Chambers, 11330 Bullis Road on the above date at 6:14 p:m.
„ Mayor Byrd presiding.
• Councilman Pedroza, Rodriguez, Santillan, Vasquez, and Byrd answered the roll call.
�� Also present were City Manager Hempe, City Attorney Beltran, and City Clerk Hooper,

City Clerk Hooper announced that the agenda had been duly posted in accordance with
the Brown Act.
, Mayor Byrd opened Lynwood Redevelopment Agency, Lynwood Information, Inc.,
Lynwood Public Finance ,Authority at 6:14 p.m. City Clerk Hooper took separate roll
call for each agency.

Mayor Byrd introduced Hector Chacon, Candidate running for the 50�' District in the
� March 2004 Election. • ,
� Hector Chacon, Member of the Montebello Board of Education — Gave brief introduction �
� about himself. �Currently a candidate in the March 2004 Election and is seeking support �
from the community of Lynwood ,
� Sylvia Ortiz, 3204 I:ouise St. — Spoke on behalf of the Ruiz Family and�stated that Oscaz
Ruiz was shot and killed in Lynwood and asked that City Council sponsor a �eward to
find the suspect who killed him. , �
Sonia Ruiz Rodriguez, Sister to Oscar Ruiz (deceased) — Shared memories of Oscar and •
, asked that City Council help with the reward money to find the suspect that kil�led her
. brother.
Martha Ochoa; 3201 Louise — Cousin to Oscaz (deceased) — Spoke on behalf of the Ruiz
� Family and stated that Lynwood is not safe anymore as there is too much crime and �
violence going-on on daily basis.
Mayor Byrd stated�.he would like to have a joint summit in the City�of Lynwood that
� involves the collaboration bf the Ministerial Alliances, LUSD Administrators, St. Francis,
Hospital, Project Impact, Drive-By-Agony, SherifPs Department and Gang Task Force to
take action on crime and violence.
Mayor Pro Tem Vasquez commented that she contacted and spoke with the Director of
Stop the Violence and Increase the Peace Foundation from the City of,Inglewood to help
with the issue of crime and violence in our city. Also she directed Lt. Tellez to work with ,
the Ruiz Family regarding the rewazd matter.

Councilman Pedroza thanked his fellow council members,for all their support in the yeaz
2002-2003.
Item #7: Mayor recessed to Lynwood Redevelopment, Lynwood Information Inc,
Lynwood Public Finance Authority at 7:00 p.m. It was moved by Councilman
Rodriguez, seconded by Councilman Pedroza.

Paulette Bradley, 3992 E. PIatt – Complimented former Mayor Pedroza for the
2002-2003 year end video presentation.
Item #16 (Special Perinit – Fortune Teller) Opposes fortuneteller permit.
Item #17 (Shared Use Proposal – National Guard Armory) opposes this item due to
parking and traffic problems.
Mark Kudler, Bulletin Displays, 7699 9` St., Buena Park, Item #19A.1 and #19C –
Provided City Council with documents pertaining to his Closed Session Items.
PUBLIC ORAL COMMUNICATIONS
Lazazo Sanchez, HP Video Productions, Independent Consultant — Provided City Council, Y
with brochures of his work performance and video accompliskiments during his service to
the City. Also stated his contract will expire in April and would like for City Council to
reconsider to extend his contract.
Councilman Rodriguez questioned whether the City has allocated funds for Mr.
Sanchez's contract.
Johonna Howard, Public Relation Officer — Explained that Mr. Sanchez's contract and
funding was approved by City Council on May, 2003.
Councilman Rodriguez requested that staff provide him a copy of Mr. Sanchez's contract. .
Councilwoman Santillan questioned whether Mr. Sanchez's contract would be placed on
the agenda before it's expired. She also directed City Manager Hempe to place Mr.
Sanchez contract on the agenda for further discussiom.
� Patricia Shields, Childcare Consultant — Complimented former Mayor Pedroza for his
' 2002-2003 year end video presentation. Item #18 (Substantial Change'Consolidated
Annual Action Plan for Fiscal Year 2003-2004) discussed that the City�is facing many � �
� � problems with the� cliildcare centers that are not licensed. Also she opposes that the
childcare responsibilities be given to the Recreatio❑ Department and asked ihat City
• Council reconsider to approve Dominoes Leazning Academy item.

