CITY OF MEDINA
RESOLUTION NO.2006-15
RESOLUTION GRANTING AN AMENDED CONDITIONAL USE PERMIT TO
PRC, LLC. FOR THE CONTINUED USE OF A DRIVE-THRU
WHEREAS, by Resolution 89-46, adopted June 20, 1989, the city of Medina granted a
conditional use permit to Phillip and Helvie Carlberg and Brian and Mary Reeder to
operate a Dairy Queen at 1400 Baker Park Road; and
WHEREAS, the city's zoning ordinance required a conditional use permit under such
circumstances; and
WHEREAS, PRC, LLC, (the "Applicant") has requested approval of an amended
conditional use permit to operate a drive-thru as required in the city's zoning ordinance;
and
WHEREAS, the Planning Commission has reviewed the request at a duly called public
hearing on October 11, 2005, and the Planning Commission recommended approval
thereof, subject to certain terms and conditions, and
WHEREAS, the City Council, on February 7, 2006 reviewed the application for
conformance with city ordinances and considered the recommendations of the Planning
Commission and heard comments from the applicant and other interested parties,
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Medina,
Minnesota that an amended conditional use permit be granted to PRC, LLC for the
continued use of a drive-thru. The conditions set forth in Conditional Use Permit 89-46
shall be replaced by the following conditions:
1. The existing six-foot cedar fence shall be maintained by the Applicant.
2. The Applicant shall close off the northerly access on Baker Park Road.
3. The drive-thru business shall be limited to 1,500 gross floor area.
4. The drive-thru land shall be a one way only.
5. The Applicant shall submit an amended site plan showing the location of all trash
receptacles.
6. The Applicant shall submit loud speaker details and menu board details that meet
city code.

BE IT FURTHER RESOLVED that a default by the applicant of any of the terms and
conditions of this resolution will be grounds for revocation of the conditional use permit.

The motion for the adoption of the foregoing resolution was duly seconded by member
Weir upon vote being taken thereon, the following voted in favor thereof:
Brinkman, Weir, Workman, Cavanaugh, Smith
And the following voted against same:
None
Whereupon said resolution was declared duly passed and adopted.
