RESOLUTION NO.2006-25
RESOLUTION ADOPTING ASSESSMENT ROLL
FOR PARK RIDGE ACRES IMPROVEMENTS
WHEREAS, Richard R. Rudd and Kathleen M. Rudd, husband and wife; Shane Rudd
and Kristine M. Rudd, husband and wife; and David W. Kearin and Marjorie G. Kearin, husband
and wife (collectively, the "Owners") are the fee owners of the land in Medina platted as Park
Ridge Acres, Hennepin County, Minnesota (the "Property"); and
WHEREAS, the city of Medina (the "City") previously awarded a contract for
construction of roadway, sanitary sewer, water and storm water improvements (the
"Improvements") to serve the Park Ridge Acres subdivision and for the benefit of the Property;
and
WHEREAS, the Owners executed a petition and waiver agreement dated March 30,
2005 and recorded in the office of the county recorder, Hennepin County, Minnesota as doc.
no. 8572559 (the "Petition and Waiver Agreement"), waiving hearing and notice of hearing on
the levying of special assessments for the Improvements against the Property; and
WHEREAS, the cost of the Improvements have now been calculated, including a credit
for the amount received by the City from the Minnesota Department of Transportation towards
cost of the Improvements, and the City intends to specially assess the Property for the
Improvements in accordance with the terms and conditions of the Petition and Waiver
Agreement.
NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina,
Minnesota, as follows:

1. The assessment roll for the Improvements, a copy of which is attached hereto as
Exhibit A and made a part hereof, is hereby accepted and shall constitute a special assessment
against the lands named therein. Each tract of land therein included is hereby found to be
benefited by the Improvements in the amount of the assessment levied against it.
2. Assessments shall be payable upon sale of each lot to a third -party purchaser and
shall bear interest at the rate of 5.75% per annum from the date of the adoption of this assessment
resolution. Subject to the payment schedule in paragraph 3 of this resolution, the assessment for
each lot shall be deferred until such time as the lot is sold or for five years from March 30, 2005,
the date of the Petition and Waiver Agreement, whichever comes first, at which time principal
and accrued interest shall be due in full.
3. Special assessments may not be pre -paid. Notwithstanding such prohibition and
the deferral authorized under paragraph 2 of this resolution, special assessments shall be paid at
such times and amounts to ensure that at least 25 percent of the total special assessments are paid
by no later than January 15, 2008; at least 50 percent of the total assessments are paid by no later
than January 15, 2009; and 100 percent of the special assessments are paid by no later than
January 15, 2010.
4. The administrator -clerk shall forthwith transmit a certified duplicate of this
assessment resolution and roll to the Hennepin county auditor to be extended on the proper tax
list of the county and such assessment shall be collected and paid over in the same manner as
other municipal taxes.

upon vote being taken thereon, the following voted in favor thereof:
Brinkman, Weir, Workman, Smith
and the following voted against: (Absent: Cavanaugh)
None
Whereupon said resolution was declared duly passed and adopted.
