AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING, AMENDING, AND
MODIFYING THE ZONING MAP OF THE ZONING CODE OF THE CITY OF JEFFERSON, BY
REZONING 1.81 ACRES FROM RS-2 LOW DENSITY RESIDENTIAL TO C-1 NEIGHBORHOOD
COMMERCIAL,LAND LOCATED ON THE NORTHERN CORNER OF THE INTERSECTION OF OLD
LOHMAN ROAD AND SOUTH COUNTRY CLUB DRIVE, LOCATED IN PART OF THE
NORTHWEST QUARTER OF THE NORTHWEST QUARTER OF SECTION 17, TOWNSHIP 44
NORTH, RANGE 12 WEST, JEFFERSON CITY, COLE COUNTY, MISSOURI AND ENDORSING
AN AMENDMENT ON THE DEVELOPMENT PLAN MAP OF THE COMPREHENSIVE PLAN TO
REFLECT SUCH CHANGE.
WHEREAS, It appears that the procedures set forth in the zoning code relating to zoning have in
all matters been complied with.
WHEREAS, The zoning ordinance requires consistency between the comprehensive plan and the
zoning map and the proposed zoning change would necessitate a change to the
Comprehensive Plan Development Plan Map.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
Section 1. The following described real estate is rezoned from RS-2 Low Density Residential
to C-1 Neighborhood Commercial: Part of the Northwest Quarter of the Northwest Quarter of Section
• 17, Township 44 North, Range 12 West, Cole County, Missouri, more particularly described as
follows: From the southwest corner of Section 8, Township 44 North, Range 12 West, Cole County
Missouri; thence N6 032'04"W, along the Section Line, 813.10 feet to the most northerly corner of a
tract described by deed of record in Book 401, page 939, Cole County Recorder's Office; thence
S55°48'04"E, along the northerly line of said tract described in Book 401, page 939, 309.05 feet to
the northeasterly corner thereof;thence S59 059'24"E,508.15 feet;thence S40 035'22"E, 148.52 feet;
thence S28°23'09"E,218.72 feet to a point on the north line of Section 17,Township 44 North, Range
12 West, Cole County, Missouri, and the POINT OF BEGINNING for this description; thence

The City Council of the City of Jefferson, Missouri, will hold a public hearing on Monday, July 16,

Case No. P07018 — Intersection of Old Lohman Road and South Country Club Drive;
Rezoning and Comprehensive Plan Amendment. Request filed by Dale and Alvyne
Scheperle, Gary and Brenda Scheperle, Keith and H. Renee Scheperle, and Janis and Eric
Miller, property owners, to rezone approximately 1.81 acres from RS-2 Low Density
Residential to C-1 Neighborhood Commercial and an associated amendment to the
development plan map of the comprehensive plan. The property is located on the northern
corner of the intersection of Old Lohman Road and South Country Club Drive. The property
is described as part of the Northwest Quarter of the Northwest Quarter of Section 17,
Township 44 North, Range 12 West, Cole County, Missouri. (Central Missouri Professional
Services, Consultant).
Mr. Nunn will abstain from discussion and voting for this request.
Mr. Mike Bates, Central Missouri Professional Services, 2500 E. McCarty Street, spoke
regarding this request. Mr. Bates distributed a visual depicting the area to be rezoned. He
explained that the Clifford Scheperle Trust voluntarily annexed the subject property a few years
ago. Mr. Bates explained that the purpose of the rezoning is to make the RS-2 zoned property
to the south and west compatible with the C-1 zoned property to the north.
. No one spoke in opposition to this request and no correspondence was received.

Mr. Barron gave the Planning Division staff report and explained that the purpose of the
rezoning request is to match the zoning of the rest of the property parcel and to make the
property available for commercial development. He stated that being located between an arterial
street (Country Club Drive) and an existing tract of C-1 zoned land, the property lends itself well
to a Neighborhood Commercial zoning designation. However, the commercial zoning would be
in contrast to the existing single family residential development in the area. He stated that staff
is neutral on the request to rezone the property from RS-2 to C-1 and the associated
comprehensive plan amendment.
Mr. Jordan-moved and Ms. Hoskins-seconded to recommend approval of rezoning property
located at the intersection of Old Lohman Road and South Country Club Drive from RS-2 to C-1
and an associated Comprehensive Plan Amendment, to the City Council. The motion passed 5-0
with the following votes:
Aye: Deeken, Hagan, Hoskins, Jordan, Yarnell

The Comprehensive Plan in 1996 did not anticipate the construction of
South Country Club Drive as an arterial roadway.
b. Whether events subsequent to the Comprehensive Plan adoption have
invalidated the Commission's original premises and findings made upon
plan adoption.
The recent changes to and adoption of the Thoroughfare Plan will alter
the next Comprehensive Plan.
C. Whether the change is consistent with the goals, objectives and policies of

SCHEPERLE REZONING

a. The existing zoning was in error at the time of adoption.
Any error was one of omission, rather than commission. There was no plan
to improve South Country Club Drive as an arterial roadway in 1996.
b. There has been a change in character in the area due to installation of
public facilities, other zone changes, new growth trends, neighborhood
deterioration, or development transitions.
South Country Club Drive has been improved to arterial roadway standards
by the City and the County.
C. There is a community need for the proposed rezoning.
The City would benefit by the proposed development adjoining the arterial
roadway.
• d. The proposed change is consistent with, and in furtherance of, the implementa-
tion of the goals and policies of the Comprehensive Plan, other adopted plans,
and policies, intents and requirements of this Ordinance and other City
regulations and guidelines.
The change would be consistent with any proposed update of the comprehensive
plan.
e. The proposed zoning is compatible with the zoning and uses of property
nearby.
The existing zoning throughout the area is a mix of commercial, industrial,
public and parks. C-1 neighborhood commercial is believed to be a compatible
use with existing and proposed development.
f. Public and community facilities, which may include, but are not limited to,
sanitary and storm sewers, water, electrical service, police and fire protection,
schools, parks and recreation facilities, roads, libraries, and solid waste
collection and disposal, are available and adequate to serve uses authorized
under the proposed zoning.
All public facilities are available.

g. A traffic impact analysis has been provided to indicate the potential
number of new trips generated and provisions are provided to mitigate
impacts of high traffic-generating projects.
There is no requirement for a site specific traffic impact study. The platting
and planning process will address this issue in the ficture.
h. Authorized uses shall not adversely affect the capacity or safety of
the street network in the vicinity of the property.
We believe the proposed land use can peacefully exist within the area.
L Potential environmental impacts (e.g. excessive storm water runoff,
water pollution, air pollution, noise pollution, excessive lighting, or
other environmental harms) of authorized uses shall be mitigated.
There are no anticipated environmental impacts from the rezoning.
j. There is an adequate supply of land available in the subject area and the
surrounding community to accommodate the zoning and community needs.
There is significant open land adjoining the property.
k. Benefits shall be derived by the community or area proposed to be rezoned.
The City will continue to benefit from the well planned and orderly development
of the area between South Country Club Drive and Highway 50.
