HomeMy Public PortalAbout2006-017 Resolution Granting PUD Final Plat Approval for ACE PropertiesMember Smith introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.2006-17 RESOLUTION GRANTING PUD FINAL PLAN APPROVAL FOR ACE PROPERTIES, LLC. FOR PROPERTY GENERALLY LOCATED NORTH OF CLYDESDALE TRIAL, EAST OF COUNTY STATE AID HIGHWAY 101 WHEREAS, Ace Properties, LLC (the "Applicant") has requested approval from the city of Medina (the "City") for a PUD Final Plan for a retail commercial building on property which is legally described in Exhibit A attached hereto (the "Property"); and WHEREAS, the PUD General Plan was heard by the planning commission at its meeting on June 14, 2005 followed by a public hearing according to City ordinance; and WHEREAS, the city council reviewed the PUD Final Plan for its conformance with the City's ordinances on February 7, 2006 and recommended approval of the PUD Final Plan subject to certain conditions. NOW, THEREFORE, BE IT RESOLVED, by the city council of the city of Medina, Minnesota that it should and hereby does approve the request by the Applicant for a PUD Final Plan for the Property, subject to the following conditions: 1. The PUD Final Plan is conditioned upon approval of the final plat of West Ridge Development Second Addition. 2. The PUD Final Plan is subject to the approval of the rezoning of the Property to PUD-Urban Commercial. 3. The Applicant shall submit revise the photometric plan to identify any private luminaries that may conflict with the public luminaries along Clydesdale Trail. The city shall review and approve any changes to the photometric plan. 4. The Applicant shall utilize perennial plants that sustain foliage throughout the year for the east elevation of the building. 5. The City's lighting ordinance, including curfew limitations, applies to parking lot lights within the Development except for security lights for employees. 6. A drive-thru shall not be permitted at this property. 7. The private development plans shall comply with all fire marshall conditions. 8. The private improvement plans shall comply with all building codes. Resolution No. 2006-17 February 21, 2006 1 9. All Development plans must be revised to comply with all city engineer conditions of approval. 10. The private improvement plans shall be approved by the Elm Creek Watershed District. 11. The private improvements plans shall be approved by the Minnesota Pollution Control Agency. 12. No construction work of any kind may take place within the Development except Monday through Friday, 7:00 a.m. to 7:00 p.m., and Saturday 8:00 a.m. to 4:00 p.m. 13. Construction traffic will not be allowed on local roads and must utilize specific haul routes approved by the City. 14. The site shall be subject to an Operation and Easement Agreement in form and substance acceptable to the City and which must be recorded with Hennepin County. 15. A development agreement acceptable in form and substance to the City must be executed by the Applicant and the City and must be filed with the County at the time of final plat. 16. The Applicant shall submit a letter of credit in a form satisfactory to the City for the private development plans. 17. The Applicant shall pay all sanitary sewer and water connection charges prior to issuance of building permits. All fees shall be paid according to the fee structure specified in the development agreement. 18. The Applicant shall provide to the City a digital copy of the approved Development plans. 19. The Applicant shall pay to the City a fee in an amount sufficient to reimburse the City for the cost of reviewing the plan and related documents. Dated: February 21, 2006 Attest: 94 Chad M.
