IN THE I�IATTER OF THE PROPOSED IMPROVEMENT OF
BEECHWOOD AVENUE BETWEEN LONG BEACH BOULEVARD
AND CALIFORNIA AVENUE BY THE CONSTRUCTION OF
CURBS, GUTTERS, DRIVEWAYS, AND SIDEWALKS, AND
THE REMOVAL OF EXISTING PARKWAYS, DRIVEWAYS,
AND PORTIONS OF SIDEWALKS, INCLUDING ALL INCI-
DENTAL AND APPURTENANT WORK.
RESOLUTION ASCERTAINING AND DETERMINING RATE
OF PER DIEM WAGES AND THE GENERAL PREVAILING
RATE OF PER DIEM WAGES FOR LEGAL HOLIDAYS AND
OVERTIME WORK IN THE LOCALITY FOR EACH CRAFT
OR TYPE OF LABORER, WORKMAN, OR MECHANIC NEEDED
TO EXECUTE THE CONTRACT FOR FURNISHING AND DE-
LIVERING CERTAIN MATERIALS AND SUPPLIES IN CON-
NECTION WITH THE ABOVE MENTIONED IMPROVEMENT IN
ACCORDANCE WITH PLANS AND SPECIFICATIONS N0.
1955-C-3.
BE IT RESOLVED by the City Council of the City of Lynwood,
California, as follows:
WHEREAS, pursuant to an Act of the Legislature of the S�ate
of Calif'ornia, approved April 24 �937 and known as the "Labor Code,"
the City Council of' the City of Lynwood is required to ascertain the
general prevailing rate of per diem wages f'or legal holidays and over-
time work, in this locality for each craft or type of laborer, work-
man, or mechanic needed to execute the proposed contract for the con-
struction of curba, gutters, driveways, and sidewalks, and the removal
of existing parkways, d.riveways, curbs, and portions of sidewalks,
including all incidental and appurtenant work in Beechwood Avenue be-
tween Lon,� Beach Boulevard and California Avenue, in accordance with
Plans and Specifications No 1955-c-3 on file in the office of the
City Cler:k of the said City of Lynwood.
NOW, THEREFORE, the City Council of the City of Lynwood does
hereby resolved as follows:
Section 1: The City Council of the City of Lynwood d.oes
hereby ascertain and determine that the general prevailing rate of
hourly wages, in the locality in which said work or improvement is
to be done, for each craft or type of laborer, workman, or mechanic
needed to execute the contract for furnishing and delivering certain
materials and supplies in connection with the improvement hereinabove
described and in accordance with Plans and Specifications No Z955-C-3
on file in the office of the City Clerk of said City, is as follows,
to wit:

Provided that not less than one and one-half times the pre —
vailing rate shall be paid for any working time more than eight hours
during an,y one calend.ar day, and f'or time on Saturdays, Sundays, and.
the several legal holidays, to wit: New Years Day, Decoration Day,
Fourth of July, Labor Day, Veterans Day, Thanksgiving Day, and.
Christmas Day.
Provided that notwithstanding the general provision con-
tained herein, flagmen, guards, and watchmen shall be paid one and
one-half times the prevailing rate for overtime (overtime shall be

time worked in excess of e�_ght hours per day or forty hours per week),
and the straight prevailing rate for time worked. on Saturd.ays, Sundays,
and holidays where such time does not constitute overtime.
The foregoing prevailing wage sehed.ule is based upon a
working day of eight hours, and in the event that laborers, workmen,
or mechanics are employed less than eight hours per day, the rate of
per diem wages shall be deemed to be that fraction of the foregoing
rates that the number of hours of employment bears to eight.
The rate of compensation for any classification not listed
in the schedule, but which may be required to execute the proposed
work, shall be commensurate and in accord with the rates sp�cified
for similar and comparable classification or for those performing
similar or comparable duties.
