RESOLUTION NO. 2006-46
RESOLUTION GRANTING PRELIMINARY PLAT APPROVAL FOR
BRUCE PADDOCK FOR PROPERTY LOCATED
AT 2492 AND 2520 WILLOW DRIVE
WHEREAS, Bruce Paddock (the "Applicant") has applied to the city of Medina (the
"City") to plat certain property located at 2492 and 2520 Willow Drive, which is legally
described on Exhibit A attached hereto: and
WHEREAS, the plat of the Subject property, to be known as "Willow Hill Preserve" was
reviewed by the planning commission at its meeting on June 13, 2006 and, following
public hearing thereon as required by law, the planning commission recommended
approval thereof, subject to certain terms and conditions; and
WHEREAS, the city council on July 5, 2006 and July 18, 2006 reviewed the preliminary
plat for its conformance with the City's ordinances, considered the recommendations of
the planning commission and heard comments from the Applicant.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MEDINA, MINNESOTA, that preliminary approval be granted to
the Applicant for the plat of Willow Hill Preserve, subject to the following terms and
conditions:
1. A preliminary plat is approved to allow the creation of two additional lots, in
accordance with the plans received by the City on September 9, 2005 and
revisions received on May 1, 2006 except as amended by the City Council.
2. The applicant must revise the preliminary plat to identify the current property
owner.
3. The plat shall be revised to identify drainage and utility easements over all
ponding areas, drainage ways and wetlands.
4. The landowner shall comply with the Wetland Conservation Act.
5. Best Management Practices (BMPs) for erosion control shall be employed in
compliance with Section 828.29 of the Zoning Ordinance.
6. Approval is subject to the review of the Minnehaha Creek Watershed District and
the Elm Creek Watershed District as the site is located within both watersheds.
7. The plat shall dedicate 45 feet of right-of-way for Willow Drive reflecting the
slope and topography of the property.

8. The applicant shall comply with all City requirements as noted in the comments
from the City Engineer, dated September 19, 2005.
9. Special consideration should be given to the location, grade and safety of the
Willow Drive curb cut and width of the private road. Final design shall be
determined by the applicant in consultation with city staff.
10. The applicant must submit a variance application for the portion of the private
road that does not meet city requirements. The approval of the plat is contingent
upon approval of the variance. The variance must be run concurrently with the
final plat.
11. The plans must be revised to identify the cul-de-sac as a private road with a public
easement for emergency vehicle access.
12. The applicant must provide a private road agreement with the final plat submittal.
13. The driveways shall access the private road at a 90 degree angle (perpendicular)
so vehicles can enter properly from both directions.
14. The applicant must conduct a tree survey for the proposed impact areas.
15. The applicant must work with City staff to minimize the impact on existing trees.
16. The application is subject to the new tree preservation ordinance.
17. The application is subject to conditions set by the Park Commission for park
dedication and trail easements.
18. The application for building permits must include grading, drainage and erosion
control plans with each building plan submitted.
19. The Building Inspector must approve the soil percolation tests and septic system
designs prior issuance of building permits. Septic sites must be staked prior to
beginning any construction on site.
20. The Building Inspector must inspect the existing septic systems to ensure
compliance with Rule 7080 and City standards.
21. The application for final plat must be submitted to the City within 180 days of
preliminary plat approval or the preliminary plat shall be considered void, unless
a written request for time extension is submitted by the applicant and approved by
the City Council.
22. The Applicant shall pay to the City a fee in an amount sufficient to reimburse the
City for the cost of reviewing the preliminary plat and related documents.

Cavanaugh upon vote being taken thereon, the following voted in favor thereof:
Weir, Workman, Cavanaugh, Smith
And the following voted against same: (Absent: Brinkman)

Whereupon said resolution was declared duly passed and adopted.
