Member Weir introduced the following resolution and moved its adoption:
CITY OF MEDINA
RESOLUTION NO.2006-56
RESOLUTION GRANTING PRELIMINARY PLAT APPROVAL FOR
TIMOTHY DRUK AND MICHAEL LEUER FOR HIGH POINTE RIDGE
WHEREAS, Timothy Druk and Michael Leuer (the "Applicants") have requested
approval from the city of Medina (the "City") for a preliminary plat to be known as High
Pointe Ridge which is legally described in Exhibit A attached hereto; and
WHEREAS, the preliminary plat was reviewed by the planning commission at its
meeting on July 11, 2006 and, following a public hearing thereon as required by law, the
planning commission recommended approval thereof, subject to certain terms and
conditions; and
WHEREAS, the Medina city council considered the preliminary plat for its
conformance with City ordinances and considered the recommendations of the planning
commission at its meeting on August 15, 2006.
NOW, THEREFORE, BE IT RESOLVED, by the city council of the city of
Medina, Minnesota that preliminary plat approval be granted to the Applicants for High
Pointe Ridge, subject to the following terms and conditions:
1. The Ordinary High Water Level of School Lake shall be shown on the final plat.
2. The final plat shall require drainage and utility easements over all floodplains,
wetlands, waterways and ponding areas.
3. The final plat shall provide right-of-way to Hennepin County in the amount of 50
feet from the centerline of County Road 201.
4. The final plat shall show the primary and secondary location for the septic system
that is the furthest point away from the Ordinary High Water Level of School
Lake.
5. The maximum lot area covered by hard surfaces for each lot shall not exceed
25%.
6. There shall be no structures shown on any lot within the 150-foot setback from
the Ordinary High Water Level.

7. The park dedication fees for two lots shall be due at time of building permit
issuance.
8. The application for Final Plat shall be received by the City within 180 days of the
preliminary plat approval, or the preliminary plat shall be considered void, unless a
written extension request is approved by the city council.
9. The Applicant shall pay the City a fee sufficient to reimburse the City for the cost of
reviewing this application.

The motion for the adoption of the foregoing resolution was duly seconded by member
Smith upon vote being taken thereon, the following voted in favor thereof:
Weir, Workman, Cavanaugh, Smith
And the following voted against same: (Absent: Brinkman)
None
Whereupon said resolution was declared duly passed and adopted.
