RESOLUTION NO. 2006-07
RESOLUTION GRANTING APPROVAL OF MULTIPLE LOT DIVISIONS AND
REARRANGEMENTS FOR LOT 1, BLOCK 1, CATES MEDINA ADDITION
AND LOT 1, BLOCK 1, MEDINA CLYDESDALE MARKETPLACE
WHEREAS, Ashland Inc. ("Ashland") is the fee owner of Lot 1, Block 1, Cates
Medina Addition; and
WHEREAS, Target Corporation ("Target") is the fee owner of Lot 1, Block 1,
Medina Clydesdale Marketplace; and
WHEREAS, Ryan Companies US, Inc. has requested approval of multiple lot
divisions and rearrangements for the property on behalf of Ashland and Target
(collectively, the "applicant"); and
WHEREAS, the City Council finds that the proposed lot divisions and
rearrangements will allow for the realignment of Clydesdale Trail, resulting in a benefit
to the general public with an improved transportation route; and
WHEREAS, the City Council finds that the proposed lot divisions and
rearrangements will reduce the possibility of any non -conformities of the parcel located
at 215 Clydesdale Trail that the City may impose by the reconfiguration of Clydesdale
Trail; and
WHEREAS, the proposed lot divisions and rearrangements were reviewed by the
Planning Commission on January 10, 2005 for conformance with the City's ordinances.
NOW, THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL OF THE
CITY OF MEDINA, MINNESOTA, that it should and hereby does grant approval of
the request by Ryan Companies US, Inc. for the following lot divisions and
rearrangements as depicted on Exhibit A attached hereto:
A. Lot splits of the vacated south %2 of Clydesdale Trail into Parcel C, Parcel D
and Parcel H (a portion south %2 of vacated Clydesdale Trail) and Parcel E (a
portion of Lot 1, Block 1, Cates Medina Addition).
B. Lot consolidation of the north % of vacated Clydesdale Trail (Parcel A) along
with Parcels C and E, all shown on the sketch with Lot 1, Block 1, Medina
Clydesdale Marketplace.

C. Lot consolidation of Parcel D (a portion of the south t/2 of vacated Clydesdale
Trail) and Parcel H, along with Parcel F (Outlot F of Medina Clydesdale
Trail) as shown on sketch with Lot 1, Block 1, Cates Medina Addition.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the above listed
divisions and rearrangements are subject to the following findings and conditions:
1. The lot divisions and rearrangements are approved in accordance with the
plans and application received by the City on December 14, 2005.
2. The approval of the lot divisions and rearrangements are contingent upon the
approval of the requested right of way and drainage and utility replacement
easements.
3. Target and Ashland must take appropriate actions, including the execution of
necessary deeds, to effect the lot division and rearrangements hereby
approved consistent with this resolution.
4. The applicant shall pay to the City a fee in an amount sufficient to reimburse
the City for the cost of reviewing the lot divisions and rearrangements.

The motion for the adoption of the foregoing resolution was duly seconded by member
Weir upon vote being taken thereon, the following voted in favor thereof:
Brinkman, Weir, Workman, Cavanaugh, Smith
And the following voted against same:
None
Whereupon said resolution was declared duly passed and adopted.
