AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, APPROVING A PRELIMINARY
AND FINAL PUD PLAN FOR PROPERTY ADDRESSED AS 318-320 WASHINGTON STREET
AND 208 WEST McCARTY STREET; CONSISTING OF PART OF INLOTS 458 AND 459,
JEFFERSON CITY, COLE COUNTY, MISSOURI.
WHEREAS, Washington Terrace Suites, LLC and Gemini Enterprises, LLC, owners of the real
estate hereinafter described, having submitted to the City Council a Preliminary and Final
PUD Plan of said real estate, being located in Jefferson City, Cole County, Missouri, and
more particularly described as follows:
208 W. McCarty Street: Part of Inlot 458 in the City of Jefferson, Missouri, beginning at the
southeasterly corner of said Inlot; thence westerly along McCarty Street, 52 feet, 2 1/a
inches; thence northerly parallel with Washington Street, 150 feet; thence easterly parallel
with McCarty Street 52 feet 2 1/a inches to the easterly line of said Inlot; thence southerly
along said easterly line 150 feet to the place of beginning, and;
320 Washington Street: The southerly part of Inlot 459 in the City of Jefferson, County of
Cole and State of Missouri, more particularly described as follows: BEGINNING at the
southeasterly corner of said Inlot 459; thence northerly along Washington Street, 100 feet;
thence westerly parallel with McCarty Street, 104 feet 4 1/2 inches to the westerly line of
said Inlot; thence southerly parallel with Washington Street, 100 feet to the southwesterly
corner of said Inlot; thence easterly along McCarty Street, 104 feet, 4 1/2 inches to the
PLACE OF BEGINNING, and;
• 318 Washington Street: Part of Inlot 459 in the City of Jefferson, Cole County, Missouri,
more particularly described as follows: BEGINNING at a point on the easterly line of Inlot
459, 100 feet northerly from the southeasterly corner of said Inlot; thence northerly along
the west line of Washington Street, 50 feet; thence 104 feet 4 1/2 inches, parallel with
McCarty Street, to the line between Inlots 459 and 458; thence southerly along said
dividing line parallel with Washington Street, 50 feet; thence easterly parallel with McCarty
Street 104 4 1/2 inches to the POINT OF BEGINNING.
Containing in all 0.54 acres.
WHEREAS, it appears that the procedures set forth in the zoning code relating to zoning have in
all matters been complied with, as said property owner submitted to the Planning and
Zoning Commission and City Council a Preliminary and Final PUD Plan for the above
referenced property.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
SECTION 1. The Preliminary and Final PUD Plan submitted by Central Missouri
Professional Services, Inc., on behalf of Washington Terrace Suites, LLC and Gemini Enterprises,
LLC, on file as Case No. P07005 in the Jefferson City Planning Division is hereby approved for the
above land referenced herein.
SECTION 2. Approval is made subject to the following conditions: (1) The underlying
zoning district shall be RA-2 Multi-Family Residential for the purpose of determining allowed uses;
• (2) Compliance with Engineering Division recommendations and corrections to the site plan.

SECTION 3. Common Areas and Public Land. No common areas are proposed and no
lands are dedicated to public use with this PUD Plan.
SECTION 4. Access: Vehicular access will be obtained from Washington Street.
SECTION 5. This ordinance shall be in full force and effect from and after the date of its
passage and approval.

(a) The project proposes to build a 15-space parking lot on property located at 208
West McCarty Street to also serve 318 &320 Washington Street. Driveway
access will be provided between 318 and 320 Washington Street. The existing
29-unit apartment building at 320 has very limited off street parking at present.
The present drive entrance is one way and is proposed to be widened to approxi-
mately 18'. The drive will still be one way at the point of entrance to the new
lot. FAR for the site is 28%. This is an infill development that is located in
the downtown area. There are existing sidewalks for pedestrian access.
(b) A preliminary and final site plan is included in the submittal.
(c) There is no plat or ownership association proposed.
(d) There are no restrictions proposed.
(e) A site specific traffic impact study is not required.
(f) There are no plans to add signage.
(g) Landscaping is shown on the plan.
(h) No additional lighting is planned.
(i) Filing fees in the amount of$320 have been submitted.

