CITY OF MEDINA
RESOLUTION NO.2006-49
RESOLUTION GRANTING AN AMENDED CONDITIONAL USE PERMIT TO
JEFFREY AND KRISTIN EVANSON FOR AN ACCESSORY STRUCTURE
WHEREAS, by Resolution 87-59, adopted July 21, 1987, the city of Medina
granted a conditional use permit to Ricardo and Graciela Gonzalez to construct a 36' x
72' accessory structure located at property legally described in Exhibit A attached hereto;
and
WHEREAS, the city's zoning ordinance required a conditional use permit under
such circumstances; and
WHEREAS, Jeffrey and Kristin Evanson, (the "Applicants") have requested
approval of an amended conditional use permit to construct a 160' x 70' accessory
structure as required in the city's zoning ordinance; and
WHEREAS, the Planning Commission has reviewed the request at a duly called
public hearing on June 13, 2006, and the Planning Commission recommended approval
thereof, subject to certain terms and conditions, and
WHEREAS, the City Council, on July 18, 2006 reviewed the application for
conformance with city ordinances and considered the recommendations of the Planning
Commission and heard comments from the applicant and other interested parties,
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Medina, Minnesota that an amended conditional use permit be granted to Jeffrey and
Kristin Evanson. The conditions set forth in Conditional Use Permit 87-59 shall be
replaced by the following conditions:
1. The applicants shall maintain manure removal that meets the requirements of the
MPCA;
2. The applicants warrant that the accessory structure which they will be permitted
to construct is for their private use and that no commercial and/or fee -based horse
boarding, training or other activities shall occur;
3. The 1,200 SF structure in the NE area of the lot shall not be used for any animal -
related activities;
4. The applicants shall maintain adequate fencing around all pasture areas;

5. The applicants shall implement adequate landscaping around the riding arena for
screening purposes;
6. The applicant shall construct the structure no later than one year after final city
council approvals, and
7. The applicant shall pay to the City a fee all fees associated with the review of the
Conditional Use Permit application.
BE IT FURTHER RESOLVED that a default by the applicant of any of the terms and
conditions of this resolution will be grounds for revocation of the conditional use permit.

The motion for the adoption of the foregoing resolution was duly seconded by member
Weir upon vote being taken thereon, the following voted in favor thereof:
Weir, Workman, Cavanaugh, Smith
And the following voted against same: (Absent: Brinkman)
None
Whereupon said resolution was declared duly passed and adopted.
