GOV t BOARD OF HEALTH MEETING WEDNESDAY JULY 18 , 2018 AT 7 : OOPM TOWN HALL , ROOM A Board members present: Carmen Scherzo, DVM , Chairman; Annette Graczewski, MT (ASCP); Joe Ford Board members absent: Penny Hausser Holeman, MPH , MA, MS Others present: Nancy Ellis Ice, CHO, RS, MPH , Health Director and Tammi Mason, Senior Department Assistant 1 . Chairman 's announcements The Brewster Coastal Committee is sponsoring a community discussion on " providing access for water dependent activities" on July 19, 2018 at the Cape Cod Museum of Natural History from 6 - 8 PM . The Brewster Community Network will present a forum to discuss " creating secondary housing units in single family homes and what' s the latest on marijuana in Brewster" on Tuesday July 24, 2018 from 6 : 30- 8PM at the Brewster Ladies Library. The VNA in conjunction with the BOH will hold a Blood Pressure, Glucose and Cholesterol screening on Tuesday July 24, 2018 from 10AM - 12 :OOPM at the Brewster Ladies Library. There is a temporary vacancy on the Board of Health from now until the May 2019 Town election . There will be a joint meeting of the Select Board and the BOH on Monday August 6'" to interview interested candidates . A quorum is needed so please plan on attending . Dr. Scherzo and Mrs . Graczewski and Brian Baumgartner from the Barnstable County Department of Health & Environment participated in the Brewster Conservation Day on Saturday July 14, 2018 with well over 50 vendors participating . P Dr. Scherzo noted with great sadness and joy that Nancy Ellis Ice would be retiring as of August 9, 2019 after 38 years with the Town of Brewster. The Board has her for another year so please make use of her vast knowledge and dedicated service . The Select Board voted to sign the Host Community Agreements on July 16, 2018 . There were 3 . Mrs . Ice will send copies to the BOH members next week. With the resignation of Town Administrator Mike Embury, Mrs . Ice was not included as a member of the Host Community Agreement committee. Mark Forrest has been named as the interim Town Administrator. On July 16, 2018 the Select Board accepted the Brewster Visionary Plan . The plan is available on the Town website . Governor Baker has proclaimed July 15 - 21 , 2018 Hurricane Preparedness Week to underscore the Commonwealth' s vulnerability to tropical storms and hurricanes . O ' Reilly & Associates Inc. — Local variance request for 32 Barberry Lane John O ' Reilly and Bob Reedy presented . A septic inspection was done . The leach pit was designed for 2 bedrooms and the home is 3 bedrooms . It is 236 feet away from Myrick Pond . The owners want to do a complete upgrade . As far away as possible . They are seeking a 68' variance . The separation from the bottom of the leaching to the pond elevation is 26' . Groundwater does not travel towards the pond . Motion : Finding that the proposed system is an improvement and the groundwater flow is away from the pond , approve the variance of 68' from leaching to pond . Motion : Joe Ford Second : Annette Graczewski Vote: 3 -0 - 0 Action : Motion carried 3 . John & Carolyn Keith — 5 Fisher Point Road — variance request from the Leaching Facility Setback regulation John Keith, Owner presented this to the Board . He wants to add an addition to the existing house . It will be another bedroom . The existing system is from 1980. It is a 3 bedroom system . An inspection was done and it is in good condition . SAS is 130 feet from elbow pond . Groundwater flow is away from pond . On a bluff well above the pond . Bottom of the leach pit is over 20' from pond level . D - box will be replaced due to its proximity. Mrs . Graczewski asked about conservation commission approval . Mr. Keith stated that they had not gone before them yet but will be . Dr. Scherzo asked where the addition was going . Mr. King stated that it would be on the west side which is the same side as the leach pit . Motion : Finding that the d - box will be H2O and the system is downgradient of the pond on a bluff, approve the 170' variance . Motion : Joe Ford Second : Annette Graczewski Vote: 3 -0 - 0 Action : Motion carried 4. James Cloran — 74 Pine View Drive — variance request from the Leaching Facility Setback regulation James & Martha Cloran presented this to the Board . The home is for sale . The septic inspection passed but it is within 300 of Pine Pond . The system is from 1984 . They are requesting a 155 ' variance . Mr. Ford stated that it appears the groundwater is flowing away from pond . Groundwater is greater than 10' from pit. Dr. Scherzo asked if the SAS was in the driveway. Mr. Cloran stated that it was not. Mr. Cloran stated that the leach pit is H2O but the d - box is not . Mrs . Ice asked about well water testing . Mr. Cloran stated that it was done and he would send it in . Motion : Finding that the separation to groundwater is greater than 10' and groundwater flow is away from the pond , approve the 155 ' variance request. Lester Hartman , MD — discussion on restricting flavored tobacco in Brewster Lester Hartman, MD was present. He spoke about youth and vaping . 42 % of high school seniors have vaped . 22 % use it regularly. Spoke about JUUL., which is another form of vaping and stated that it was on the rise. If the Board is interested, DJ Wilson, or Bob Colette can give the Board language for a proposed restriction . Bob Colette, Cape Cod Regional Tobacco Control Program spoke about this issue and told the Board about how prevalent this is becoming for youth . Mr. Colette will get the language for the regulation and pass it on to Mrs . Ice . 6 . Review and possibly approve the Upgrading of Substandard Onsite Disposal System regulations This will be updated and brought back to the Board for review. 7 . Review and approve minutes from 4/ 18/ 18 meeting Dr. Scherzo asked about a sentence in item #2 . Mrs . Mason will check the tape and adjust if needed .
