COUNCIL MINUTES
NOVEMBER 17, 1987 - REGULAR MEETING
The regular monthly meeting of the Bal Harbour Village
Council was held on Tuesday, November 17, 1987 at the Village
Hall. The meeting was called to order at 9:35 a.m. by Mayor
Richard H. Olsen and the roll was called. Those present were:

Also present: Louise K. Miller, Village Manager
Richard J. Weiss, Village Attorney
Carole S. Morris, Village Clerk
As a quorum was present, Mayor Olsen commenced the meeting.
Approval of Minutes: A motion was offered by Mrs. Stern and
seconded by Mr. Blank to waive the reading of the minutes oT the
October 20, 1987 regular council meeting. The motion carried
unanimously (3-0). Mayor Olsen then inquired as to :toy c',anges
or corrections in the minutes. Mr. Lou Brandt, Regencl :spa, was
then recognized. Mr. Brandt reported that his (throurl, ::he :_pa
manager) requests for copies of meeting minutes, directed k:o
Miller and Mrs. Morris, had been ignored. Both Mrs. Miller and
Mrs. Morris denied ignoring the request but acknowledged a delay
in accommodation of this request. Mr. Brandt then left the
meeting (later to return with the Spa Manager Jimmy Feyko). A
motion was then offered by Mr. Blank and seconded by Mrs. Stern
to approve the minutes of the October 20, 1987 meeting as
submitted. The motion carried unanimously (3-0) and the minutes
were approved.
Presentations - Officer of the Month: Mayor Olsen then
recognized Police Chief Robert Baquero to present the Officer of
the Month award. Chief Baquero announced that Officer Hernan
Cardeno had been named as Officer of the Month for October 1987.
Unfortunately, Officer Cardeno was unable to attend the meeting.
Chief Baquero would present his certificate and check to him at
roll call that afternoon. Mayor Olsen requested that the Chief
also extend the Council's congratulations on this honor.
Ordinances: Mrs. Stern offered a motion that first reading
on the two zoning ordinances be deferred until the December
Council meeting due to the absence of Councilmen Boggess and
Taplin. This motion was seconded by Mr. Blank and carried
unanimously (3-0). Mayor Olsen also requested that the Village
Attorney confer with Mrs. Stern and Building Official George
Desharnais to ensure that the ordinances conform with the
Council's recommendations.

Resolutions: A resolution was read, in full, by the Clerk
which would approve the Police Benevolent Association contract
for the period October 1, 1987 through September 30, 1989 and
authorize the Village Manager to execute said contract. Mrs.
Miller requested the resolution be amended to reflect the date of
the contract. As there was no discussion the resolution was
adopted becoming

Reports and Recommendations: Mayor Olsen reported that the
Village is donating a television set to the Surf Bal Bay Library.
Mrs. Rose Fox was present, on behalf of the Library Committee,
and thanked the Council for their generous donation.
Mr. Weiss noted that a memorandum was included in the
Council's agenda packets outlining the status of the Sun Bank
Park. Mrs. Miller outlined the process for having this property
platted.
Mrs. Miller request that the Council approve payment of an
invoice for services rendered by the Village actuary, Kruse
O'Connor and Ling in the amount of $3,150 from account
001.513.315. A motion was offered by Mrs. Stern and seconded by
Mr. Blank to approve payment of this invoice. The motion carried
unanimously (3-0).
Mrs. Miller announced that an "Open Enrollment" insurance
program has been planned for Village employees. This event
will be held on Monday, November 23, 1987 from 11:00 a.m. until
4:00 p.m. in the Council chamber. The Council's participation is
invited.
An invitation has been received from Miss Phyllis Grey,
Librarian for the Surf Bal Bay Library to the opening of the
Senior Reading Program. This event is scheduled for
December 8, 1987 commencing at 1:00 p.m. at the library.
Mrs. Miller requested that the Council select a date for a
workshop meeting to be held regarding the Comprehensive Plan.
After some discussion, this workshop was scheduled for Monday,
November 30, 1987 at 3:30 p.m. The Clerk will arrange the
required advertising.
Mr. Weiss updated the Council on various matters affecting
the pension plan. The attorney is working with the actuary to
draft the documents required to update the plan in accordance
with governing regulations. Additionally, the request for an
administrative hearing requested regarding problems with the
police pension fund reports has been placed "on hold". Other
cities are in a similar predicament and the Florida League of
Cities is proceeding with this matter. There was some discussion
regarding the status of the pension fund following recent stock
market events. Northern Trust will be asked to report at the

next Pension Committee meeting.
Mr. Bob Maute, 9800 Collins Avenue, requested the Council
look into problems and poor service being received by Village
residents by Harte Hanks - the cable television service. Both
Mayor Olsen and Mr. John Bruno, 50 Park Drive, concurred that
indeed the cable service is less than satisfactory. After some
further discussion, it was agreed that the Village Manager would
contact Harte Hanks regarding this service and locations
throughout the Village where the cable is not properly buried.
Mr. Lou Brandt, Regency Spa, returned to the meeting with
Mr. Jimmy Feyko. There was some further discussion surrounding
the delay experienced by Mr. Feyko in receiving minutes of
certain September meetings - the Clerk explained that this delay
had been precipitated by the work created through the budget
process. Mr. Brandt charged that the proposed ocean front
district zoning changes and the Harland Bartholomew Report
constituted discrimination against the Regency Spa. Mayor Olsen
attempted to respond to Mr. Brandt's charges but Mr. Brandt
refused to yield the floor. After being ruled out of order,
Mayor Olsen requested the Police Chief remove Mr. Brandt from the
chamber.
When the meeting returned to order, Mr. Bruno related
flooding problems being encountered in the north residential
section of the Village following rain storms. Mayor Olsen
replied that this problem is addressed in the capital improvement
element of the comprehensive plan - to be reviewed at the
November 30th workshop.
Mr. Bruno inquired as to whether all Village tax assessments
were increased. Mrs. Miller explained that this process is
handled by the County - independent of Village control.
Mr. Maute queried as to whether or not former Council
members received tokens for their service. Mayor Olsen noted
that, as only Mrs. Antiles attended the Induction Meeting when
they were presented, plaques were delivered to each of the
remaining council persons.
Mr. Bruno inquired as to the status of reductions in solid
waste bills. It was agreed that Finance Officer John Kelly would
discuss this matter with Mr. Bruno.
There being no further business a motion was offered by Mrs.
Stern and seconded by Mr. Blank to adjourn the meeting. The
motion carried and the meeting adjourned at 10:45 a.m.
