CITY COUNCIL
MINUTES
SEPTEMBER 17, 1985
INITIATION:
I 1. CALL TO ORDER:
Mayor Dennis called the regular meeting of the City Council to order
at 7:35. p.m. on Tuesday, September 17, 1985, in the Council Chambers.
2. The invocation was given by Acting City Manager, Jeff Shaw.
3. The Pledge of Allegiance to Che Flag was led by Mayor Dennis.
4. ROLL CALL:
Present: Councilmen -- Atkins, Gillanders, Swain, Tyrell, Dennis
Absent: Councilmen -None
Also Present: Planning Director Shaw, City Attorney Martin, Parks
and Recreation Director Kobett, Public Works Coordin-
ator Peterson and Judy Cook of the Temple City Times.
PRESENTATION: Mr. Oscar Valencia of the Automobile Club of Southern
California presented a 1984 Pedestrian Safety Citation plaque to
Mayor Dennis in recognition of Temple City's zero pedestrian fatality
rate during the past year and for those safety services activities
developed to enhance pedestrian safety. Mayor Dennis in turn pre-
sented a Proclamation to Mr. Valencia proclaiming the month of Sep-
tember as "Seat Belts Work" Month.
5. CONSENT CALENDAR:
It was moved by Councilman Gillanders, seconded by Councilman Atkins
and unanimously carried to approve all items on the Consent Calendar.
A. APPROVAL OF MINUTES Regular Meeting of September 3, 1985
Approved as written.
B. RECOMMENDATION FROM TRAFFIC COMMISSION MEETING OF SEPTEMBER 4, 1985
(1) HOLIDAY PARKING ENFORCEMENT - PUBLIC PARKING LOTS, CENTRAL
BUSINESS DISTRICT
Council approved that parking enforcement be provided by the
Sheriff's Department five days per week, four hours per day,
Monday through Friday beginning December 9 and ending Decem-
ber 24, 1985 in the public parking lots of the central busi-
ness district. Funds have already been budgeted for the
increased enforement.
C. RECOMMENDATIONS FROM PLANNING COMMISSION MEETING OF SEPTEMBER 10,
1985
(1) SET PUBLIC HEARING: REQUEST FOR CHANGE OF ZONE FROM R -1 TO
R -2 (4809 Hallowell Avenue)
Council set public hearing for October 1, 1985.
(2) PROPERTY NUISANCE CASE. NO. 85 -136: 4834 ARDEN DRIVE
Council. adopted Resolution. No 85 -2385, a Resolution of the
City of ,Temple City declaring certain premises to be a public
nuisance and ordering abatement.

(3) PLANNING COMMISSION ACTION
Council received and filed memo from the Planning Commission
outlining action taken at the Commission's meeting of Sep -
tember 10 1985.
D. APPEAL OF THE DECISION. OF THE PLANNING COMMISSION DENYING A RE-
QUEST TOR A CONDITIONAL USE PERMIT TO ALLOW A 15 -UNIT RESIDENTIAL
CONDOMINIUM AT 9547 -9549 GARIBALDI; APPLICANT: LOUIS AND
JOSEPHINE PIEROTTI
Council set public hearing for October 1, 1985 to hear appeal.
E. SET PUBLIC HEARING: EXTENDING ORDINANCE NO. 85 -570, AN INTERIM
URGENCY ORDINANCE AMENDING SEC. 3 OF ORDINANCE 85 -565 AS IT RE-
LATES TO ZONING
Council set public. hearing for October 1, 1985.
F. ACCEPTANCE OF BID AND AWARD OF CONTRACT - 1985 -86 CHIP AND SLURRY
SEAL PROJECT, MAINTENANCE AREA 4 AND EL MONTE AVENUE
Council accepted low bid from Manhole Adjusting Contractors, Inc.
in the amount of $136,515 and authorized Mayor and City Clerk to
sign Agreement.
G. LEAVE OF ABSENCE FOR SHIRLEY RASCHKE, BUSINESS LICENSE CLERK
Council, approved the request for leave of absence for Shirley
Reschke.
H. CLAIM FOR DAMAGE: CHRISTOPHER YOUNG
Council denied claim and referred it to JPIA.
I. RESOLUTION NO.: 85 -2381: EMPLOYMENT OF PERSONNEL
Council adopted Resolution appointing budgeted personnel.
J. RESOLUTION NO. 85-2382: WARRANTS AND,DEMANDS - Council adopted
Resolution. No. 85 -2382 authorizing payment of bills.
6. UNFINISHED BUSINESS:
A. PUBLIC HEARING: CONDITIONAL USE PERMIT 85 -763 TENTATIVE TRACT
NO. 43790; APPL.ICANT:• DR, ADEL MOUFARREJ (9626 Longden Avenue)
Planning Director Shaw provided background information stating
the Planning Commission at their August 27 meeting approved and
recommended that City Council approve a tentative tract map to
allow development of Ha five -unit residential condominium at 9626
Longden Avenue. The development will consist of five one -story
attached dwelling units with a total lot coverage of 40 %. Each
unit will include approximately 1,100 square feet of floor area,
with 2 bedrooms, 2 baths, living and dining areas, kitchen and a
2 -car garage. A Negative Declaration of Environmental Impact has
been filed indicating the project will not have a significant
environmental impact,
Mayor Dennis declared the public hearing open and invited anyone
wishing to speak to come forward.
Adel. Moufarrej, 701 West Callita Street, Arcadia, the applicant,
requested Council to consider the conditional use permit favor -
ab.ly.
There being no one else: wishing to.address Council, Councilman
Tyrell moved to close the public hearing, seconded by Councilman
Gillanders and unanimously carried.
Councilman Tyrell moved to make the Planning Commission reports
a part of the records of the public hearing, seconded by Council -
(Apn Gillanders and unanimously carried.

