CITY OF MEDINA
RESOLUTION NO.2005-65
RESOLUTION GRANTING PRELIMINARY PLAT APPROVAL FOR ACE
PROPERTIES, LLC. FOR WEST RIDGE DEVELOPMENT SECOND
ADDITION
WHEREAS, Ace Properties, LLC (the "Applicant") has requested approval from the city
of Medina (the "City") of a preliminary plat to be known as West Ridge Development
Second Addition to allow construction of a six -tenant retail commercial building; and
WHEREAS, the preliminary plat was reviewed by the planning commission at its
meeting on September 13, 2005 and, following a public hearing thereon as required by
law, the planning commission recommended approval thereof, subject to certain terms
and conditions; and
WHEREAS, the Medina city council considered the preliminary plat at its meetings on
October 4 and November 1, 2005.
NOW, THEREFORE, BE IT RESOLVED, by the city council of the city of Medina,
Minnesota that preliminary plat approval be granted to the Applicant for West Ridge
Development Second Addition, subject to the following terms and conditions:
1. The final plat shall incorporate Outlot G, Medina Clydesdale Marketplace.
2. The final plat must include drainage and utility easements 10' in width along the
right-of-way for Clydesdale Trail and 5' along shared property boundaries.
3. The Applicant must submit title work satisfactory to the City for the final plat,
including Outlot G.
4. The Applicant shall submit the application for the final plat to the City within 180
days of preliminary plat approval or the preliminary plat shall be considered void,
unless a written request for time extension is submitted by the Applicant prior
thereto and approved by the city council.
5. The preliminary plat is subject to approval of the PUD General Plan of development
approval.
6. The preliminary plat is subject to the receipt and City approval of the agreement of
easements, covenants and restrictions between the Applicant and Target
Corporation.

7. The preliminary plat is subject to the receipt and City approval of a reciprocal
easement agreement involving West Ridge Development and West Ridge
Development Second Addition.
8. The Applicant shall pay the City a fee sufficient to reimburse the City for the cost of
reviewing this application.

The motion for the adoption of the foregoing resolution was duly seconded by member
Cavanaugh and upon vote being taken thereon, the following voted in favor thereof:
Brinkman, Weir, Workman, Cavanaugh
and the following voted against same: (Absent: Smith)
None
Whereupon said resolution was declared duly passed and adopted.
