Request filed by City Staff to rezone an area containing 24 property parcels and consisting of approximately 27.57 acres from M-2 General Industrial to C-2 General Commercial. The street address of the properties contained within this area include 2701,2705,2709, 2713, 2717 and 2721 Industrial Drive, 204, 204 Rear, 206, 207, 210,211, 215 and 221 Metro Drive, 2712, 2716, 2724, 2728 and 2729 Plaza Drive, 116, 117 and 201 Commerce Drive, 2801 and 2815 W Truman Boulevard. The area is described as lots 1-16 of Bax's Commercial Property Subdivision and lots 17 and 37- 42 of Bax's Commercial Property Subdivision Section 2 and five metes and bounds,parcels located in the east half of the Southeast Quarter and the east half of the Northeast Quarter of Fractional Section 3,Township 44, Range 12,Jefferson City,Cole County,Missouri. The area is generally located south of Industrial Drive in the vicinity of Commerce Drive(HWY 179). Notification By publication in the newspaper,by letter to adjacent and affected property owners within 185 feet, and by three sign postings at intersections within the area. Location and Zoning The subject area is generally located south of Industrial Drive in the vicinity of Commerce Drive(HWY 179). The area is currently zoned M-2 General Industrial. Please see the attached map showing the boundaries of the area. Nature of Request • This is a staff initiated request to rezone the Metro/Plaza Drive area from M-2 General Industrial to C-2 General Commercial. This is a revised proposal,the original proposal was presented to landowners of the area and revised based on their comments. Staff Analysis A staff analysis of the rezoning proposal is attached. This staff analysis was mailed to each of the property owners within the Plaza/Metro/Merchants Drive area along with comment forms asking for feedback on the rezoning proposal. Correspondence Several comment forms relating to the rezoning proposal have been received. Of the 5 written comments received as of January 4`'', 2007, all are in favor of the rezoning proposal. Public comments relating to the original rezoning proposal are on file and are available on request. Staff Recommendation Staff recommends approval of the request to rezone the area from M-2 to C-2. Revised Staff Analysis • Hwy 179/1ndustrial Drive-Merchants/Metro/Plaza Drive Area Nature of Analysis: The Hwy 179/Industrial Drive - Merchants/Metro/Plaza Drive area consists of approximately 47 '/2 acres generally located at the junction of Highway 179 (Commerce Drive) and Industrial Boulevard. There are 39 separate parcels of private property located within the boundaries of this area. In the process of answering general planning and zoning related questions about possible development in this area, city staff realized that this rather Iarge area of land may be zoned improperly for its current and intended future use. Location: Please see the attached map showing the boundaries of the area. Current Zoning: M-2 General Industrial Staff Analysis: Comprehensive Plan: The Development Plan of the City of Jefferson Comprehensive Plan shows this area as being split by two intended land uses. The majority of this area is shown as commercial while the southern portion of the area along Merchants Drive is shown as Industrial. History: The City of Jefferson adopted a revised zoning ordinance in 2002. The old zoning ordinance operated under what is called a pyramidal or tiered zoning system, land uses allowed within a certain district were also allowed in districts that were considered a more intensive use. For example,residential uses were allowed in commercial zones but not vice versa, commercial uses were allowed in industrial zones because the industrial zoning was considered a more intensive use. When the City adopted a new zoning ordinance this pyramidal system was changed to an express purpose- system,.which only allows certain land uses in certain districts and does not follow a tiered system. When this change ook place, many of the businesses and other activities in Jefferson City that had for many years existed as an allowed use der the pyramidal zoning structure became non-conforming uses. These uses have of course continued, as they are egally allowed to continue, as nonconforming uses. Nonconforming Uses: The Planning Division of the City of Jefferson has conducted a land use survey of the area in question. The results of this study indicate that only 3 of the 34 occupied parcels in this area have land uses that are listed as permitted uses under the M-2 General Industri al zoning classification. The other 91%of the occupied properties in this district are existing as nonconforming uses. The definition of Nonconforming Use is as follows: The use of land, buildings or structures, or a portion thereof, legally existing at the effective