HomeMy Public PortalAboutM 1982-01-19 - CCREGULAR MEETING JANUARY 19, 1982 The City Council of the City of Lynwood met in a regu- lar session in the City Hall, 11330 Bullis Road, on above date at 7:30 p.m. Mayor Byork in'the chair. Councilmen Green, Morris, Rowe, Thompson, and Byork answered the roll call. Also present were Acting City Manager Gomez and City Attorney McEwen. It was moved by Councilman Rowe, seconded by Councilman Green, and carried, that the minutes of the regular meeting of January 5, 1982, be approved as corrected. SCHEDULED MATTERS The Mayor announced that the time had arrived to conduct public hearing to ascertain whether a nuisance is being maintained on property commonly known as 12525 Atlantic Avenue. Mr. Richard Stiles, Lynwood Code Enforcement Officer, identfied the property and testified that the slides presented accurately depict the condition of the property as it exists as of this date. The Mayor in- quired if anyone present wished to speak in favor of or in opposition to the proposed abatement.. There was no response and the public hearing was closed. The City Attorney advised that notices as required by the Lynwood City Code have been mailed and posted. ""~ RESOLUTION NO. 82-7 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD DETERMINING THAT A NUI- SANCE IS BEING MAINTAINED ON CERTAIN PROPERTY AND DIRECT- ING THE ABATEMENT THEREOF."' was presented. It was moved by Councilman Green, .seconded by Councilman Thompson, that the resolution be adopted. ROLL CALL: Public Hearing 12525 Atlantic RES. NO. 82-7 NUISANCE ABATEM' Ayes: Councilmen Green, Morris, Rowe, Thompson, Byork Noes: None Absent: None The City Manager advised that the nuisance at 12501 Atlantic Avenue has been satisfactorily abated, and the item was deleted from the agenda. The Mayor announced .that the time had arrived to conduct Public Hearing public hearing to ascertain whether a nuisance is being 3977 Beechwood maintained on property commonly known as 3977 Beechwood Avenue. The City Manager reported that several complaints have been received from neighbors about dogs barking. The City Attorney stated that notices as required by the Lynwood City Code have been posted and mailed. The Mayor inquired if anyone present wished to speak in favor of or in opposition to the proposed abatement. Mr. Raymond Burton, 3977 Beechwood Avenue, spoke in opposi- tion to the proposed abatement stating that his dogs bark excessively because they are provoked by neighbors and that the dogs have been licensed and vaccinated. He read a letter signed by Michael Haack, Planning Technician, City of Lynwood, dated November 4, 1977 advising him that he may keep any dogs acquired before June 7, 1974 as an existing non-conforming use. Mr. Burton also read a portion of Ordinance No. 967, which limits the total number of dogs allowed to be kept to three. Mr. Burton read letters from neighbors at 3981 and 3968 Beechwood which stated that Mr.'Burtorl's dogs are 'not a problem and do not bark excessively. Mr. Burton pointed out that his dogs have prevented two attempted burglaries; that he has had the dogs for a number of years, and that at the present time he has eight dogs. The Mayor inquired if anyone else wished to be heard. There was no response and the public hearing was closed. Council- man Green stated that he visited the property a year ago and at that time found the dogs to be very noisy. Councilman Morris stated that Council has to consider other people and recommended that Council adhere to the ordinance. Council concurred. RES. No. 82-8 RESOLUTION NO. 82-8 entitled: "A RESOLUTION OF THE PUBLIC NUISANCE CITY COUNCIL OF THE CITY OF LYNWOOD DETERMINING THAT A ABATEMENT NUISANCE IS BEING MAINTAINED ON CERTAIN PROPERTY AND DIRECTING THE ABATEMENT THEREOF." was presented. It was moved by Councilman Green, seconded by Councilman Morris, that Mr. Burton be given sixty days to abate the nuisance. ROLL CALL: Ayes: Noes: Absent: Councilmen Byork None None Green, Morris, Rowe, Thompson, PUBLIC HEARING The Mayor announced the time had arrived to conduct Amusement Arcades public hearing on proposed amendment to Ordinance No. 570 regulating the use and location of amusement arcades in commercial zones. The Manager stated that the City currently has no regulatory