HomeMy Public PortalAbout2006-014 Resolution Granting Site Plan Approval with Variances for PRC LLC 1400 Baker Park RoadMember Cavanaugh introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.2006-14 RESOLUTION GRANTING SITE PLAN APPROVAL WITH VARIANCES FOR PRC, LLC. FOR PROPERTY LOCATED AT 1400 BAKER PARK ROAD WHEREAS, PRC, LLC. (the "Applicant") has requested approval of a site plan with variances to allow a four -tenant retail building for the property located at 1400 Baker Park Road, legally described as follows: Lot 1, Block 1, CARLBERGADDITION, Hennepin County, Minnesota WHEREAS, the Planning Commission has reviewed the request for a site plan with variances at a duly called public hearing on October 11, 2005, and the Planning Commission recommended approval thereof, subject to certain terms and conditions, and WHEREAS, the City Council has reviewed the request for a site plan with variances on February 7, 2006, and WHEREAS, the City Council finds that the variances requested are due to the Applicant providing easements to the City for the benefit of a future road and the variances 'would not be materially detrimental to the purposes of the City Ordinances or to adjacent property in the same zone; and WHEREAS, the City Council finds that the future road poses extraordinary circumstances which do not apply generally to other properties in the same zone; and WHEREAS, the City Council finds that the special conditions or circumstances do not result from the actions of the Applicant; and WHEREAS, the City finds that the variance is the minimum necessary to alleviate the hardship. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota, that it should and hereby does approve the request by PRC, LLC. for a site plan with variances, for the property located at 1400 Baker Park Road, subject to the terms and conditions that shall be met prior to the issuance of a building permit: 1. The Applicant shall provide additional landscaping around the sign area to meet code and to mitigate the lack of landscaping around the perimeter of the building. 2. The Applicant shall provide further architectural elements to the north elevation of the building. Resolution No. 2006-14 February 21, 2006 1 3. The Applicant shall provide details with the building permit for the control of cooking odors. 4. The Applicant shall provide a stub on the east end of the property for optimal access to the extended public utilities for the benefit of the adjacent property owners who currently do not have public utilities. 5. The Applicant shall update the site plan on the northerly half of the private road to show that area as future public right-of-way. 6. The site plans shall meet all city engineering and building requirements and conditions. 7. The Applicant shall comply with the requirements of the Minnesota Department of Health with regard to the existing well on site. 8. The Applicant shall provide an easement to the city right-of-way and drainage and utility purposes over the portion of the site to be used for public roads. 9. The Applicant shall obtain, and provide the city, an easement from Scott Baker for purposes of drainage and flowage. 10. The Applicant shall obtain, and provide the city, an easement from Holiday Station Stores for purposes of drainage and flowage. 11. The Applicant shall obtain a city permit for the demolition of the existing structures on -site as shown on the site plan including the pylon sign at the Holiday property near Hwy 12. 12. The Applicant shall obtain a permit from the Minnehaha Creek Watershed District. 13. The Applicant shall obtain a permit from Hennepin County for all work done in the right-of-way of County Road 29. 14. The Applicant shall obtain approvals from the city of Maple Plain for water service or provide additional details about the private well servicing water to the site. 15. The Applicant shall enter into a Petition and Waiver Agreement with the city for the future construction of the public road prior to issuance of any building permit. 16. The Applicant shall enter into a development agreement with the city which must be executed by the Applicant and the city and filed with the County prior to the issuance of any building permit. Resolution No. 2006-14 February 21, 2006 2 17. The Applicant shall submit a letter of credit in a form satisfactory to the city for the private site improvements. 18. The Applicant shall pay all connection charges for sewer and, if necessary, for water to the site. All fees shall be paid according to the fee structure specified in the development agreement. 19. The Applicant shall provide to the City a digital copy of the approved development plans. 20. The Applicant shall pay to the City an amount sufficient to reimburse the City for the cost of reviewing all plans and applications and for the preparation of all agreements and related documents for the project.
