Services (MCES) Infiltration/Flow 2007 SurchargeMember Weir introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.2006-59 RESOLUTION CONTESTING METROPOLITAN COUNCIL ENVIRONMENTAL SERVICES (MCES) INFILTRATION/INFLOW 2007 SURCHARGE WHEREAS, The Metropolitan Council Environmental Services (MCES) has adopted an Infiltration/Inflow Surcharge Program, and, WHEREAS, the MCES has determined that the City of Medina has experienced at least one peak flow event between June 2004 and June 2006, on June 9, 2004, that exceeds the MCES peak flow goal for the City, and WHEREAS, the MCES has proposed that the City of Medina pay an annual surcharge of $30,310 for a period of five years ($151,550 total), or appeal the proposed surcharge in accordance with the provisions of the Surcharge Procedure Manual, and WHEREAS, the Surcharge Procedure Manual provides five (5) options for communities to contest the proposed 2007 surcharge amount, including credit for "peak flow mitigation expenses underway" since the peak flow event, and WHEREAS, the Cities of Medina, Independence and Greenfield are all tributary to the MCES flow meter that recorded the peak flow event, and WHEREAS, the Cities of Independence and Greenfield are considered by the MCES to be "customers" of the City of Medina, and part of the metered service area, and WHEREAS, the City Engineering firm Bonestroo, Rosene, Anderlik and Associates has prepared a letter report dated August 28, 2006 that documents expenses for I/I rehabilitation in excess of the proposed 2007 surcharge amount. NOW THEREFORE BE IT RESOLVED, THAT: 1. Based on the information provided in the August 28, 2006 Bonestroo, Rosene, Anderlik and Associates letter report, the City of Medina formally requests that the proposed MCES 2007 I/I surcharge be eliminated due to past expenditures that have exceeded the proposed surcharge amount. 2. In addition, the City of Medina requests consideration of reducing or eliminating future surcharges based on the previous expenditures. 3. The City of Medina will continue to evaluate the I/I situation as more information is developed in the next few years. Resolution No. 2006-59 1 September 5, 2006 4.