Carmelita Marshall, Director of Dominoes Learning Academy — Explained that
Dominoes Academy provides education and childcare services to Lynwood residents.
She asked that City Council reconsider to approve the Dominoes Learning Academy

� Habitat - Item #10 (Request for Public Hearing Date to Amend Parking Citatiori �
Fines/Bail Amounts) spoke against the item, Item #16 (Special Permit: Fortune Teller
31001 Imperial Hwy.) opposes this item, Complained about trolley stops not having
bench shelters, Item #19 (Conference; Training, and Meeting Policy) spoke_against the
item.
Councilman Pedtoza instructed the City Manager to conduct a survey throughout the city
' regarding how many trolley stops have bench shelters. .
'� Yolanda Demoine, 4309 Brewster — Item #18 (Substantial Change Conso(idated Annual �
�; Action Plan for Fiscal Year�2003-2004) Spoke in favor of the item and asked that City
Council approve the funding for pominoes Learning Academy.
. Blanca Sanchez, 4117 Agnes Avenue — Item #18 (Substantial Change Consolidated
Annual Action Plan for Fiscal Year 2003-2004) stated she volunteers at the Dominoes
Leaming Academy and is very pleased to have her children in this program. She asked
that City Council approve the funding for pominoes. " �
• Sylvia Herron, 3576 Beechwood - Item #18 (Substantial Change Consolidated Annual
Action Plan for Fiscal Year 2003-2004) Spoke as C.D.B.G. Commi'ssioner and stated that
when Ms. Shields gave the childcare presentation at the C.D.B. G. Commission that there
was no voting or discussion about fhe Afterschool program.
'� Jack Keane, Spoke �in favor of Sheriff's substation and stated he is willing to sponsor a� � '
mural wall in Lynwood.
Ramon Salazar, 3530 Mutford .— Complained about the Recreation Department
� sponsoring a Martin�Luther King Soccer Tournament and his team was not allowed to
" - participate in the tournament. '
.. Councilman Pedroza recommends that the Recreation Department allow Mr. Salazar's
team�to participate in the soccer program. • � � � ,
Ben Wallace, Lynwood Employees Association Representative — Addressed many
concems about the city employees being unhappy with their job, pay salary and working
� conditions. Discussed that the City is not obeying Civil Service rules and Labor Laws,
and employees are not getting fair Yreatment when it comes to hiring them. Stated that
` the City does not bargain in good faith.
Councilman Pedroza commented that he had no acknowledge that the city employees
were so unhappy with their jobs.
City Manager Hempe explained that the City of,Lynwood has two bargaining units,
which are General Employees and Management Employees. Explained.that the General
Employees contract will expire in July and negotiations will commence in February.
Councilmembers addressed many concerns regazding the employee's salary and working
conditions and stated they are willing to work with the employees bargaining unit.
Lorene Reed, 11805 Harris Avenue – Spoke in favor of city employees and stated 4hey
need better pay salary. Commended Councilman Pedroza for his outstanding work —
performance during the yeaz of 2002-2003: Spoke in favor of Dominoes Learning .
Academy and needing affordable housing for low-income residents. ,
Irene Gazcia, 2737 E. 111` St. – Commended Councilmember Rodriguez and Santillan
for their stand in wanting to correct the wrong on money wise.
Maria Garcia, 3947 Tweedy Blvd. – Expressed concerns with city employees being
unhappy on your jobs. She encouraged Council to renewal Lorry Hempe's contract so.
she may continue with the City's progress.
Paulette Bradley, 3992 E. Platt Avenue –� Complained that people are dumping trash on
the alley.

