HomeMy Public PortalAbout18-9571 Retroactively Execute Interlocal Agreement Extension FL 31-X082-00 between The So Florida Regional Transportation Sponsored by: City Manager RESOLUTION NO. 18-9571 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA, AUTHORIZING THE CITY MANAGER TO RETROACTIVELY EXECUTE INTERLOCAL AGREEMENT EXTENSION FL-37-X082-00 BETWEEN THE SOUTH FLORIDA REGIONAL TRANSPORTATION AUTHORITY (SFRTA) AND THE CITY OF OPA-LOCKA FOR THE TRANSIT CIRCULATOR NORTH ROUTE FOR THE PERIOD OF FEBRUARY 3, 2015 THROUGH JANUARY 3, 2017; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, SFRTA, acting in its role as the Miami Urbanized Area Designated Recipient, applied to the Federal Transit Authority (FTA)under the FTA's Job Access and Reverse. Commute (JARC)Program pursuant to 49 U.S.C. Section 5316, which included the City of Opa-locka's ("CITY") project; and WHEREAS, the FTA's JARC Program is authorized under the provisions set forth in the Safe, Accountable, Flexible, and Efficient Transportation Equity Act: A Legacy for Users, (SAFETEA-LU), enacted on August 10, 2005, as codified at 49 U.S.C.5316; and WHEREAS, the FTA's JARC Program aims to improve access to transportation services to employment and employment related activities for welfare recipients and eligible low-income individuals and to transport residents of urbanized areas and nonurbanized areas to suburban employment opportunities; and WHEREAS, SFRTA received JARC grant funds from the FTA pursuant to grant number FL-37-X082-00; and WHEREAS, the City Commission of the City of Opa-locka finds that it is in the best interest of the City of Opa-locka to extend the interlocal agreement with SFRTA substantially in the form attached. NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA: Section 1. RECITALS ADOPTED. The recitals to the preamble herein are incorporated by reference. Section 2. AUTHORIZATION The City Commission of the City of Opa-locka hereby authorizes the City Manager to retroactively execute the interlocal agreement extension with SFRTA. SECTION 3. SCRIVENER'S ERRORS. Sections of this Resolution may be renumbered or re-lettered and corrections of typographical errors which do not affect the intent may be authorized by the City Manager, or the City Manager's designee, without need of public hearing, by filing a corrected copy of same with the City Clerk. Section 4. EFFECTIVE DATE. This Resolution shall take effect immediately upon adoption and is subject to the approval of the Governor or his designee. Staff Summary: The City of Opa-locka entered into an interlocal agreement with the South Florida Regional Transportation Authority (SFRTA) to continue operating the transit circulator for the North Route through grant funding from Job Access Reverse Commute (JARC) and SFRTA. The attached is an extension for the period of February 3, 2015 through January 3, 2017, for which the City will receive 50% cost reimbursement of the North Route transit circulator expenditures up to $139,005.00 from SFRTA and the other 50% of the circulator cost will be paid with Miami Dade County Surtax Fund through the Citizens Independent Transportation Trust program (CITT). We were able to confirm and reconcile the numbers and we have $50,693.48 unbudgeted reimbursement pending on the approval of the agreement. Delaying this process will affect the SEFA and the CITT audit. Proposed Action: Staff recommends the City Manager to retroactively approve and execute this extension in order to submit reimbursements for expenditures incurred by the City during the grant period that have not been previously submitted. THE City WORKSCOPE: APPROVED BUDGET AND MATERIAL REPRESENTATIONS 1.01 ',Vorkscope. the City agrees to perform and complete in a satisfactory and proper manner the Workscope specified 'r± Exhibit A (FTA Grant Application) in accordance with the terms and conditions of this Agreement. The Workscope details the activities to be completed by the City and a proposed schedule for the completion of the Workscope. All Workscope activities must be consistent with the approved Workscope and the approved budget detailed below. Re-budge`Mg of proje.a funds among the existing approved budget items of the Workscope are allowable without prior approval if the amount of project funds to be transferred is less than twenty percent (20%) of the approved budget. However, re-budgeting between operating and capital line iters is not allowable due to differing match requirements. 1.03 Material I'LapresentatLus. The City agrees that ail representations contained in its ay:ideation for grant assistance are material representations of fact upon which SFRTA relied in awarding this grant and are incorporated by reference into this Agreement. ARTICLE M. GRANT AMOUNT,MATCH AND PAYMENT 3.01 EFiiinated Pr-ject Amount. SFRTA awards to the recipient a grant of up to $139,005 for the Workscope. In no event will SFRTA obligation under this Agreement exceed the lesser of t' following: A. The nilaximum Federal Grant Amount; or B. The combination of 50% of the total net operating Workscope expenditures plus 80%of capital Workscope expL-Aiditures. SFRTA shall bear no responsibility for cost overruns that r 3/ be incurred by the City in performer ee of the Workscope. ARTICLE IX. GENERAL CONDITIONS 9.01 Amendments. The terms of this Agreement may be changed only by mutual agreement c the parties. The City assumes liability for and agrees to defend, indemnify and hold harmless SFRTA, its officers, employees and agents from and against all losses, damages, expense, liability, claims, suits, or demands including, withouu limitation, attorney's fees, arising out of,resulting from, or relating to the poi formance of the Grant Project by the City or City employees,agent or subcont.<;etors. Nothing herein is intended to serve as a waiver of sovereign immunity by any party nor shall anything inch,led herein be construed as consent to be sued by third parties in any ma- arising out this Agreement or any other contact. The City is a state agency or political subdivision as defined in Chapter (-,8.28, Florida Statutes, and agrees to be fully responsible for the acts and omissions of its agents or employees to the extent permitted by law. 9.04 Workscope Data. The City agrees that the results of the Workscope, the reports submitt-d, and any new information or technology that is dev,,loped with the assistance of this grant is in the public domain and may not be copyrighted or patented by the City. The City shall allow public access to all documents, records, repo its or other material subject to the applicable provisions for Chapter 119 Florida Statutes, and made or received by the City in connection 8 with this Agreement.
