HomeMy Public PortalAboutM 2003-10-29 - CC ' LYNWOOD CITY COUNCIL � SPECIAL MEETING � OCTOBER 29, 2003 The City Council of the City of Lynwood met in a Special Meeting in the Council Chambers, 11330 Bullis Road on the above date at 6:10 p.m. Mayor Pedroza presiding. " ` Councilman Byrd, Reyes, Santillan, Rodriguez and Pedroza answered the roll call. Also present were Interim City Manager Gonzales, Interim City Attorney Montgomery, ` City Clerk Hooper and City Treasurer Pygatt. City Clerk Hooper announced that the agenda had been duly posted in accordance with the Brown Act. ' PUBLIC ORAL COMMUNICATIONS � (Regarding Agenda Items Only) � - Carole Reese; — Item #5 stated that she is very concern with the new trash bins from ,� Consolidated Disposal, believes that they a're too big and heavy for the seniors to have to push them outside the yard into the curb. Kathryn Jones — Item #5 explained that she does not want the new trash company Consolidated Disposal; complained that the trash bins are too big and heavy for her to _ push them to the curb, stated that she was very satisfied with Waste Management and very thankful for their adequacy tiine. I would' like to know what is the trash bill for the residents now: � �Irene Kenly — Item #5 also complained ori the trash bins being to big for the handicap and � seniors that are going to have to push them outside to the curb, asked the council to have some kind of consideration for the handicaps and seniors. Irene Gazcia — Item #5 questioned the Council in regards to the money that was given to the City would like to know where is that money, supports Waste Management and also agrees with the trash bins being too big and heavy. , PUBLIC ORALS COMMUNICATIONS Lorene Reed - Supports Consolidated Disposal believes.it is a great company and knows . it will provide better service to the community and would make arrangemenfs to accommodate any resident that has a concern. Stated that Waste Management paid residents for the collection of signatures to process the circulation of a petition against Consolidated ; Disposal. Waste Management has only lied to the residents of Lynwood � they never promised to change the trucks and make it better for the community. The Council should start looking out for the residents this is a struggling City. , Irene Garcia — Stated that Council explained that Consolidated Disposal was not going to raise the fees for a period of five years, but then again it states differently that � Consolidated ,Disposal can come back afrer two years and request an increase on the . service fee. � .---_ . Sylvia Herron — Supports Consolidated Disposal, stated that this company would provide the service the community needs and is looking for and will also save the City a lot of , money. The seniors are getting a better deal we are getting a four-dollar discount and we �, : are not paying the recycling fee. Consolidated Disposal will also pick up your big items on Saturday mornings and there will not be any extra charges. Manny Perez — Stated that he thinks it's great that the Council finally changed the trash , company, believes that Consolidated Disposal would provide better service to the community and the City would look a lot cleaner. Joaquin Macinas — Explained that Council does not communicate with the residents and this is causing a lot of problems and misunderstandings between residents. The Council has the obligation to inform the community of what is going on. The residents have the right to see the original contract and see for them selves if there was a two million dollaz dea1. Mayor Pro Tem Rodriguez — Stated that there is a lot of confusion, I have received a lot of calls in regards to how the is going to be picked up from now on, we do have a lotof seniors and handicap residents and I am glad to hear that Consolidated Disposal would try to help fhem. Councilman Byrd — Stated that he would like to have the Street Sweeper pass by and the --- trash picked up at the same time, believes this would help the residents. Councilwoman Santillan — Stated that Council did not ask to bring this Close Session Item, questioned the Interim City Manager that why was this brought and why are we having this Special Meeting tonight. Councilman Reyes — Questioned the Interim City Attorney if the change of contract is the subject of this Close Session. Interim City,Attorney Montgomery.- Explained that'the Close Session Item is simply to bring the Council up to date on threaten litigation, as some of the people in the audience have conectly sermiezed there aze two companies here that aze both interested in this contract both have indicated that they intend to litigate to establish there position so the propose of the close Session is to simply bring the Council up to • date on all the ramifications that are here there is no presumed action some MembeTS of the Council would like to presume one action or the other would be taken that is not the purpose of the Close Session members of the audience were permitted to speak because they should get the benefit of the doubt if they want to speak on a issue but in response to Councilwomari Santillan it is merely to bring you up to date on what is been going on with respect to the referendum petitions the existing contract so that you aze • fully informed of all the ramifications. Mayor Pedroza — Stated that he is•concerned for the seniors and handicap, explained that Consolidated Disposal would work anything out with whoever has a concem or problem, they aze willing to go out of their way to help the seniors and handicap provide a smaller trash bin and the rates are going down, the new trash trucks would not pollute the City's air anymore. Explained that Waste Management wanted to loan the City two million at a seven percent for the Senior Center, when the Council can have the two million loan for a three percent from the Federal Government. Waste Management wanted to increase the commercial sates by fifteen percent they wanted to increase the residentiaP rate by.seven percent and they wanted to increase the CPI on a yearly basis and they also wanted to increase the rates for taking the.trash to the dump, that is all documented you can analysis and decide for your sel£ Two companies wanted