HomeMy Public PortalAbout2006-053 Resolution Granting Final Plat Approval for JAN-HAR Ltd 922 Hwy 55Member Weir introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. 2006-53 RESOLUTION GRANTING FINAL PLAT APPROVAL FOR JAN-HAR LIMITED PARTNERSHIP FOR PROPERTY LOCATED AT 922 STATE HIGHWAY 55 WHEREAS, Jan-Har Limited Partnership (the "Applicant") has requested final approval to the city of Medina (the "City") of the Plat for "Jan Har Addition" to unify three properties into one, 1.72 acre property located at 922 State Highway 55, which is legally described on Exhibit A attached hereto: and NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF MEDINA, MINNESOTA, that it should and hereby does approve the final plat for Jan-Har Limited Partnership for "Jan Har Addition"; and FURTHER, that the following conditions be met prior to recording the final plat: 1. A final plat is approved in accordance with the plan received by the City on June 19, 2006 and revisions received on July 20, 2006, except as amended by this resolution. 2. The Applicant must submit a revised final plat for City Council review and approval if any modifications occur prior to the release of the final plat for filing. FURTHER, that the following conditions be met prior to issuance of building permits: 1. The plans shall meet the conditions noted within the memo from the City Engineer dated July 26, 2006 including the delivery of the letter of credit and also including the comments from Lance Hoff dated July 25, 2006. 2. The applicant must follow the maintenance program established for the sand filtration structure and is subject to any inspection performed by the City. 3. The plans shall meet the conditions noted with the memo from MnDOT dated July 20, 2006. 4. The plans shall comply with the Kennedy and Graven Plat Opinion letter dated July 11, 2006. 5. The landscape plan shall be revised to meet the City requirements of 38 units with the correct unit size. 6. The landscape plan shall be revised to clarify the existing and proposed trees. Resolution No. 2006-53 August 15, 2006 1 7. The applicants may construct the retaining wall within the 5-foot drainage and utility easement on the east side of the property at their own risk. 8. The dumpster enclosure shall consist of 4-sided decorative block architecture to match the principal building. 9. The Applicant shall comply with building permit requirements. 10. The Applicant shall pay to the City a fee in an amount sufficient to reimburse the City for the cost of reviewing the final plat and related documents. 11. The final plat must be filed with the County within180 days of the date of the City Council resolution granting final approval or the final plat shall be considered void, unless a written request for time extension is submitted by the applicant and approved by the City Council. Resolution No. 2006-53 August 15, 2006 2 Exhibit A That part of the Northeast Quarter of Section 11, Township 118 North, Range 23 West, Hennepin County, Minnesota described as follows: Beginning at the most southerly southeast corner of Lot 2, Block 1, TWIN CITY MONORAIL; thence on an assumed bearing of North 00 degrees 16 minutes 20 seconds East, along an east line of said Lot 2, a distance of 352.38 feet to an interior corner of said Lot 2; thence South 68 degrees 08 minutes 06 seconds East, along a southerly line of said Lot 2, a distance of 187.85 feet; thence South 00 degrees 16 minutes 20 seconds West a distance of 425.65 feet to the center line of Minnesota State Highway No. 55 as monumented; thence North 69 degrees 58 minutes 40 seconds West, along said centerline, a distance of 185.58 feet to the intersection with a line bearing South 00 degrees 16 minutes 20 seconds West from the point of beginning; thence North 00 degrees 16 minutes 20 seconds East a distance of 79.69 feet to the point of beginning.