date of this ordinance which does not comply with the zoning district, and any amendments thereto, in which such use is located. Nonconforming uses are allowed to continue to exist. However, a nonconforming use that is damaged by more than 75 percent of its fair market value would not be permitted to be restored or repaired unless the restoration would bring the use into conformance. In other words,if a building in this area were to be destroyed by a fire or other natural disaster, it would not be allowed to be restored to its current use unless that use is listed as a permitted use in the M-2 General Industrial zoning classification. Land Use: The majority of the land use within this area is of a Commercial/Office nature with some industrial uses located in the southern portion of the area. Of the 49 individual land uses identified in the area, 24 are of a commercial nature, 18 are office uses,4 are Industrial uses, and 3 are vacant lots. There are also three buildings in the area that.are being used as Contractor Trade Shops (indoor storage)which are technically not permitted in the M-2 zoning district, although outdoor storage varieties of trade shops are permitted. Traffic: The 2005 traffic count on Industrial Drive is approximately 10,000 cars per day. The 2005 traffic count on Commerce Drive(Hwy. 179)is also approximately 10,000 cars per day. • Page 1 -.Consideration of Options: manning Division staff researched four,options regarding how to proceed with the non-conforming nature of this area. Option One: Leave the Area Zoned as M-2 General Industrial. Over 90%of the properties in the area would continue their existence as non-conforming uses under this option. The following uses in the area are permitted within the M-2 General Industrial zoning district: 1. Mini Warehouse 2. Distribution Facility 3. Wholesale Publishing 4. Storage-for institutional use Option Two: Rezone the entire area to C-1 Neighborhood Commercial. This option would address the majority of the nonconforming use situations in the-area. The following uses would continue to exist as non-conforming uses under the new zoning district: 1. Bar(allowed as a conditional use), 2. Vehicle Sales 3. Mini Warehouse 4. Distribution Facility 5. Wholesale Publishing 6. Storage-for institutional use(allowed as a conditional use) Option Three: Rezone the entire area to C-2 General Commercial. This option would positively address all of the nonconforming use situations in the area. Every use that is currently located in the area is a permitted use under the C-2 General Commercial zoning district with the exception of the Mini Warehouse operation and the Distribution Facility, hich would both be allowed with a conditional use se permit. Op tion Four: Consider a mix ed use rezoning. T his option could be applied in order to allow Commercial uses in the northern half of the area and manufacturing uses in the southern half of the area. Please see the attached map showing the boundaries regarding this option. Recommendation: The revised staff recommendation is Option Four—Rezone the northern half of the area to C-2 General Commercial and leave the southern half of the area zoned M-2 General Manufacturing. The C-2 General Commercial zoning district would be the most ideal fit for the northern portion of the area considering the current land use as well as the future potential of the area. Two major thoroughfares of the City of Jefferson intersect at this area and it is an ideal location for commercial activity. The only non-conforming use that would exist in the area after the rezoning would be a mini-storage operation,which is allowed with a conditional use permit. The M-2 General Manufacturing zoning district would be appropriate for the southern portion of the area. The area has been zoned for manufacturing use for some time and a variety of buildings of a manufacturing nature have been constructed in the area. The three contractor trade shops along Commerce Drive would technically continue to exist as non-conforming uses in the M-2 zoning district,but a modification to the zoning code in order to allow this use in the M-2 district could be pursued. Two office buildings in this area would also continue to exist as non-conforming uses in the M- 2 zoning district,but a modification to the zoning code allowing office uses in the M-2 zoning district could be pursued as well. .This option would be in close conformance with the Development Plan contained within the Comprehensive Plan and would address the majority of concerns expressed by landowners in the southern half of the area. Although the rezoning would be of a mixed use nature it would be very compatible with what has been developed in the area and with future potential land uses that have been conveyed to the City by landowners in the area.