This letter is to notify you that the Jefferson City Planning and Zoning Commission will meet at 5:15
p.m. on Thursday, February 8, 2007 in the Council Chambers of the John G. Christy Municipal Building,
320 East McCarty Street, to consider the following matter (see map on back):
Case No. P07005 — 318 and 320 Washington Street and 208 West McCarty Street;
Preliminary and Final PUD Plan. Request filed by Washington Terrace Suites, LLC,
and Gemini Enterprises, LLC, Jon Hartenstein, Authorized Member, for approval of a
PUD Plan to build a 15 space parking lot. The 0.54 acres of PUD zoned property is
located on the northern corner of the intersection of West McCarty Street and
Washington Street and consists of part of inlots 458 and 459, Jefferson City, Cole
County, Missouri (Central Missouri Professional Services).

Plan. Request fled by Washington Terrace Suites, LLC, and Gemini Enterprises, LLC Jon Hartenstein,
Authorized Member, for approval of a PUD Plan to build a 15 space parking lot. The 0.54 acres of PUD
zoned property is located on the northern corner of the intersection of West McCarty Street and Washington
Street and consists of part of inlots 458 and 459, Jefferson City, Cole County, Missouri (Central Missouri
Professional Services).
Notification
By publication in the newspaper, by letter to adjacent and affected property owners within 185 feet, and by
posting a sign on the property.
Nature of Request
The applicant operates a 29 unit apartment building at this location(and 2 single familyhomes)and has only 6
parking stalls available for this use. The driveway access to this parking lot is 11 feet wide. The applicant
requests approval of a Preliminary and Final PUD Site Plan in order to widen the driveway to 20 feet and to
permit the construction of a 15 space parking lot.
Location
The subject property is located on the northern corner of the intersection of Washington Street and West
• McCarty Street in a PUD district. Adjacent zoning is PUD in all directions.
Access/Traffic
The property currently contains one parking lot with 6 parking stalls. Access to this parking lot is off of
Washington Street. One of the existing parking stalls would be removed in order to provide access to the new
parking lot. After construction, a total of 20 parking spaces would be available for the 29 unit apartment
complex.
Staff Analvsis
Permitted Uses. A PUD preliminary plan is used-to establish the underlying zoning, allowed uses, density,
layout, design and phasing of the development. The applicant intends to construct a parking lot to serve an
existing apartment building. Based on surrounding uses and the intended use of the structure, RA-2 Multi-
Family Residential would be the most appropriate underlying zoning for purposes of establishing allowed uses
on the property.
Parking. The parking requirement for multi-family residential land uses is two parking stalls per residential
unit. The parking requirement for the 29 unit apartment complex would therefore be 58 parking spaces.
Although the 20 spaces outlined in the PUD proposal does not meet the onsite parking requirement of this
property, the net increase in parking stalls is considered a benefit.
Landscaping. Parking lot landscaping would consist of 2 Swamp White Oak trees.
No new signage is proposed.
Lighting. No additional parking lot lighting is proposed.

• Stormwater. Runoff from the parking lot would drain from an outlet on the south side of the parking lot and
sheet drain to McCarty Street.
Utilities. An existing power pole is to be removed and the utilities will be placed underground.
Staff Recommendation
Staff recommends approval of the Preliminary and Final PUD Plan subject to the following conditions:
L The underlying zoning district shall be RA-2 Multi-Family Residential for the purpose of detennining
allowed uses.
2. Compliance with Engineering Division recommendations and corrections to the site plan.

COMMENTS-
Staff of the Engineering Division have completed a technical review of the site plan submitted by Central
Missouri Professional Services. The following comments are regarding this review;
Site Plan
Storm Water/Erosion Control
* Storm water has been planned to flow from the site to the south, similarly to how it currently
flows.
* The site will be required to have adequate erosion control measures, including silt fence and
phasing for construction. A Land Disturbance Permit is not necessary for this site.
Sidewalk
* Sidewalk exists along Washington Street and also East McCarty Street.
Sanitary Sewer
* Existing sanitary sewer service laterals serve all buildings on the subject property.
Traffic Impact
* The proposed development is within the downtown area.
* East McCarty Street is classified as a minor arterial roadway. Washington Street is classified as
a collector roadway. (Functional classification is from the List of Functional Roadway
Classification for Jefferson City, dated April 12, 2000 and the Countywide GBA Transportation
Study, 2003.)
* Washington Street is a two (2) lane roadway with parking allowed on either side of the street.
* The drive entrance to Washington Street is existing and will be widened to allow vehicles to pass
entering and exiting the parking lot.

• ENGINEERING STAFF RECOMMENDATION-
A recommendation of approval, subject to all Engineering Staff technical comments being addressed
on the final site plan.