Councilman' Atkins moved to certify the Negative Declaration of
Environmental Impact, seconded by Councilman Swain and unani-
mously carried.
Councilman Atkins moved to approve the request for Tentative Tract
43790 allowing development of a 5 -unit residential condominium
at 9626 Longden Avenue per the findings of the Planning Commission,
seconded by Councilman Swain and unanimously carried.
B. PUBLIC HEARING: PROPOSED AMENDMENT TO THE TEMPLE CITY ZONING
CODE TO INCLUDE PROVISIONS FOR PEDESTRIAN- ORIENTED SIGNS IN COM-
MERCIAL ZONES
Planning Director Shaw provided background information stating
that the Planning Commission approved and recommended on August
27; 1985 that City Council approve an amendment to the Temple
City Zoning Code to include provisions for pedestrian- oriented
signs in commercial zones. The proposed ordinance includes a
definition of "under canopy /marquee" signs and will allow one.
under - canopy /marquee sign and /or one pedestrian- oriented wall sign
provided the total sign area does not exceed six (6) square feet.
Under- canopy signs shall maintain a vertical clearance of 7 feet
6 inches above the sidewalk and shall not project beyond the edge
of the canopy or marquee. Signs shall be limited to the identifi-
cation of the business or service and not used for the purposes
of advertisement. A Negative Declaration of Environmental Impact
has been filed.
Mayor Dennis declared the public hearing open and invited anyone
wishing to speak to come. forward.
There being no one wishing to address Council, Councilman Tyrell
moved to close the public. hearing, seconded by Councilman Atkins
and unanimously carried.
Councilman Atkins moved to certify the Negative Declaration of
Environmental Impact, seconded by Councilman Gillanders and unani-
mously carried.
City Attorney Martin introduced Ordinance No. 85 -571, AN ORDINANCE
OF THE CITY OF TEMPLE CITY ADDING TO SECTIONS 9321 AND 9326 OF
THE TEMPLE CITY 'ZONING CODE AMENDING REGULATIONS PERTAINING TO
SIGNS TO. INCLUDE PROVISIONS. FOR PEDESTRIAN- ORIENTED SIGNS IN COM-
MERCIAL ZONES for first reading by title only.
Councilman Atkins moved to waive further reading of Ordinance
No. 85 -571, seconded by Councilman Swain and unanimously carried.
7. NEW BUSINESS:.
A, APPEAL OF DENIED OVERNIGHT PARKING PERMIT APPLICATION; EDWARD REY,
10259. NADINE 'STREET
Planning Director Shaw advised Council that Mr. Edward Rey re-
quested an appeal of'the Traffic Commission decision. Mr. Rey
felt that, in view of the fact that he owned two full -size trucks
and a Cadillac, and that his housematre is a brick mason who uses
the garage to store his cement mixer, tools and cement, his park-
ing permit should be approved.
Council viewed a video of the location, noting that the cement
mixer was in the driveway and not stored in the garage. It was
the consensus of the Council that, if the garage was used to
park one of the vehicles rather than being used for storage,
sufficient space is available on the 52 -foot driveway for the
other two vehicles.
Councilman Tyrell moved to deny the appeal of the overnight park -
ing permit of Edward Rey, 10259 Nadine Street, seconded by Coun-
cilman Atkins and unanimously carried.

