CITY OF MEDINA
RESOLUTION NO.2006-20
RESOLUTION GRANTING PRELIMINARY PLAT APPROVAL FOR GREG
AND JOY FRIES FOR PROPERTY LOCATED AT 2845 ARDMORE AVENUE
WHEREAS, Greg and Joy Fries (the "Applicant") have applied to the city of Medina
(the "City") to plat certain property located at 2845 Ardmore Avenue, which is legally
described on Exhibit A attached hereto: and
WHEREAS, the plat of the Subject property, to be known as "Fries Independence
View" was reviewed by the planning commission at its meeting on February 14, 2006
and, following public hearing thereon as required by law, .the planning commission
recommended approval thereof, subject to certain terms and conditions; and
WHEREAS, the city council on February 21 and March 6, 2006 reviewed the
preliminary plat for its conformance with the City's ordinances, considered the
recommendations of the planning commission and heard comments from the Applicant.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MEDINA, MINNESOTA, that preliminary approval be granted to
the Applicant for the plat of Fries Independence View, subject to the following terms and
conditions:
1. The final plat shall clearly identify and dedicate the new right-of-way for
Lakeshore Avenue.
2. The Applicant must submit a revised erosion and sediment control plan.
3. The Applicant shall comply with building permit requirements.
4. The Applicant shall comply with the plat opinion letter dated February 1, 2006
5. The Applicant shall comply with the requirements of the Minnesota Department
of Health with regard to the existing well on site, and closure of said well.
6. The Applicant shall pay to the City a fee in an amount sufficient to reimburse the
City for the cost of reviewing the preliminary and related documents.

The motion for the adoption of the foregoing resolution was duly seconded by member
Weir upon vote being taken thereon, the following voted in favor thereof:
Weir, Workman, Cavanaugh, Smith
And the following voted against same: (Absent: Brinkman)

Whereupon said resolution was declared duly passed and adopted.

Exhibit A
Parl : Lot 9, Block 29, "Independence Beach, Hennepin County, Minnesota," and that
part of Government Lot 2, Section 18, Township 118, Range 23, described as follows:
Commencing at the southeast corner of said Government Lot 2: thence on an assumed
bearing of West along the South Line of said Government Lot 2, a distance of 396 feet:
thence on a bearing of North a distance of 297 feet: thence North 70 degrees West, a
distance of 20.50 feet to a point hereinafter referred to as point "A"; thence continuing
North 70 degrees West a distance of 17.25 feet; thence South 20 degrees West, a distance
of 9.69 feet, to the intersection with the Southwesterly line of said Block 29, said
intersection being the point of beginning of the land to be described; thence South 20
degrees West to the Northeasterly line of the public road as described in Document No.
2907575, Files of the County Recorder: thence South 48 degrees 45 minutes East a
distance of 8.24 feet along said Northeasterly line; thence South 20 degrees East a
distance of 14.90 feet, along said Northeasterly line, to a line which bears South 20
degrees West drawn from said point "A"; thence South 20 degrees West, a distance of
20.13 feet, to the Westerly extension of the South line of Lot 10, Block 29: thence
Easterly along said extension, a distance of 69.97 feet, to the Southwest corner of said
Lot 10: thence North 0 degree 36 minutes West to the Norwest corner of said Lot 9:
thence North 70 degrees 13 minutes 15 seconds West a distance of 50.82 feet, to the point
of beginning, according to the recorded plat and Government Survey thereof.
The boundary lines of the above land are set by Judicial Landmarks pursuant to Torrens
Case No. 19278, see Document No. 1862901 for location of said Judicial Landmarks.
Subject to a public road easement over a portion of said Government Lot 2 as shown by
instrument of record in Book 2020 of Deeds, page 128, Document No. 2907575;
Subject to a reservation of the State of Minnesota of mineral and mineral rights as to Lot
9;
Subject to a 40 foot perpetual easement for sanitary sewer and water purposes, which
easement was created by instrument dated June 12, 1975, and recorded August 2, 1978,
as Hennepin County Recorder Document No. 4223184, the legal description of which
easement has been reformed as set forth in Torrens Case No. 19278, as described in
Finding No. 17, Document No. 1862900, Files of the Register of Titles;
Par 2; Lot 10, Block 29, "Independence Beach, Hennepin County, Minnesota", according
to the recorded plat thereof.