ordinance. The Mayor inquired if anyone present wished to speak in favor of or in op- position to the proposed amendment. Mr. Rudy Maestas, 3262 Flower Street, inquired how many amusement arcades are currently licensed and was advised that four such businesses are licensed. Hazel Von, 5400 Fertile Avenue, stated that she has observed young boys using food stamps to play the video machines at Food King. Mr. Ryan spoke in favor of the proposed ordinance stating that distances from school should be regulated. Mr. Ryan advised that there are problems during after school hours at the arcade at Lavinia and Atlantic Avenues. Mr. Gary Benson, 1043 Stonebank, Bellflower, stated he is part owner of an amusement arcade at Century Boulevard and Bullis Road, and that he feels video machines offer young people a worthwhile activity. He added that he is cooperating with the School Board with respect to hours and is of the opinion that arcades could be a source of job training for youth. Councilman Morris stated that it is the duty of Council to set certain rules for amusement arcades. He commented that some children are using their lunch money to play the machines. Mr. Benson stated he would not be in favor of limiting the number of machines. Beverly Hopkins, 11279 Pope Avenue, spoke in favor of the proposed amendment. 5... .~-u ~.~ '-. .~ Carmen Hernandez, 11516 Pope Avenue, questioned the previous speaker's remark that amusement arcades could be a source of job training and expressed doubt that Drs. Webb and Knight had given consent. Dave M. Richman, 11106-B Benwell Drive, stated that any regulation. should be on the basis of safety or morality and that amusement arcades do not fall into either category. He asked how the provisions of the ordinance with respect to hours would be enforced. Mr. Ryan stated that video games have created prob- lems for him with his children and other people's children. He stated there should be some control over the machines. ORDINANCE NO. 1150 entitled: "AN URGENCY ORDINANCE OF ORD NO. 1150 THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING ORDI- Amusement Arcad NANCE NO. 570 (ZONING ORDINANCE) REGULATING THE USE AND LOCATION OF AMUSEMENT ARCADES IN THE CITY'S COMMERCIAL ZONE." was presented. It was moved by Councilman Morris, seconded by Councilman Rowe, that the ordinance be read by title only and adopted. AN ORDINANCE .entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING ORDINANCE NO. 570, THE ZONING ORDINANCE, BY CHANGING ZONING CLASSIFICATION OF CERTAIN PROPERTY FROM R-3 TO H-M-D." was presented for first reading. It was moved by Councilman Thompson, seconded by Councilman Green, that the ordinance be read by title only and introduced. NO. 82-9 COUNCIL OF THE CITY OF LYNWOOD APPROPRIATING MONIES FROM HCDA BLOCK PROD THE CITY GENERAL FUND TO A SPECIAL FUND FOR PAYMENT TO LOS ANGELES COUNTY FOR DEFICIENCIES IN THE LYNWOOD HOUS- ~--- ING AND COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM." was presented. The City Manager reported that an audit of the Community Block Grant Program indicates that the City owes the County an additional $2,039 which staff recom- mends be paid over a 30-month period. DEMANDS Jan 19, 82-10 RESOLUTION NO. 82-10 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD ALLOWING AND AP- 1982 PROVING THE DEMANDS AND ORDERING WARRANTS DRAWN THEREFOR." was presented. It was moved by Councilman Green, seconded by Councilman Thompson, that the resolu- tion be adopted. ROLL CALL: Ayes: Councilmen and Byork Noes: None Absent: None OLD BUSINESS Green, Morris, Rowe, Thompson, AGREEMENT The City Manager presented an agreement with California Hazard Elim Department of Transportation for Hazard Elimination safety Project Safety Project (Traffic Signal Upgrade and Interconnect Project, at various locations) Fiscal Year 1981-82 CIP, with the recommendation that Council approve the agree- ment and authorize a call for bids. It was moved by Councilman Green, seconded by Councilman Thompson, that Council concur with the recommendation. No. 82-11 RESOLUTION NO. 82-11 entitled: "A RESOLUTION OF THE HCDA YEAR VII CITY COUNCIL OF THE CITY OF LYNWOOD AUTHORIZING THE APPROPRIATION OF SIX HUNDRED ONE THOUSAND, EIGHT HUNDRED NINETY SEVEN DOLLARS ($601,897) AND ESTABLISH- ING ACCOUNTS