HomeMy Public PortalAbout2006-039 Resolution Granting Preliminary Plat Approval for Jan-Har Ltd 922 Hwy 55Member Smith introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.2006-39 RESOLUTION GRANTING PRELIMINARY PLAT APPROVAL FOR JAN-HAR LIMITED PARTNERSHIP FOR PROPERTY LOCATED AT 922 STATE HIGHWAY 55 WHEREAS, Jan-Har Limited Partnership (the "Applicant") has applied to the city of Medina (the "City") to plat certain property located at 922 State Highway 55, which is legally described on Exhibit A attached hereto: and WHEREAS, the plat of the Subject property, to be known as "Jan-Har" was reviewed by the planning commission at its meeting on May 9, 2006 and, following public hearing thereon as required by law, the planning commission recommended approval thereof, subject to certain terms and conditions; and WHEREAS, the city council on June 6, 2006 and June 20, 2006 reviewed the preliminary plat for its conformance with the City's ordinances, considered the recommendations of the planning commission and heard comments from the Applicant. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF MEDINA, MINNESOTA, that preliminary approval be granted to the Applicant for the plat of Jan-Har, subject to the following terms and conditions: 1. A preliminary plat is approved to allow the construction of a new office and warehouse, in accordance with the plans received by the City on January 9, 2006 and revisions received on April 26, 2006 except as amended by the City Council. 2. The plat must be revised to dedicate to the public, the right-of-way, with a 50-foot minimum radius in the northeast corner of the site. 3. The plat shall be revised to identify all wetlands within a drainage and utility easement. 4. The plat shall be revised to extend the drainage and utility easement to the north property line for the future water main extension. 5. The development shall comply with all conditions of site plan and conditional use permit approval. Resolution No. 2006-39 June 20, 2006 1 6. The application for final plat must be submitted to the City within 180 days of preliminary plat approval or the preliminary plat shall be considered void, unless a written request for time extension is submitted by the applicant and approved by the City Council. 7. The Applicant shall pay to the City a fee in an amount sufficient to reimburse the City for the cost of reviewing the preliminary plat and related documents. Dated: June 20, 2006 Attest: Chad M. Resolution No. 2006-39 June 20, 2006 2 Exhibit A PROPOSED LEGAL DESCRIPTION PER THE EXAMINER OF TITLES That part of the Northeast Quarter of Section 11, Township 118 North, Range 23 West, Hennepin County, Minnesota described as follows: Beginning at the most southerly southeast comer of Lot 2, Block 1, TWIN CITY MONORAIL; thence on an assumed bearing of North 00 degrees 16 minutes 20 seconds East, along an east line of said Lot 2, a distance of 352.38 feet to an interior corner of said Lot 2; thence South 68 degrees 08 minutes 06 seconds East, along a southerly line of said Lot 2, a distance of 187.85 feet; thence South 00 degrees 16 minutes 20 seconds West a distance of 425.65 feet to the center line of Minnesota State Highway No. 55 as monumented; thence North 69 degrees 58 minutes 40 seconds West, along said centerline, a distance of 185.58 feet to the intersection with a line bearing South 00 degrees 16 minutes 20 seconds West from the point of beginning; thence North 00 degrees 16 minutes 20 seconds East a distance of 79.69 feet to the point of beginning.
