In response to the Mayor's inquiry, Mr. Hill stated
he is satisfied with the proposed amendment. Councilman
Morris inquired if Mr. Hill or the Compton-Lynwood Board of
Realtors had registered a complaint regarding violations of
the City's real estate ordinance and Mr. Hill responded that
he had requested repeal of the current ordinance which
specifies that directional signs on main thoroughfares
are prohibited. Councilman Green asked Mr. Hill if he
policed outside realtors for business licenses and Mr. Hill
responded that he had not. Mr. Hill stated that stronger
code enforcement is needed. Councilman Morris recommended
that the real estate ordinance be enforced and that the
City adjust its policy with respect to code enforcement on
Saturdays and Sundays.

ing. It was moved by Councilman Green, seconded by Council-
man Thompson, that the ordinance be read by title only and

Recommendation Councilman Rowe asked what kind of control the City would
of fee amount have. Councilman Thompson inquired how the City would deter-

City Manager stated that the City would have control through
inspections and that because of the amount of time required
for this, staff recommends a fee of $50 per newsrack. Council-
man Morris and Thompson stated that a fee of $50 per newsrack
is too high. The City Attorney stated that the exact amount
of the fee will be discussed later in the meeting.

NEW BUSINESS
The Mayor reported on a staff recommendation to hire an
--- Accounting Technician to handle the Community Development
Grant Programs, the Lynwood Redevelopment Agency Programs,
and the Lynwood Local Development Company Programs. It
was moved by Councilman Thompson, seconded by Councilman
Morris, that Council concur with the recommendation.
Councilman Rowe inquired how much of the salary will be
.applied to Lynwood Redevelopment Agency. The Mayor asked
for a report.

Councilman Rowe inquired. if there is a basis for need, and
the Fire Chief. responded in the affirmative, .stating that
Fire Station No. 1 is in poor condition. It was moved by
Councilman Thompson, seconded by Councilman Green, and
carried, that Council authorize call for bids for the re-
modeling of Fire Station No. 1.
ORDINANCE NO. 1142 entitled: "AN ORDINANCE OF THE CITY COUNCIL 0~•
OF THE CITY OF LYNWOOD REQUIRING .GENERAL MUNICIAPL ELECTIONS 1142

presented. The Mayor stated that a new law will enable the Consolida-
City to consolidate its General Municipal Election with tion
School District Election. It is estimated that consolidation
would result in a cost saving of $10,000 to $12,000 per elec-
tion. Councilman Morris explained SB-230 which became
effective on September 30, 1981.
It was moved by Councilman Morris, seconded by Councilman ADOPTION OF

adopted. Councilman Rowe questioned the estimated cost sav-
ings on the basis that it is an unknown factor. He pointed
,~,,, out that the ordinance will extend councilmembers' term of
office by 19 months, making the term of office 5 years and
~ 7 months rather than the 4 year term for which they were
elected. Councilman Rowe asked what recourse there is for
people who are not in favor of the ordinance. Councilman
Morris stated there was good cause for the passage of
Senate Bill No. 230, and that the Council has always tried
to reduce the cost of City government. Councilman Rowe
pointed out that the City spends $20,000 to $.35,000 per
year on travel and meetings.- Councilman Rowe asked what
justification there is for the ordinance which arbitrarily
extends a councilman's term of office without any input
from the public.

The City Attorney recommended that the resolution be amended
to add a fee for Mobile Homes under Community Development,
Page 5, Other .Fees, Section (c), as follows: Mobile Homes,
$25 plus $2 per lot or unit.
It was moved by Councilman Green, seconded by Councilman
Thompson, that the permit fee for newsracks be changed to
$25 per year.

meeting.
COUNCIL ORAL COMMUNICATIONS
Door-to-door Councilman Green requested a report regarding enforcement of
Solicitations prohibitions in connection with door-to-door solicitations.
Members of the Council extended Christmas Greetings to everyone.

