HomeMy Public PortalAbout2006-067 Resolution Authorizing Publication of Ord 414Member Weir introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.2006-67 RESOLUTION AUTHORIZING PUBLICATION OF ORDINANCE NO. 414 BY TITLE AND SUMMARY WHEREAS, the city council of the city of Medina has adopted Ordinance No. 414, an ordinance amending Section 820.31, of the Medina code of ordinances regarding park dedication and open space; and WHEREAS, Minnesota Statutes, section 412.191, subd. 4, allows publication by title and summary in the case of lengthy ordinances or those containing charts or maps; and WHEREAS, Ordinance No. 414 is two pages in length; and WHEREAS, the city council believes that the following summary would clearly inform the public of the intent and effect of the ordinance. NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina that the city administrator -clerk shall cause the following summary of Ordinance No. 414 to be published in the official newspaper in lieu of the entire ordinance: Public Notice The city council of the city of Medina has adopted Ordinance No. 414. The ordinance amends the code section regarding park dedication requirements upon subdivision of land. The ordinance provides that park dedication requirements are based on the buildable, not gross, land in the subdivision; that the city must give "due consideration" to the private open space or recreational facilities provided in a subdivision when deciding the park dedication requirement; and that the city must restrict the use of park dedication funds to the acquisition and development or improvement or redevelopment of parks, recreational facilities, playgrounds, trails, wetlands, or open space. No park dedication fees may be used for ongoing operation or maintenance of these facilities. Park dedication or cash in lieu may only be collected for the net increase in the number of lots in the case of resubdivision of property for which a park dedication was previously made.
