MAY 22, 2002 CONTINUED MEETING OF MAY 21, 2002 TO DISCUSS THE FOLLOWING THREE (3) ITEMS AS POSTED IN THE AGENDA FOR THE MEETING OF MAY 21, 2002 �. The City Council of the City of Lynwood met in an Adjourned Meeting in the Council ' Chambers, 11330 Bulfis Road on the above date at 6:43 p.m. Mayor Reyes presiding. Councilman Byrd, Pedroza, Richards, Rodriguez, and Reyes answered roll call. Also present were City Manager Gonzales, Interim City Attorney Montgomery, City Treasurer Pygatt, and Administrative Analyst II Adel Rojas. ' Administrative Analyst II Adel Rojas announced that the Item had been duly posted in accordance with the Brown AcL � Item #16: iJNITY PESTIVAL/JULY 4 CELEBRATION Mayor Reyes stated that Council would discuss the Beer Garden (Letter "D) of the July 4` Celebration. � Recreation and Community Services Director Jim Given stated that they are proposing to open a Beer Garden in a secluded area of the Natatorium patio and only those persons that meet the criteria, with a wristband will be allowed to buy alcoholic beverages, and i — the area will be well supervised. � ' Councilman Richards asked who's going to supervise this area. Mr. Given stated that City staff would supervise this area. There would be six (6) City staff inembers to serve alcohol and to check wristbands. Councilman Richards asked how many deputies would be available and what time would the Beer Garden open. Mr. Given stated that there would be two (2) deputies and two (2) Private securities, and it would open two (2) hours prior to the program and closed at dusk — per Department of Alcohol L3everage Control. Councilman Richards asked who's selling the alcohol and who's collecting the money. Mr. Given stared that Budweiser would provided the beer and four (4) City staff inembers would sel] the alcohol and collect the money. It was also stated that the money would be handled by the pool cashier. Mr. Given asked Recreation Superintendent Perry Brents to give more detailed information on the Beer Garden. Councilman Rodriguez asked the cost per barrel and Mr. Brents explained cost. Councilman Rodriguez also asked if there were any problems with the consumption of � alcohol at the Cinco de Mayo Celebration and did they anticipated any problems at this event. Mr. Brents stated that they didn't have any problems but did anticipated problems and that's why they had extra security and sheriffs. Councilman Rodriguez stated that he supports the Beer Garden because it will bring more revenue to the City. Mr. Brents explained that Lynwood is family oriented and not a lot of people consumed Alcohol. Councilman Byrd is concemed with the adults consuming alcoho] in the public view and also how much.would it cost for staff coverage. Mr. Brents stated that no beer would be , , � .�.� �. allowed out of the beer garden. Mayor Pro Tem Pedroza asked Mr. Brents if they had an estimate of what would be the wst for staff coverage. Mr. Brents explained staff and sheriff cost for this particular event. Councilman Byrd asked if any unused beer could be returned to the vendor. Mr. Brents responded that any unused beer would be returned to the vendor. He also explained that staff would check appropriate ID's and would issue tickets, once they have verified the individual's identity. Councilman Richards stated that he's not against the beer garden butjust concerned with ' security, staff expense and the safety of the residents, since the excessive consumption of alcohol have caused incidents. He continued to express his concerns regarding the beer gazden. Mayor Reyes stated that he has attended many events in the City and never noticed any incidents and hopes that the beer garden would bring more revenue to the city. Council members continued expressing their concerns relative to this item. It was moved by Councilman Rodriguez, seconded by Mayor Pro Tem Pedroza to approve Beer Garden. ROLL CALL: AYES: COUNCILMAN RODRIGUEZ, PEDROZA, AND REYES NOES: COUNCILMAN BYRD AND RICHARDS ABSTAIN: NONE ABSENT: NONE Councilman Richards suggested that in the future other options can be pursued by obtaining other businesses that are willing to pay for the franchise fee for the right to sell beer to I5,000 people and for the City not to have legal problems. _. Item #22: REQUEST FOR SPECIAL PERMIT: STREET/ALLEY CLOSURE Mayor Reyes asked Mr. Murillo to explain exactly what's his request. Mr. Murillo stated that they are having a family reunion and would like to have a portion of the alley closed between Cortland and Lugo. This event would be from 8:00 a.m. to 6:00 p.m. Mayor Pro Tem Pedroza asked Mr. Murillo if his neighbors were awaze of his request. Mr. Murillo responded that they weren't notified, but in the past, Council has approved his request. Council members asked Mr. Murillo various concerns relative to his request. Mr. Murillo stated that he's not requesting the street closure but only the section of the alley behind his property. It was moved by Councilman Richards, seconded by Councilman Rodriguez to approve the special permit. � ROLL CALL: AYES: COUNCILMAN BYRD, PEDROZA, RICHARDS, RODRIGUEZ, ; ' AND REYES NOES: NONE — ABSTAIN: NONE ABSENT: NONE , ���� , Item #25: CLOSED SESSION ITEM Interim City Attorney Montgomery stated, with respect to every item of business to be discussed in joint Closed Session Pursuant to Section 54956.9: A. CONFERENCE WITH LEGAL COUNSEL — ANTICIPATED LITIGATION �~ 1. Number of Cases: One (1) Case Interim City Attomey Montgomery requested to add another case, which is an existing litigation — Shell ChemicaL The reason for the late notice is because he received response to offer a compromise. It was moved by Councilman Byrd, seconded by Councilman Richards to add Shell Chemical Case to Closed Session. ROLL CALL: AYES: COUNCILMAN BYRD, PEDROZA, RICHARDS, RODRIGUEZ, AND REYES NOES: NONE ABSTAIN: NONE ABSENT: NONE It was moved by Mayor Pro Tem Pedroza, seconded by Councilman Rodriguez and carried to recess to Closed Session at 725 p.m. Council reconvened at 7:57 p.m. Interim City Attomey Montgomery stated Council met on the aforementioned matters and stated on: �� Item #25: A. CONFERENCE WITH LEGAL COiJNSEL - ANTICIPATED LITIGATION 1. Blockbuster — Council instructed City Attorney to bring back an Ordinance that clarifies certain complaints and . issues that has been raised, and will bring an Ordinance for Emergency adoption at the next meeting. Votes were unanimously B. Name of Case: Shell Chemical Council instructed City Attorney to accept the settlement proposal negotiated with the Plaintiffs.