this.contract one of them won itfrom the RFP and the other one loss it. Interim City Manager Gonzales — Explained to Council and the audiehce that the change of contract is not the subject of the Close Session Item, if it were it would have to be an open session item, the issue here is the legal points that have to do .with the referendum and briefing Council on this issues. CLOSED SESSION Item #5: CLOSED SESSION TTEMS: , Interim City Attomey Montgomery stated with respect to every item-of business to be discussed in Joint Close Session pursuant to Section 54956.9: A. Ham Pazk: City of Lynwood & Lynwood Unified School District B. Anticipated Litigation — Number of Cases: (2) . It was moved' by Councilman Byrd, second by Mayor Pedroza and canied to reces's to . Close Session at 6:45 p.m. Council reconyened at 725 p.m. � ' • Interim City Attorney Montgomery stated that the Council met on the aforementioned matters and stated on: A. Ham Pazk: Council permitted the School District to proceed with "" " e the demolition of Ham Pazk in th'e advance of the receipt from Yhe check by the State which has been promised upon the posting of either a guazantee or a good of sufficient charity and that discretion has been left to the City Attorney or the City Manager to ' determine. � ° B. Anticipated Litigation: No reportable action ' . Interim City Attorney Montgomery — Stated that the Anticipated Litigation means that the Council considers the contract with ,Consolidated Disposal to be in full force and affect it at this time. • " CITY COUNCIL ORALS & WRITTEN COMMUNICATION Councilman Byrd — I think the Council made the right decision at this point of time, I do' , feel bad about some of the misinformation that has been projected out in the community, _ and I think that this trash bins are going to be better and help the City look a lot better and - � I also think that if we coordinate tfie trash and street sweeper together then it would help resolve a lot of problems Councilwoman Santillan — I feel for the seniors there is a lot of miscommunication going on and if these seniors need help I am sure Consolidated Disposal will help accommodate these seniors, I understand that for seniors and younger people any change is always difficult but in the long run our City will eventually look much cleaner and as soon as we �� can get�the trash picked up to coordinate with the street sweeper things will ease up. Ori another matter on Bui Street close to Long Beach Boulevard there is about seven pair � of tennis shoes hanging from the electrical wires this resident has ask me to please have - them remove. Would also like to have a First Time Home Buyer seminar in Spanish and ` English I am willing to volunteer because there it is a lot of people that have questioned me about the homebuyer program. I would also like for staff to bring back the Sun Newspaper contract. Councilman Reyes — I was just thinking about the trash contracts, the City is basically in the middle of the three companies trying to get a contract, I do not know I am not an Attorney or a 3udge on how it would go but hopefully whatever happens is for the best of the community, I have friends on both sides of.the companies and I wish I knew what is best but we would let it to the courts to decide, I am satisfied with either company that is ' going to provide the service, we are just going to waiTand sees what is-going to happen. I am concem about the cruising, speeding and traffic the residents want speed bumps to stop these problems. There are also a lot of gazage conversions and this is causing a lot of pazking issues. Councilman Byrd — I had a call from a resident from Lynwood Road stating that there is a lot of traffic during the day and at nighttime there is a lot of cruising and speeding going on. .. Councilman Reyes — Stated that it is getting so bad that a little girl was almost runed over • . by a speeding car. Mayor Pro Tem Rodriguez — It is sad that we have two companies and I would say two , very good companies fighting for a contract that who gets it is not the issue the issue is _ the residents are the ones paying for it. Number one I have had many calls asking that there is a lot of misinformation number one they do not know how much they are paying they do not know how many trash cans they aze picking up and I think it is up to the City to inform the residents either way both English and 5panish and not do it only once but . � two or three times we as residents when we get notices when we get things like that we get so much mail that we end up throwing it away and if we do not take care, of this we will have problems secondly a resident came to me and complained that some residents just come and throw couches and other big stuff and when they call the trash to come and pick it up they do so. Also some residents have called the sheriffs department for some assistant and they have said that if it is not important then they cannot come out and assist them. Mayor Pedroza — I wanted remind staff that that on the next scheduled meeting I wouid like to see the information on the possibility of getting ride of the parking meters on Long Beach Boulevard and also Mariposa and Tecumseh those streets with the cruising problems that most of the cruisers aze going into the residential streets causing a lot of _. problems let's make sure we bring it back for Councils discussion on how to come up with solutions they feel that they have been neglected by the Council. I feel tliat Consolidated is a great company it was selected because it was the best company of the RFP I also respect the. people from Waste Nlanagement trying to retrain the contract it is business so at this point I rather see the court decide or the people of Lynwood decide. I want to let the seniors know that Consolidated is willing to give smaller trash bins and work with the seniors, they are also going to work with you depending on what you need, this is the first time we are decreasing the trash fee afrer ten years the seniors aze getting a discount, recycling is free, trash bins are free also. I would also like to remind staff that I would like to see the cost of a party caz from the sheriffs department at the next meeting for�possibility �approving a party caz.