PUBLIC HEARING
Item #9 APPEAL N0.,2003-04 4237-4241 IMPERIAL HIGHWAY
ITwas moved by Councilman Pedroza, seconded by Councilman Rodriguez and carried
to open the public hearing.
Ken West,10981 Pine Avenue, Lynwood – Presented City Council with petition, of 17 '
signatures, Opposes five-foot rear yard setback and opposes two-story homes.
Pauline Taylor, 10932 Pine Avenue - Spoke in opposition of zone change to two-story
residences. Stated she is.concerned with invasion of privacy, safefy and traffic issues.
Special Assistant/Development Services Grant Taylor – Stated the project is to construct
nine (9) detached single-family residences, two-stories in height, with attached two-car
garages. The applicant is reguesting a Variance to reduce the rear yard setback for two
(2) residences and reduce the minimum lot area for four (4) residences. The subject
property totals 38,541 square feet and is located on the north side of Imperial Highway
between Pine Avenue and Jackson Avenue in the�R-1 (Single-Family Residential) zone.
Stated that at the Planning Commission Meeting, public testimony identified a number of
areas concern to include but not be limited to privacy, zone change, property taxes, --
property values, traffic, parking, emergency vehicle access, traffic signal; building
covenant,;density.
Mr. Taylor stated he recommends,to approve theproject, but if the City Council elects to
deny the project, attached is a Resolution to deny Zone Change 2003-05, that would ,
make the other zoning entitlements moot.
City Attorney Beltran suggested that City Council' allow public testimony 6efore any
questions are asked. �
. Miguel Sanchez, PBS Associates, 7340 Florence Avenue, Downey, CA — Spoke in
support of the project, stated that he is a Planner and has reviewed the City's plans, which
meets all city's zoning guidelines.
, Daniel Chavez, 8913 %z San Gabriel Avenue — Applicant to the housing development and
� informed the City Council that the project would increase the property value of
, surrounding properties. Property taxes would not increase due to the project. He asked
that City Council reconsider approving this request.
Ramon Chavez, 10009 Orange, South Gate — Applicant to the housing development,
' spoke in support and stated this is the third time in requesting this permit and asked'that
' City Council reconsider approving his request.
Rigoberto Chavez, 8927 San Gabriel, South Gate — Spoke in.support of the project.
' Stated the housing project would make the surrounding area more beautify.
Rene Morales, 11803 Long Beach Boulevard — Spoke in support of the project.
Fernando Aldame, 10939 San Capistrano, Spoke in favor of the project and supports it:
Robert Williams, Truck Driver — Spoke on behalf of the project and supports it.
Alfred Lemus, 10941 Pine Avenue - Spoke in opposition stating property values will not
increase and privacy will be impacted.

Carmen Avalos, Stated she is not against the project but opposes the two-story residences
in a one-story neighborhood due to privacy.
Abel Moreno, 4235 Imperial Hwy. — Spoke in support of the project.
Juan Ramos, 1769 46` $t., Los Angeles, CA 90001 — Spoke in support of the project.
Ronald Fobbs, 4228 Pendleton Avenue — Spoke in opposifion to two story residences in a.
one-story neighborhood. �

Andres Hemandez, 5915 Muller, Spoke in support of the project.
Eduazdo Rocha, 10929 Jackson'- Spoke in support of the project, but questioned whether
' Property taxes would increase due to the project.

Patricia Carr, 1092T Pine — Spoke in opposition of the project. She informed the City
Council that Mr. & Ms. Cortez at 10921 Pine and Mr. Miller at 10942 Jackson opposes
the project due to privacy and confinement to their hoine.
It was moved by Councilman Pedroza, seconded by Councilwoman Santillan and carried
to close the public heazing.
Councilman Pedroza stated he visited the property and noticed that there is traffic and
parking concerns and suggested the proposed project remains as single homes.
Councilwoman Santillan stated she supports this type of project but suggests that the
proposed project remains as single homes. �
Councilman Rodriguez stated he supports the project, as Lynwood needs developments
that will improve the appearance of the community.
It was moved by Councilman Rodriguez.to approve Option #1 (Construct nine (9)
detached residences, two-stories in height).
Motion dies lacking a second.
Mayor Pro Tem Vasquez stated she is concerned with the proposed project and opposes
it.
Mayor Byrd stated he is concerned with traffiasafety issues on Imperial Highway.
It was moved by Councilman Pedroza, seconded by Councilwoman Santillan to adopt the
resolution.

