HomeMy Public PortalAbout2613 (09-06-55) zc��3 RESOLUTION N0 2613 , RESOLUTION OVERRULING PROTESTS IN CONNECTION WITH THE HEARING ON DEBT LIMITATION FOR THE PROPOSED IMPROVEMENT OF BEECHWOOD AVENUE BE- TWEEN LONG BEACH BOULEVARD AND CALIFORNIA AVENUE BY THE CONSTRUCTION OF CURBS, GUTTERS, DRIVEWAYS, AND SIDEWALKS, AND THE REMOVAL OF EXISTING PARKWAYS, DRIVEWAYS, AND POE�TIONS OF SIDEWALKS. WF�REAS, the City Council of the City of Lynwood did, on ' the 7th day of August, 1955 approve an investigation report under the provisions of Division 4 of the Streets and Highways Code, cited as "Special Assessment Investigation, Limitation and Majority Protest Act of 1931" as amended, upon the proposed of Beechwood Avenue between Long Beach Boulevard and California Avenue by the con- struction of curbs, gutters, driveways, and sidewalks, and the re- moval of existin arkwa s drivewa s and ortions of sidewalks 6 P Y, Y, P , including all incidental and appurtenant work, as shown on Plan No. 1955—e—z on file in the office of the City Clerk of said City, and , WHEREAS, said report having been duly prepared and filed, a hearing was held by said City Council on the 6th day of September, 1955 in the manner provided in said Act above referred to; and WHEREAS, more than thirty days have expired since the date of mailing notices of hearing on said report; NOW, Tf�REFORE, the City Council of the City of Lynwood does hereby resolve as follows: 1. That the protests made at said hearing on said investi- gatibn report be and the same are hereby overruled. 2. That the publie interest, convenience, and necessity require the doing and making of the public improvement set forth and described in said report above referred to and substantially in the manner set forth; 3. That the pro,ject consisting of the proposed improvement above referred to is feasible and that the lands to be assessed will be able to carry the burden of said proposed assessment, and the v � -1- i limitations on the amounts of assessments provided for in this part may be�disregarded, both with respect to the limitations on the dis- trict as a whole and as to the limitation on individual specific assessments. 4. That the estimated total amount proposed to be assessed upon any or a11 lots or parcels of land for the costs and expenses of said proposed improvement does not exceed the limitation of indebt- edness established and set forth in said act above referred to and will not, by the levy thereof, cause said limitation to be exceeded in any instance; 5, That the written protests filed with the clerk of the legislative body by the owners did not constitute a ma,jority of the frontage of the property fronting on said proposed improvement. 6. That it is hereby ordered that the proceedings for the making of said proposed improvement be undertaken pursuant to the provisions of an Act of the Legislature of the State of California, designated as Division 7 of the Streets and Highways Code, cited as the "Improvement Act of 1911, and amendments thereto."
