HomeMy Public PortalAbout2006-040 Resolution Granting CUP Approval for JAN-HAR Ltd. 922 Hwy 55IU Member Smith introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.2006-40 RESOLUTION GRANTING CONDITIONAL USE PERMIT APPROVAL FOR JAN-HAR LIMITED PARTNERSHIP FOR PROPERTY LOCATED AT 922 STATE HIGHWAY 55 WHEREAS, Jan-Har Limited Partnership (the "Applicant") has applied to the city of Medina (the "City") for conditional use permit approval for property located at 922 State Highway 55, which is legally described on Exhibit A attached hereto: and WHEREAS, the conditional use permit was reviewed by the planning commission at its meeting on May 9, 2006 and, following public hearing thereon as required by law, the planning commission recommended approval thereof, subject to certain terms and conditions; and WHEREAS, the city council on June 6, 2006 and June 20, 2006 reviewed the conditional use permit for its conformance with the City's ordinances, considered the recommendations of the planning commission and heard comments from the Applicant. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF MEDINA, MINNESOTA, that conditional use permit approval be granted to the Applicant, subject to the following terms and conditions: 1. A conditional use permit is approved to allow the construction of a new office and warehouse, in accordance with the plans received by the City on January 9, 2006 and revisions received on April 26, 2006 except as amended by the City Council. 2. Exhaust and emissions shall not adversely effect use of adjacent property or tenant space on the property. 3. Provisions for storage of hazardous materials must be included in the building and identified on the plans. 4. The development shall comply with all conditions of preliminary plat and site plan approval. 5. The Applicant shall pay to the City a fee in an amount sufficient to reimburse the City for the cost of reviewing the conditional use permit and related documents.