Item #14: QUARTERLY CONTRACT.CHANGE ORDER REPORT �
Mayor Byrd stated that he is still concerned with the change orders being brought every
time asking for additional funding. � � �
Councilman Pedroza recommended that the'City Manager bring back the ordinance for
CounciPs consideration.
Yadi Farhadi, Director of Environmental Services/Engineer —�Explained that the contract
change orders was issued for the Orchard Ave., Walnut Ave., and Sanborn Ave.
- Improvement Project. One (I) change order was issued for the Woodlawn Ave.
Improvement Project and due to budget limitations they need additional funding.
City Manager Hempe stated that staff would set down with City Council before
processing any contract change orders and would also bring back the ordinance for .
CounciPs consideration.
� Afrer further discussion, Councilmembers continued to address many concerns about the
bid opening process, advertising the project design on Online, Contractors using local
subcontractors, and the change order reports. Director Fazdahi responded to City Council
questions.
It was moved by Mayor Byrd, seconded by Councilman Pedroza to receive and file the
quarterly contract change order report for the period of August 1, 2003 through October
31, 2003.

Item #16: SPECIAL PERMIT- FORTt1NE TELLER 3101 IMPERIAL HIGHWAY,

Councilman Pedroza stated the Fortune Teller business is not the type of business that is
needed in Lynwood. -
It was moved by Councilman Rodriguez, seconded by Councilman Pedroza to Deny the
Special Permit–,Fortune Teller 3101 Imperial Highway.

Item #17: SHARED USE PROPOSAL- NATIONAL GUARD ARMORY i �
Grant Taylor, Special AssistanUDevelopment Service – Gave brief presentation regarding
a proposal from the National Guard to enter into a shared use agreement with the City of
Lynwood. The National Guard requests not more than twenty-two (22); parking stalls aE•
City Hall or the Transit Center, Fridays through Sundays and offers use of the Armory
Building to the City of Lynwood Mondays through Fridays and some weekends. No
monetary exchanges are proposed.
Jim Given, Director of Recreation & Community Services – Explained that the Transit
Center parking availability would not affected the seniors meals since the usage of the
National Guard Armory will be on weekends and after hours. The City of Lynwood has
an opportunity to.utilize a multi-purpose facility for the lost Ham Park recreation
activities, a boxing Faciliry, and other City related events/activities.� � �
National Guard Facilities Director Colonel Carl Williams – Gave brief presentation.and
detail information about the programs that the National Guard Armory is used, for, . Stated
that the National Guazd Armory is requesting to use the Bateman Hall and Transit Center
pazking lot for various events. The City would have to supervise their events, provide.
janitorial services and provide needed supplies to include restrooms supplies.
After further discussion, Councilmembers addressed concerns with liability insurance, --
loitering after the party, and security issues. Councilman Pedroza stated that the
Recreation Depar[ment would benefit from sharing the National Guard Armory building
by having other programs ihere.
City Manager Hempe informed the City Council that staff would bring back an
agreement for approval..
By general consent, it was moved by Councilman Rodriguez, seconded by Councilman
Pedroza to bring back an agreement for City Council approval.
Item #18: SUBSTANTIP:L GHANGE CONSOLIDATED ANNUAL ACTION '
PLAN FOR FISCAL YEAR 2003- 2004
, Annette Potts, Deputy Director of Administrative Services that on May 3, 2003, the
CDBG Commission's recommendations were submitted to City Council. City Council
reviewed all proposals and decided to fund the Dominoes Academy in the amount of
;� $20,000. The program became part of the City's fiscal year 2003-2004 Consolidated
Action Plan, and was approved by HUD, effective July 1, 2003. The program's move to
the Teen Center faciliry has caused a problem with the program's eligibility
deterniination. The Teen Center is not a State licensed childcare faci�lity. Therefore, the �
� Dominoes Learning Acaderrfy cannot receive CDBH funds for childcare at the new ��
� location. Dominoes' administrative staff has requested� that funds previously allocated `
for childcare subsides, be reallocated towards a Parent Education Program, which may be
� an eligible use within the Teen Center facility. Dominoes' request to change its location
and scope of services constitute a Substantial Change to the cunent year's Consolidated
Plan. '
After further discussion, it was moved by Councilman Rodriguez, seconded by
Councilman Pedroza to approve Option #1 (Approve an allocation in the amount of
' $20,000 to allow Dominoes Leaming to provide Parent Education at the new location), .
� and to provide a parent education program as well as an Anti-drug prevention program.
Patricia Shields, Childcare Consultant �— Explained that the Parent Eduoation would be
part of the First-5 L.A. Childcare programs where parents would be taught on how to be a
� parent while educating�themselves.

