CALL TO ORDER: Mayor Dennis called the regular meeting of the City Council to order at 7:30 p.m., Tuesday, October 15, 1985, in the Council Chambers. 2. The invocation was given by Reverend Barry Vail, Bethlehem Lutheran Church, 5319 North Halifax Road. 3. The Pledge of Allegiance to the Flag was led by Mayor Dennis. 4. ROLL CALL: Present: Councilmen - Atkins, Gillanders, Swain, Dennis Absent: Councilmen -None Also Present: City Manager Koski, City Attorney Martin, Planning Director Shaw, Parks and Recreation Director Kobett, Public Works Coordinator Peterson and Julie Estrada of the Temple City Times Mayor Dennis recognized and welcomed Webelo Pack #160 who were attending the Council meeting as part of their Citizenship patch. RECOGNITION AND COMMENTS — COUNCILMAN JACK TYRELL Councilman Tyrell passed away on October 7, 1985. Councilman Gillanders -- Councilman Tyrell fought for incorpor- ation of the City and served as Councilman for 25 years. His memorial is his deeds, Councilman Swain - The Council has lost a friend. Councilmembers and citizens alike are charged by Jack to keep this community the kind of community he wanted - - a place of law and order, a place of friendship, friendliness, a real "home" place and together we'll do the work that he would want us to do. Councilman Atkins - Councilmen Swain and Gillanders have des- cribed Councilman Tyrell's,attributes and all that could be added is that it feels lonely . at this end of the table. City Manager Koski - The community has lost an energetic and dedi- cated leader; the City Council has lost a supportive colleague; and the staff has lost, a strong supporter. Councilman Tyrell al- ways wanted the best for the community, the staff, and the people of the town. He's, going to be missed by all. The best way for us to remember Jack is to picture him active, robust and charging out to do his best for. the City. City Attorney Martin Jack was a personal friend for over 30 years and this City certainly stands as a memorial to him. He dedicated more than half of his adult life to the City - - week in and week out, month in and month out, and year in and year out. Jack was a many faceted man because he served with excellence in other fields as well. He was a prime member of"the Bar and recognized as such; and he was a fine member of organizations within the Bar. Jack served not only this City, but cityhood in general. He was first class. when .,r he went, and I shall miss him. 1.22 Council Minutes, October 15, 1985 - Page 2 Mayor Dennis - For over 25 years the direction of this City was influenced by Jack Tyrell. I was fortunate to have served with him for 13 of those years. He was extremely proud of this City and his family should be extremely proud of his accomplishments and his contributions to this City. I also had the opportunity of knowing Jack as a friend. Our families had become close friends, spending many hours together camping and off - roading back into the wilderness. My family grew to love Jack and his family, and we will miss him. 5. CONSENT CALENDAR: Councilman Atkins requested that item F. be removed from the Consent Calendar for clarification. On motion by Councilman Gillanders, seconded by Councilman Swain and unanimously carried, all other items on the Consent Calendar were approved. A. APPROVAL OF MINUTES - Regular Meeting of October 1, 1985 Approved as written. B. RECOMMENDATIONS FROM TRAFFIC COMMISSION MEETING OF OCTOBER 2, 1985 (1) ADDITIONAL RED CURB - ROSEMEAD BOULEVARD .& EMPEROR AVENUE Council approved. an additional 38' of red curb be placed on the east side of Rosemead Boulevard in order to allow adequate visibility. (2) ADDITIONAL REGULATIONS - WENDON AVENUE NEAR PRIMROSE AVENUE 1 Council approved Traffic Commission's recommendation for additional traffic control at . Wendon and Primrose Avenues with a stop sign at the west. approach to Primrose on Wendon. (3) ADDITIONAL REGULATIONS - PAL MAL AVENUE Council approved. Traffic Commission's recommendation that Sparklett,.Hallwood, Roseglen and Fairhall be stopped at the east and west approaches to Pal Mal and Arrowood be stopped at the east approach to Pal Mal, making Pal Mal a through street with existing 30 MPH speed limit posting. C FAU PROJECT FOR 1985 -86 RESURFACING OF LONGDEN AND GOLDEN WEST AVENUE ET AL Council, approved resurfacing of Longden Avenue from Rosemead to the Arcadia City limits., Golden West from Las Tunas to Lemon: using FAU funds in the amount of $175,000; resurfacing Myda Avenue, Sultana Avenue. and Hart Avenue from Las Tunas Drive to Hermosa Avenue using City funds in the amount of approximately $19,000; and authorized the Mayor to request the County Supervisors to permit the Los Angeles County Depart ment of Public Works to design and administer the project for the City. D. CLAIM FOR DAMAGES: KENNETH VERHARST Council denied claim and referred it to JPIA. E. RESOLUTION NO.85 -2389: EMPLOYMENT. OF PERSONNEL Council adopted Resolution No. 85 -2389 appointing budgeted personnel. 