HomeMy Public PortalAbout2005-064 Resolution Granting PUD General Plan Approval for ACE PropertiesMember Weir introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. 2005-64 RESOLUTION GRANTING PUD GENERAL PLAN APPROVAL FOR ACE PROPERTIES, LLC. FOR PROPERTY GENERALLY LOCATED NORTH OF CLYDESDALE TRIAL, EAST OF COUNTY STATE AID HIGHWAY 101 WHEREAS, Ace Properties, LLC (the "Applicant") has requested approval from the city of Medina (the "City") for a PUD General Plan for a retail commercial building on property which is legally described in Exhibit A attached hereto (the "Property"); and WHEREAS, the PUD Concept Plan was heard by the planning commission at its meeting on June 14, 2005 and by the city council on June 21, 2005 according to City ordinance; and WHEREAS, the planning commission reviewed the PUD General Plan for its conformance with the City's ordinances on September 13, 2005 and, following a public hearing thereon as required by law, the planning commission recommended approval of the PUD General Plan subject to certain conditions; and WHEREAS, the city council reviewed the PUD General Plan on October 4, 2005 and November 1, 2005 for conformance with the City's ordinances. NOW, THEREFORE, BE IT RESOLVED, by the city council of the city of Medina, Minnesota that it should and hereby does approve the request by the Applicant for a PUD General Plan for the Property, subject to the following conditions: 1. The PUD General Plan is conditioned upon approval of the final plat of West Ridge Development Second Addition. 2. The PUD General Plan is subject to the revocation of the existing Conditional Use Permit, Resolution 88-99. 3. The PUD General Plan is subject to the approval of the rezoning of the Property to PUD-Urban Commercial. 4. The Applicant shall submit boulder wall engineering details. 5. The Applicant shall submit an updated photometrics plan for the Property with a reduction in parking lot luminaries or show lot line foot candle reductions that comply with the City lighting ordinance. Resolution No. 2005-64 November 15, 2005 1 6. The Applicant shall submit an updated landscaping plan that utilizes a perennial planting for the trellises that sustains foliage throughout the year. 7. The private improvement development plans shall comply with all fire marshall conditions. 8. The private improvement plans shall comply with all building codes. 9. The private improvement plans shall comply with all City engineering conditions and standards. 10. The private improvement and public improvement plans shall be approved by Hennepin County. 11. The private improvement plans shall be approved by the Elm Creek Watershed District. 12. The private improvements plans shall be approved by the Minnesota Pollution Control Agency. 13. The applicant shall submit an application for the PUD Final Plan in conjunction with the final plat of West Ridge Development Second Addition. NOW, THEREFORE, BE IT FURTHER RESOLVED, by the city council of the city of Medina, Minnesota that prior to the issuance of a grading permit for any work on the Property the following conditions must be met: 1. The Applicant shall submit an approved final grading and erosion control plan for the site development. 2. The Applicant shall submit an approved final earthwork calculations for the site development. 3. The Applicant shall submit an approved SWPPP plan for the site development. 4. The Applicant shall provide the City a cost estimate for the grading and erosion control improvements. 5. The Applicant shall provide a letter of credit in a format satisfactory to the City for the grading and erosion control portion of the improvements. 6. The Applicant shall provide the haul route for the excavation work that is satisfactory to the City. Resolution No. 2005-64 November 15, 2005 2 7. The PUD General Plan is subject to receipt and City approval of the agreement of easements, covenants and restrictions between the Appellant and Target Corporation. 8. The PUD General Plan is subject to the receipt and City approval of a reciprocal easement agreement involving West Ridge Development and West Ridge Development Second Addition. 9. The Applicant shall obtain a permit from the Minnesota Pollution Control Agency. 10. The Applicant shall obtain a permit from the Elm Creek Watershed District. 11. The Applicant shall obtain a City permit for grading and shall pay to the City a fee in an amount sufficient to reimburse the City for the cost of reviewing the related documents.