�� � Item# 19: CONFERENCE, TRAINING, AND MEETING POLICY
City Manager Hempe stated that at the last regular meeting, she presented a drafr policy
for conference, training and meeting attendance for Council' consideration. Since that
time, staff has met with City Council Members to receive their input. Councilwoman
Santillan has submitted a drafr policy for Council's consideration.
Councilman Pedroza stated he has reviewed Councilwoman Santillan's draft policy and
believes that she addresses very strong points that must be addressed.
I Councilwoman Santillan addressed the issue of the mileage reimbursement (within a 5
� � Mile Radius), $100.00 stipend, and the $500.00 Car Allowance. � �
Mayor Pro Tem Vasquez stated that they should still get per diems for attending the
meetings. _
° Councilman Pedroza asked the City Attorney to define the difference between Per Diems,
Stipend, and Subsistence Rate.
� City Attorney Beltran responded to Mr. Pedroza's question regarding per diems, stipend,
and subsistence rate.

_ Councilman Pedroza stated that far the record, it is impossible to make the same salary
from 2001 to now, because salary changes have been made.
After further di'scussion, Mayor Pro Tem Vasquez stated that City Council has directed
the City Attorney to work a policy that is reasonable and to bring it back for City
Council approval.
City Manager Hempe informed the City Council that Closed Session Items would ,
take a two-hour discussion.
It was moved by Councilman Pedroza, seconded by Councilwoman Santillan to recess all
Closed Session Items to Wednesday at b:00 p.m.
City Clerk Hooper advised the City Manager that no new items_can be added to the ..
Agenda.
City Clerk Hooper asked that the City Attorney clarify the motion, just made by the
Councilmembers. City Attorney Beltran stated that they couldn't recess the meeting in
accordance to the Brown Act, but suggested to re-notice the Closed Session Items as a
Special meeting for Monday, January 26, 2004 at 6:00 p.m.
CITY COUNCIL ORAL AND WRITTEN COMMUNICATION
Councilman Rodriguez — Requested that city staff follow up on a complaint about the tree
roots lifring up the sidewalk. Complained about the alleys not being deaned:
Councilman Pedroza — Suggested that the two liquor stores located at the comer.of
Lavinia Avenue be put on the Vine Program to prevent graffiti. Also sends
condolescences to the Family of Dalida Espinoza for the passing away,of her son, Daniel'.
Councilwoman Santillan — Christmas Decoration need to be removed, questioned
housing deyelopment at corner of Thorson Ave. and Muriel Dr., requested. an update on
the color chart review for residential homes, requested number of citations'for patrol car,
requested increasing the down payment on the Home Buyer Program, needs to know
whether the City will have 4` of July Firework booths, also requested' that all campaign
signs be removed. '
City Clerk Hooper gave an update about the Fireworks and campaign•ordinances stated
that these two items would be brought back for City Council consideration.
Mayor Pro Tem Vasquez — Pleased to introduce numerous projects such as Sheriff's
Substation, After school Programs, Neighborhood Forums. Also stated the National Girls
and Women in Sports and the Girls Basketball Team need to be recognized.
Mayor Byrd — Stated he talked with Rev. Hawkins about utilizing the computer lab for
the kids. Requesting to have a Summit in the springtime.