conducted in the City of Lynwood, County of Los Angeles,
State of California, on Tuesday, the 3rd day of November, 1981,
as reouired by law; and
WHEREAS, notice of said election was duly and
regularly given in bile, form and manner as provided by law;
that said special municipal election was consolidated wit:~l the
L'rified Sc'rlccl District Board election held on the same date
and that, within the City of Lynwood the precincts, polling
places and election officers of the two elections were the
same, and that the Board of Supervisors of the County of Los
Angeles canvassed the returns of the special municipal elec-
~"" lion and declared in time, form and manner as required by the
provisions of the Elections Code of the State of California
for the holding of elections in cities; and
WHEREAS, pursuant to Resolution Io. 81-108, adopted
the 4t;'1 day of August, 1981, the Registrar of Voters canvassed
the returns of said election and has certified the results to
t;~lis City Council, said resu_tts are received, attached and
made a Dart hereof as "Exhibit A."

LYNWOCD, CALIFORNIA, DOES RESOLVE AS FOLLOWS:
Section 1. That at said special municipal election
the following measure was submitted to the electors of said
City, to wit:
"Shall ar, Ordinance providing for the levy

"Shall an Ordinance providing for the levy of a special
tax for fire protection and prevention service
(Paramedic service) be adopted?"
That the number of votes given at each precinct
for and against the measure were as listed in "Exhibit A,"
attached.
Section 5. That as a result of said election, a
two-thirds majority of the qualified voters voting on said
measure relating to Paramedic Service did not vote in favor
thereof, and that said measure was not carried, and shall
not be deemed adopted and ratified.
Section 6. The City Clerk shall enter on the
records of the City Council of said City a statement of the
result of said election showing:
(1) The whole number of votes cast in the City;
(2) The measure voted ugon;
(3) The number of votes given at each precinct for
and against each measure;
(4) The number of votes given in the City for and.
against ,each measure.
Section 7. That the City Clerk shall certify to
the passage and adoption of_this resolution; shall enter the
'same in the book of original Resolutions of said City; and
shall make a minute of the passage and adoption thereof in the
records of the proceedings of the City Council of said City,
in the minutes of the meeting at which the same is passed and
adopted.

suggest that a referendum is in order.
Dave M. Richman, 11106 Benwell Avenue, addressed Council to D. Richman
discuss concerns regarding the legality of a legislative Election
body extending a term of office and the implications and Ordinance
intent of the ordinance. The City Attorney stated that the
State Legislature has adopted procedures for consolidation
of Municipal Elections with School Board, General and Primary
Elections and has given them as a legal option to the com-
munities and that implementation of this, consolidation is
governed by the General Laws of the State.
Robert Henning, 13932 Carlin Avenue, addressed Council to R. Henning
request that records concerning the formation of Lynwood Formation of
Information, Inc., be made available for inspection, and Lyn Inf, Inc.
to express the opinion that putting off an election for
19 months is a joke.
Louis Dias, 3965 Beechwood Avenue, addressed Council to L. Dias re
state that the community does not want the two .incumbents to Election
occupy their seats for another 19 months; to state that the Extension
community's intent is to have an election; to state that
the taxpayers had no input. Mr. Dias complained of lack of
response by administration regarding his complaint that
there are 26 dogs at 3977 Beechwood Avenue.
Council adjourned to executive. session at 9:55 p.m. Follow-
ing the executive session., the meeting was reconvened.
It was moved by Councilman Morris, seconded by Councilman Negotiation
Green, and carried, that .Council authorize the City Manager R. Bonilla
to negotiate a Stipulation Agreement with Mr. Ricardo Bonilla W. Comp
regarding a workers' compensation claim. Claim

Morris, and carried, that the City Engineer be designated as City Engine
department head for Public Works, Water Department, Engineer-er Head

Thompson, that RESOLUTION NO. 81-169 entitled: A RESOLUTION Amending
OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING THE FISCAL FY Budget
YEAR 1981-82 BUDGET, SALARY RESOLUTION AND EMPLOYEE POSITION,
AND CLASSIFICATION PLAN."
