CITY OF MEDINA
RESOLUTION NO.2006-43
RESOLUTION GRANTING APPROVAL OF A VARIANCE FOR JASON AND
STEPHANIE LEY FOR PROPERTY LOCATED AT 485 VIXEN ROAD
WHEREAS, Jason and Stephanie Ley (the "Applicants") have requested
approval from the city of Medina (the "City") for a variance from a wetland setback
requirement to allow a performance -based septic system to be constructed and utilized for
the property located at 485 Vixen Road (the "Property"), legally described as follows:
Lot 4, Block 1, Tally Ho Farms
WHEREAS, the City finds that the granting of the variance requested will allow
the property in question to be put to reasonable use; and
WHEREAS, the City finds that the variance requested is the minimum variance
needed to allow a septic system per city ordinance section 720; and
WHEREAS, the City finds that extraordinary physical characteristics do exist
that are unique to the property; and
WHEREAS, the City finds that the special conditions or circumstances do not
result from the actions of the Applicants; and
WHEREAS, the City finds that the variance will not be detrimental to the public
health, safety or welfare or injurious to the Property, surrounding properties, ground
water quality or the use and enjoyment of other properties in the area; and
WHEREAS, the City Council reviewed the application on June 20, 2006 for it's
conformance with the city's ordinances and Minnesota Rules Chapter 7080 including part
7080.0179, and heard comments from the Applicants and other interested parties,
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Medina, Minnesota that a variance be granted to Jason and Stephanie Ley for the
property located at 485 Vixen Road, subject to the following terms and conditions:
1. The septic system designer and Applicants must provide reasonable assurance of
the performance of the system with a design that shows pretreatment, metering and
an alarm device that warns that the system has failed.
2. The Applicant must provide a monitoring program for the septic system with a
minimum quarterly maintenance schedule for the first two years.

3. The Applicant must obtain a building permit for the septic system.
4. The Applicant shall pay all fees sufficient to reimburse the City for the cost of
reviewing the plan and related documents.

The motion for the adoption of the foregoing resolution was duly seconded by member
Weir upon vote being taken thereon, the following voted in favor thereof:
Brinkman, Weir, Workman, Cavanaugh, Smith
And the following voted against same:
None
Whereupon said resolution was declared duly passed and adopted.
