RESOLUTION NO.2006-08
RESOLUTION VACATING A PORTION OF CLYDESDALE TRAIL
AND VARIOUS DRAINAGE AND UTILITY EASEMENTS
WHEREAS, city of Medina (the "City") is the owner by dedication of Clydesdale
Trail, including the portion thereof immediately north of Lot 1, Block 1, Cates Addition,
Hennepin County, Minnesota; and
WHEREAS, Ryan Companies US, Inc. (the "Developer") is in the process of
developing surrounding land which will require Clydesdale Trail to be realigned; and
WHEREAS, the Developer has requested that the City vacate portions of
Clydesdale Trail which will no longer be needed; and
WHEREAS, the adjoining property owner, Ashland, Inc., ("Valvoline") owns Lot
1, Block 1, Cates Medina Addition; and
WHEREAS, the realignment of Clydesdale Trail will require Valvoline and the
Developer to grant to the City a new right of way easement; and
WHEREAS, the portion of Clydesdale Trail to be vacated is legally described on
Exhibit A attached hereto; and
WHEREAS, the Developer and Valvoline have requested that the City vacate
portions of the drainage and utility easements on the plats of Medina Clydesdale
Marketplace and Cates Medina Addition, jointly, (the "Plats"); and
WHEREAS, the drainage and utility easements to be vacated are legally described
on Exhibit B attached hereto; and

WHEREAS, the drainage and utility easements are no longer needed due to
realignment of Clydesdale Trail; and
WHEREAS, the City will be obtaining new drainage and utility easements from the
Developer and Valvoline; and
WHEREAS, pursuant to Minn. Stat. § 412.851, the City scheduled a public hearing
for January 17, 2006, to consider the vacation of a portion of Clydesdale Trail as dedicated
on the plat of Cates Medina Addition and the proposed vacation of the utility and drainage
easements; and
WHEREAS, notice of the public hearing was posted, published twice in the official
newspaper and mailed to the owners of other affected properties at least 10 days before the
hearing, all in accordance with law; and
WHEREAS, the City has this day held the public hearing on the proposed
vacations, at which hearing all interested parties were heard; and
WHEREAS, following the public hearing, the City has determined that the vacation
of the described portion of Clydesdale Trail and the vacation of the described utility and
drainage easements to be in the public interest.
NOW, THEREFORE, BE IT RESOLVED by the city council of the city of
Medina, Minnesota, that Clydesdale Trail as dedicated on the plat of Cates Medina Addition
is hereby vacated and the drainage and utility easements are hereby vacated, subject to the
following terms and conditions:
1. Vacation of the drainage and utility easement is subject to property owners
conveying new drainage and utility easements as required by the City;

2. Vacation of that portion of Clydesdale Trail as dedicated on the plat of Cates
Medina Addition is subject to property owners conveying new right of way
easements as required by the City.
3. The City staff is hereby authorized and directed to file the notice of vacation
of Clydesdale Trail as dedicated on the plat of Cates Medina Addition and
the vacation of the drainage and utility easements with the Hennepin County
Recorder and Auditor.

and upon vote being taken thereon, the following voted in favor thereof:

Whereupon said resolution was declared duly passed and adopted.

That part of Clydesdale Trail as dedicated in CA"1'ES MEDINA ADDITION, according
to the recorded plat thereof, Hennepin County, Minnesota described as follows:
Beginning at the northwest corner of Lot 1, Block 1, said CATES MEDINA ADDITION;
thence North 00 degrees 41 minutes 55 seconds East, assumed bearing, along the west
line of said Clydesdale Trail, a distance of 60.10 feet to the north line of said Clydesdale
Trail; thence easterly, along said north line, a distance of 199.58 feet, along a non -
tangential curve, concave to the south, having a radius of 3264.35 feet, a central angle of
03 degrees 30 minutes 11 seconds, a chord bearing of South 84 degrees 11 minutes 45
seconds East and a chord length of 199.55 feet; thence easterly, along said north line, a

DRAINAGE AND UTILITY EASEMENT VACATION DESCRIPTION
That part of the drainage and utility easement dedicated on Lot 1, Block 1, MEDINA CLYESDALE
MARKETPLACE, according to the recorded plat thereof, Hennepin County, Minnesota lying 10 feet north and 10 feet
west of the following described line:
Beginning at the northeast corner of Clydesdale Trail, as dedicated on CATES MEDINA ADDITION, according to
the recorded plat thereof, said Hennepin County; thence westerly, along the north line of said Clydesdale Trail, a
distance of 18.47 feet, along a curve, concave to the north, having a radius of 270.00 feet, a central angle of 03 degrees
55 minutes 11 seconds, a chord bearing of North 84 degrees 24 minutes 15 seconds West and a chord length of 18.47
feet; thence westerly, along said north line, a distance of 199.58 feet, along a reverse curve, concave to the south,
having a radius of 3264.35 feet and a central angle of 03 degrees 30 minutes 11 seconds to the west line of said
Clydesdale Trail; thence South 00 degrees 41 minutes 55 seconds West, along said west line, a distance of 55.77 feet
and there terminating.
The side lines of said easement vacation shall be prolonged or shortened to terminate on a line 5 feet west of, as
measured at right angles to the east line of said Lot 1 and its northerly extension and on the following described line:
Beginning at the terminus of the above described line; thence southwesterly, a distance of 12.83 feet, along a curve,
concave to the southeast, having a radius of 175.00 feet, a central angle of 04 degrees 12 minutes 01 seconds, a chord
bearing of South 51 degrees 55 minutes 36 seconds West and a chord length of 12.83 feet to the intersection with a
line 10 feet west of, as measured at right angles to, said west line of Clydesdale Trail and there terminating.
And
That part of the drainage and utility easement dedicated on Lot 1, Block 1, CATES MEDINA ADDITION, according
to the recorded plat thereof, said Hennepin County lying 10 feet southerly of, as measured at right angles to, the north
line of said Lot 1, Block 1, CATES MEDINA ADDITION.
The side lines of said easement vacation shall be prolonged or shortened to terminate on a line 10 feet west of, as
measured at right angles to the east line of said Lot 1, Block 1, CATES MEDINA ADDITION and its northerly
extension and on the west line of said Lot 1, Block 1, CATES MEDINA ADDITION.
