RESOLUTION NO.2006-41
RESOLUTION GRANTING SITE PLAN APPROVAL FOR
JAN-HAR LIMITED PARTNERSHIP FOR PROPERTY LOCATED
AT 922 STATE HIGHWAY 55
WHEREAS, Jan-Har Limited Partnership (the "Applicant") has applied to the
city of Medina (the "City") for site plan approval for property located at 922 State
Highway 55, which is legally described on Exhibit A attached hereto: and
WHEREAS, the site plan was reviewed by the planning commission at its
meeting on May 9, 2006 and the planning commission recommended approval thereof,
subject to certain terms and conditions; and
WHEREAS, the city council on June 6, 2006 and June 20, 2006 reviewed the site
plan for its conformance with the City's ordinances, considered the recommendations of
the planning commission and heard comments from the Applicant.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MEDINA, MINNESOTA, that site plan approval be granted to the
Applicant, subject to the following terms and conditions:
1. A site plan is approved to allow the construction of a new office and warehouse,
in accordance with the plans received by the City on January 9, 2006 and
revisions received on April 26, 2006 except as amended by the City Council.
2. To the extent the driveway does not meet the wetland setback requirements, the
applicant must submit a variance application. The approval of the site plan is
contingent upon approval of the variance. The variance application must be
reviewed concurrently with the final plat.
3. The landscape plan must be revised to identify the 10-foot wetland setback. The
10-foot buffer area must be restored to its natural state. There shall be no trees or
shrubbery located within this area.
4. The landscape plan must be revised to provide the required number of trees and
foundation plantings as well as a seeding plan for the wetland buffer area.
5. The landscape plan must identify any significant trees.
6. The applicant must verify that the decorative block will be utilized on all 4 sides
of the dumpster enclosure.
7. Fence details for screening of the electrical equipment must be provided.

8. Retaining wall details must be provided.
9. A revised photometric plan must be submitted to identify light fixtures.
10. The maximum pole height for pole mounted luminaries may not exceed 30 feet
plus a pole base not to exceed 30 inches high.
11. The utility plan must be revised so that the water main is located west of the
building and terminates at a point directly west of the building and drive area.
12. Any illuminated signs must be turned off at 10:00 p.m. or when then business
closes, whichever is later and may not be turned on until 6:00 a.m. or whenever
the business opens, whichever is later.
13. The plan must be revised to identify the side yard setback for the sign.
14. The site plan must be revised to identify the driveway and drive aisle widths.
15. The applicant must obtain the necessary permits for building demolition.
16. The applicant is subject to the review and approval of the Fire Marshall and
Building Official.
17. The applicant must comply with the conditional use permit standards for
extermination and pest control facilities.
18. The applicant must comply with the City Engineer's stormwater memo dated
March 16, 2006.
19. The applicant must comply with the MnDOT letter dated May 10, 2006.
20. The applicant must comply with the City Engineer letter dated May 17 2006.
21. The applicant must comply with the Elm Creek Watershed Commission letter
dated May 10, 2006.
22. The development shall comply with all conditions of preliminary plat and
conditional use permit approval.
23. The Applicant shall pay to the City a fee in an amount sufficient to reimburse the
City for the cost of reviewing the site plan and related documents.

Weir upon vote being taken thereon, the following voted in favor thereof:
Brinkman, Weir, Workman, Cavanaugh, Smith

That part of the Northeast Quarter of Section 11, Township 118 North, Range 23 West, Hennepin County,
Minnesota described as follows:
Beginning at the most southerly southeast comer of Lot 2, Block 1, TWIN CITY MONORAIL; thence on
an assumed bearing of North 00 degrees 16 minutes 20 seconds East, along an east line of said Lot 2, a
distance of 352.38 feet to an interior corner of said Lot 2; thence South 68 degrees 08 minutes 06 seconds
East, along a southerly line of said Lot 2, a distance of 187.85 feet; thence South 00 degrees 16 minutes 20
seconds West a distance of 425.65 feet to the center line of Minnesota State Highway No. 55 as