1 .2 1 Council Minutes, October 15, 1985 - Page 3 CONSENT CALENDAR ITEM F. - RESOLUTION NO. 85 -2390: WARRANTS AND DEMANDS Councilman Atkins requested clarification on the check to Valverde Construction Inc. for repair work at Builders Emporium for $3,237.40 and a check to Typemaster Information Systems for unbolting typewriters in the amount of $74.22. City Manager Koski explained that the check to Valverde Con- struction covered the replacement of a damaged fire hydrant in the rear of Builders Emporium; and the check to Typemasters covered the fee charged for unbolting the typewriters in order that the desks could be moved and painted. Councilman Atkins moved to adopt Resolution No. 85 -2390 approving warrants and demands, seconded by Councilman Gillanders and unani- mously carried. 6. UNFINISHED BUSINESS: A. ORDINANCE NO, 85 -5.73 (2nd reading) REQUEST FOR APPROVAL OF CHANGE OF ZONE FROM R -1 TO R-2 (4809 HALLOWELL AVENUE); APPLICANT: HASSAM MOHAMMED ELDEEB Councilman Gillanders moved -to waive further reading and adopt Ordinance No. 85 -573, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPROVING 'A CHANGE 'OF ZONE FROM R -1 TO R -2 (Z.C. 85 -769), ;seconded by Councilman Atkins and unani- mously carried. B. PROPOSED ORDINANCE AMENDMENT TO THE ZONING CODE ESTABLISHING A C -1 -0. LIMITED RETAIL. COMMERCIAL AND OFFICE ZONE City Manager Koski provided background information stating that in September the Planning Commission approved and recom- mended that City Council approve. an Amendment to the Temple City Zoning Code establishing a new C -1 -0 limited commercial and office zone. The proposed ordinance would create a zone which would allow those uses permitted in the C -1 Zone and also business and professional offices, insurance agents or brokers and investment securities and stock brokerage firms. A Nega- tive Declaration of Environmental Impact has been filed. This is an outgrowth of the C -1 Zone. Certain areas in the C -1 Zone, Commission felt, were suitable for some limited office use. Rather than rezone that to the C -2 general commercial zone, the Planning Commission has created this new inter- mediate classification. Mayor Dennis declared the public. hearing open and invited anyone wishing to speak to come forward. There being no one wishing to. address. Council, Councilman Gillanders moved to close the public, hearing, seconded by Councilman Atkins and unanimously carried. Councilman Gillanders moved to certify the Negative Declaration of Environmental Impact, seconded by Councilman Atkins and unanimously carried, City Attorney Martin introduced. Ordinance. No. B5 -574, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF. TEMPLE CITY ADDING NEW SECTIONS 9379, 9379.1, AND 9379.2 TO THE TEMPLE CITY ZONING CODE CREATING A NEW.C- 1- O,.ZONE LIMITED RETAIL COM- MERCIAL AND. OFFICE ZONE. -for first reading by title only. Councilman Atkins moved to waive further reading, seconded by Councilman Gillanders and. unanimouslycarried. 1 , 5 120 Council Minutes, October 15, 1985 - Page 4 Councilman Gillanders moved to refer the Ordinance to Lee Strong, developer who is studying the entire commercial area on Las Tunas, for his input by way of a written report prior to the second reading, seconded by Councilman Swain and unani- mously carried. 7. NEW BUSINESS: A. 1985 -86 ROBERTI - Z'BERG- HARRIS URBAN OPEN -SPACE AND RECREATION PROGRAM FOR IMPROVEMENTS AT TEMPLE CITY PARK Councilman Gillanders moved to authorize filing of an appli- cation for State Grant Funds in the amount of $14,880 to be used for improvements to Temple City Park and authorize the Mayor to sign, seconded by Councilman Atkins and unanimously carried. Councilman Gillanders moved to adopt Resolution No. 85 -2388, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPROVING 'THE APPLICATION FOR GRANT. FUNDS UNDER THE ROBERTI Z'BERG URBAN OPEN -SPACE AND RECREATION PROGRAM FOR IMPROVE- MENTS AT TEMPLE CITY PARK, seconded by Councilman Atkins and unanimously carried. 8. COMMUNICATIONS:. None 9. TIME FOR THOSE IN THE AUDIENCE WHO WISH. TO. SPEAK: None wished to address the Council. RECESS TO CRA: At this time Council recessed to meet. as the Temple City Community Redevelopment Agency; approved the Minutes of the regular meeting of October 1, 1.985; approved rental payment on the Parking Lot Agreement on behalf of the City; and adopted Resolution No. CRA 248: Warrants. and Demands. The Minutes are set forth in full in the records of the Agency. 10. ACTION ON REQUEST BY CRA: None 11. MATTERS FROM CITY OFFICIALS: A. REQUEST AUTHORIZATION TO ATTEND. CITY CLERK'S. ELECTION LAW SEMINAR - SAN DIEGO, NOVEMBER 20..- 22,. 1985 Councilman Gillanders moved to approve attendance of Chief Deputy City Clerk At City Clerk's.Election Law Seminar in San Diego November 20..