8. COMMUNICATIONS:
A. CHAMBER OF COMMERCE FOR HALLOWEEN HOEDOWN
Councilman Gillanders expressed concern about the insurance risk
of having Las Tunas Drive blocked off to vehicular traffic bet-
ween Temple City Boulevard and Cloverly Avenue.
Councilman Swain responded that the streets in question were wel
barricaded with sufficient members of the Sheriff's Department 'I
and Emergency Reserve personnel. '�
Councilman Atkins moved to approve the request of the Chamber of
Commerce to hold their 5th Annual Halloween Hoedown on Saturday,
October 26, 1985, subject to the required certificate of insurance
and coordination with City staff, seconded by Councilman Tyrell
and unanimously carried.
B. HANS GUBLER /GUBLER.ORCHIDS UPDATE
Planning Director Shaw advised Council that_ he and City Attorney
Martin.met.with William Burtocao,.attorney for.Hans and Chris
Gubler;.on September 12 to discuss alternatives for'the Gubler
Orchids property. 'At that time, a request for thirty days was
granted to allow Mr. Brutocao time to meet with his clients to
discuss alternc_tive solutions to the case.
Councilman Tyrell moved to receive and file a letter from William
Brutocao and City Attorney Martin's written response, seconded by
Councilman Atkins. and unanimously carried.
9. TIME FOR THOSE IN THE AUDIENCE 'WHO WISH TO SPEAK:
Lucinda Grant, '5434 El Monte•Avenue, Temple City, brought to the att -
tion of the City Council the problem of speeders in the area of
El Monte Avenue from Las Tunas to Lower Azusa Road. Mrs. Grant scat
it was very difficult to cross El Monte Avenue safely and was concerned
about the elderly and the youngsters trying to cross this street.
A representative of the Sheriff's Department was present and stated
that the problem would be investigated. Council requested the
Sheriff's Department to.provide additional enforcement of speed re-
striction on El Monte Avenue between Las Tunas Drive and-Lower Azusa
Road
RECESS TO CRA:
At this time Council recessed to meet as the Temple City Community
Redevelopment Agency; approved the Minutes of the regular meeting of
September 3, 1985; and approved a wall sign for the Ice Haus on
Rosemead Boulevard. The Minutes are set forth in full in the records
of the Agency,

Councilman GillaDdera suggested a modification in the Rules and
Regulations #2 to read: The Community Room is available, on a
reserved basis, only to non - business Temple City groups and
He also recommended that the telephone in the Community
Room be programmed for 911 only calls.
Councilman Gillanders moved to approve the modified Guidelines
for Use of the New Community Room, seconded by Councilman Swain

B. DELEGATION OF AUTHORITY TO THE CITY CLERK'S OFFICE TO SET PUBLIC
HEARINGS
Councilman Tyrell moved to delegate the authority to set public
111 hearings to the City Clerk's Office per staff memo, seconded by
Councilman Gillanders and unanimously carried.
C. REQUEST FROM TEMPLE 'CITY AMERICAN YOUTH SOCCER ASSOCIATION
Councilman Atkins moved to approve the use of Live Oak Park by
the Temple City American Youth Soccer Association on September 21,
1985 from 6:00.. a.m. to 11:00 a.m. for a Pancake Breakfast, secon-
ded by Councilman Gillanders and unanimously carried.
D. SB 821, FUNDS - SIDEWALK PROJECTS
Planning Director Shaw stated that each year the City is required
to file a 'claim for the use of SB 821 funds, which are designated
for sidewalk construction purposes under the State Transportation
Development Act. This year $7,777 has been apportioned to the
City. The top uncompleted priority or the Master Plan of Side-
walks adopted by the City Council in October of 1981 is the con-
struction of sidewalk on portions of the west and east sides of
El Monte Avenue between Live 0ak and Freer.
Councilman Atkins moved to adopt Resolution No. 85 -2383 approving
the claim for the City's allocation of SB 821 funds for fiscal year
1985-86, seconded by Councilman Swain and unanimously carried.

On motion by Councilman Swain, seconded by Councilman Tyrell, the
meeting adjourned. at 8:25 p.m. Next regular meeting of the City
Council will be held on Tuesday, October 1, 1985, at 7:30 p.m. in
the Council Chambers.