FOR THE PURPOSE OF IMPLEMENTING HOUSING AND COMMUNITY DEVELOPMENT ACT (HCDA) YEAR VII PROJECTS PREVIOUSLY APPROVED BY THE FEDERAL DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT AND THE COUNTY OF LOS ANGELES, AND THE CITY OF LYNWOOD." was presented. It was moved by Councilman Green, seconded by Councilman Thompson, that the resolution be adopted. Councilman Morris requested that the value of the Block Grant Program be publicized. STATUS status on solicitations from January 18 to April 18, 1982, was presented. oRD No. 1151 ORDINANCE NO. 1151 entitled: "AN ORDINANCE OF THE CITY AMENDING CB-1 COUNCIL OF THE CITY OF LYNWOOD AMENDING ORDINANCE NO. 570, to R-3 THE ZONING ORDINANCE, BY CHANGING THE CLASSIFICATION OF CERTAIN PROPERTY FROM CB-1 (CONTROLLED BUSINESS) TO R-3 (MULTI-FAMILY RESIDENTIAL)". was presented. It was moved by Councilman Green, seconded by Councilman Thompson, and carried, that the foregoing be approved. The City Attorney recommended that Council deny the Verified Claim of Fortunato Serrano et al. for Refund of Excessive Tax Payment (Secured Property Tax) in view of pending litigation. It was moved by Council- man Morris, seconded by Councilman Green, and carried, that Council concur with the recommendation. INFORMATIONAL ITEMS The City Engineer reported that installation of a flashing yellow light at Imperial Highway and Ruth Avenue was completed on January 6. Reverend C. C. Coleman, Pastor, New Life Baptist Church, 11516 State Street, addressed Council on the following matters: (1) to express concern about the lack of maintenance at Rose Park, State Street and to propose that Council consider rezoning the area or selling or leasing the property to New Life Baptist Church; (2) to recommend that something be done about the problems of prostitution and narcotics on Long Beach Boulevard and Atlantic Avenue; and to state that the hotels and motels in the City are a disgrace; and (3) to invite the Mayor to attend a state convention of the Congress of Christian Education to be held at the New Life Baptist Church on April 5, 1982, at 7 p.m. and to request that Council prepare a resolution for the occasion. The Economic Development Director advised that City will be receiv- ing approximately $4,200 within the next month which will be used to purchase 20 trash cans. The Mayor inquired if it would be possible to take advantage of an offer made by Mr. Santos Martinez, 5130 Imperial Highway, to give Lynwood youth instruction in welding, painting, etc. The Recreation Director will study the matter and report back to Council. Whitley Camille Whitley, 11530 Virginia Avenue, addressed various Council to suggest a possible solution to the problem of prostitution; to state that untrimmed trees in her neighborhood present a traffic hazard; to ask if some- thing could be done about the dip at Cortland and Atlantic Avenues; to request that the problem of stand- ing water at Cortland and Virginia Avenues be corrected; to suggest that a "Stop" sign be installed at that location; to inquire what is being done about the theatre building on Long Beach Boulevard; to advise that a catering truck parked daily at Fernwood Avenue and Fir Street is a traffic hazard; to inquire what percentage of monies the Fire Department receives from their annual fund raising event; to inquire about the status of the cable television franchise; to disagree with the decision to abate the nuisance at 3977 Beech- wood Avenue. Richman addressed Council to state that the various newly installed flashing light at Imperial Highway and Ruth Avenue has not helped since the crossing guard depends upon the light to escort children across the street- Mr. Richman suggested that a Black and White Sheriff's car be parked on Long Beach Boulevard to deter prostitution. x. von Hazel Von, 5400 fertile, addressed Council to request xoles that something be done about several holes near the corner at Thrifty Drugstore. ~- ~G.. , Rudolph Maestas, 3262 Flower Street, addressed Council to inquire if Caltrans has plans to clean up the debris resulting from the razing of apartments and houses in the freeway corridor. He stated he is having problems with roaches and rats which result from the demolition. Mr. Maestas recommended that Caltrans exterminate the rodents before razing.
