HomeMy Public PortalAbout005-1998 - Vacation - Alley between SW 18 & 19ORDINANCE NO. 5-1998 A SPECIAL ORDINANCE VACATINGTHE PUBLIC PLACE DESCRIBED AT THAT PORTION OF THE EAST/WEST ALLEY RUNNING FROM SW 19TH STREET TO THE WEST LINE OF THE NORTH/SOUTH ALLEY BETWEEN SW 19TH AND SW 18TH STREETS IN THE CITY OF RICHMOND, INDIANA. WHEREAS, TKC Properties, L.L.C. on behalf of Delores J. Goodson, owner; Peter D. Cleveland, P.C., agent has petitioned Common Council of Richmond, Indiana, requesting the vacation of the public place described as that portion of the East/West alley running from SW 19th Street to the west line of the North/South alley between SW 19th and SW 18th Streets, in the City of Richmond, located at the northeast corner of West Main and SW 19th Streets, the same being Vacation Petition No. 1-1998, and WHEREAS, all of the owners of all land abutting the above described public way have joined in said petition requesting vacation, and WHEREAS, the abutting land owners have waived notification by the City Clerk as required by statute, and WHEREAS, said Council, pursuant to Indiana Code 36-7-3-12, conducted a public hearing on said petition February 16, 1998, after publishing legal notice thereof at least 10 days in advance of said hearing as required by statute, and WHEREAS, the Richmond Advisory Plan Commission, pursuant to Richmond Code 155.04(b), conducted a public hearing on said petition January 29, 1998, after publishing legal notice thereof at least 10 days in advance of said hearings as required by ordinance, and WHEREAS, it is desirable to vacate said public way, NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that the subject to the preservation of easements for existing utilities, the public way described below is hereby vacated and the abutting property owners shall acquire ownership of the land heretofore dedicated as a public way as indicated below, to wit: The public place described as that portion of the East/West alley running from SW 19th Street to the west line of the North/South alley between SW 19th and SW 18th Streets in the City of Richmond. Salter, said Plat is recorded in Plat Book 1, page 109, in the office of the Recorder of said County; running thence West along a hedge fence 19.52 rods to an iron bolt; thence North 29 rods to an iron bolt in the south line of a street known as South Avenue in Greenwood; thence East along the South line of said Avenue 19.52 rods to an iron bolt at the northwest corner of Mary Topey’s land; thence south along the West line of said Topey’s land 29 rods to the place of beginning, containing 3.54 acres.