- 22; 1985; authorize necessary ex- penses; and amend adopted budget. accordingly, seconded by Councilman Atkins and unanimously carried. B EMPLOYMENT. OF PART-TIME 'CASHIER FOR SALES OF RTD BUS PASSES Councilman Atkins moved to authorize employment of a part - time cashier for sales of RTD bus passes from the 25th through the 10th of each month from 8:00 a.m. to 5:00 p.m. at an hourly pay schedule of $5,00 - $5.50.. $6.00; and amend the FY 1985-86 adopted budget accordingly, seconded by Councilman, Swain and unanimously carried, �.q 119 Council Minutes, October 15, 1985 - Page 5 C. MORATORIUM ON NEW USES RELATED TO AND ON BUILDING AND OCCUPANCY PERMITS FOR APARTMENT COMPLEXES INVOLVING MORE THAN 3 UNITS Mayor Dennis stated that, during a recent public hearing con- cerning proposed condominium development, it was brought to the attention of the Council that the City had no requirement for Conditional Use Permit on apartments. Therefore, the City had no opportunity to review those units before being built. City Attorney Martin was, therefore, requested to prepare an urgency ordinance that would give the City a moratorium of 45 days on any new apartment construction pending Planning Commission studies. City Attorney Martin introduced Ordinance No. 85 -575, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ENACTING AN INTERIM ZONING ORDINANCE PURSUANT TO THE PROVI- SIONS OF SECTION 65858 OF THE CALIFORNIA GOVERNMENT CODE IMPOSING A MORATORIUM ON NEW USES RELATED TO, AND ON BUILDING AND OCCUPANCY PERMITS FOR, APARTMENT COMPLEXES INVOLVING MORE THAN 3 UNITS MAXIMUM DEVELOPMENT, PENDING PLANNING COM- MISSION STUDIES WITH RESPECT THERETO, for first reading by title only. Councilman. Atkins moved to waive further reading and adopt Ordinance No. 85 -575, seconded by Councilman Swain and carried on a roll call vote.: ROLL CALL: AYES: Councilmen - Atkins, Gillanders, Swain, Dennis NOES: Councilmen -None D. MARCH 1984 UPDATE OF LOS ANGELES COUNTY SOLID WASTE MANAGE- MENT PLAN City Council indicated their support of every effort to allevi- ate the waste disposal problem.. However, any definitive endorsement. or approval of present or pending plants for waste disposal facilities will require a thorough and compre- hensive review of the Environmental Impact Report and other technical data available, Staff will prepare a report for presentation to Council. at. an early date.. E. SOUTHERN CALIFORNIA JPIA - CITY OF WALNUT'S, APPLICATION FOR MEMBERSHIP Councilman Swain moved to.. vote in favor of the City of Walnut being accepted into membership in the Southern California Joint Powers Insurance Authority, seconded by Councilman Atkins and unanimously carried, F. APPOINTMENT TO FILL VACANCY - PATRICK FROEHLE Mayor Dennis stated that, according to City Charter, the Council has two options regarding the unexpired term of Councilman Tyrell - - one would. be to make an appointment within 30 days and the second would be to call a special election within six months, Council, in a Study Session held October 14, concurred on the appointment of Commissioner Patrick Froehle to fill the unexpired term of Jack Tyrell. It was the general feeling of the Councilmen. that the duties of five councilmen could not feasibly be divided among four. Councilman Gillanders moved to approve the appointment and seat - ing of Patrick Froehle to fill the unexpired term of office of Jack Tyrell to April' of 1988 and that he be appointed to fill the vacant committee assignments, which would include serving as dei.:gate with the Juvenile Diversion Program and Public �� 118 Council Minutes, October 15, 1985 - Page 6 Safety (Civil Defense, Law Enforcement and Emergency Reserve), and as alternate with the California Contract Cities and Southern California Joint Powers Insurance Authority, seconded by Councilman Swain and carried on a roll call vote. OATH OF OFFICE City Manager Koski administered the Oath of Office for Patrick Froehle, appointed to fill the unexpired term of office of Jack Tyrell to April of 1988. H. RESOLUTION NO. 85 -2391: ADOPTING A RULE OF PARLIAMENTARY PROCEDURE Councilman Atkins moved to adopt Resolution No. 85 -2391, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ADOPTING .A RULE OF PARLIAMENTARY PROCEDURE, seconded by Coun- cilman Gillanders and carried on a'roll call vote. ROLL CALL: AYES: Councilmen-Atkins, Froehle, Gillanders, Swain, Dennis NOES: Councilmen -None Councilman Froehle said that he had enjoyed working with the Planning Commissioners and is looking forward to serving on the City Council, working with the other Councilmen, the City Manager and City Attorney, City Hall staff and the residents of Temple City. 12. ITEMS SET FOR PUBLIC HEARING: A. STREET LIGHTING IMPROVEMENTS - FIESTA AVENUE, LOWER AZUSA ROAD TO LA ROSA DRIVE Public hearing is set for November 5, 1985. 13. ADJOURNMENT: On motion by Councilman Atkins, seconded by Councilman Gillanders, the meeting adjourned. at 8:25 p.m. in memory of Councilman Jack R. Tyrell, who served consecutively for 25 years as Councilman and Mayor of the City of Temple City.
