HomeMy Public PortalAbout2023-29 Resolution Granting Pioneer Highlands Final PlatResolution No. 2023-29 March 7, 2023 Member DesLauriers introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION 2023-29 RESOLUTION GRANTING FINAL APPROVAL FOR THE PIONEER HIGHLANDS PLAT WHEREAS, the city of Medina (the “City”) is a municipal corporation, organized and existing under the laws of Minnesota; and WHEREAS, Onyx Performance Investment, LLC (the “Applicant”) is the fee owner of the property located southeast of Willow Drive and southwest of Pioneer Trail (the “Property”) which is legally described in Exhibit A, attached hereto; and WHEREAS, on October 18, 2022, the City Council adopted resolution 2022-84, granting preliminary approval of a four-lot plat known as Pioneer Highlands; and WHEREAS, the Applicant has requested final approval of the Pioneer Highlands plat; and WHEREAS, the city Council reviewed the proposed plat and heard relevant testimony on March 7, 2023; and WHEREAS, subject to the fulfillment of the conditions noted below, the City Council makes the following findings of fact in regard to the final plat based on the requirements of the City’s subdivision ordinance: a. The proposed plat is consistent with the approved preliminary plat. b. The conditions on which preliminary plat was approved have been completed or have been incorporated into this resolution and the corresponding development agreement. c. The plat meets the criteria described in Subd. 10 of Section 820.21 for approval. NOW, THEREFORE BE IT RESOLVED, that the City Council of Medina, Minnesota hereby grants final approval for Pioneer Highlands, as depicted on the plat received by the City on February 24, 2023, subject to the following terms and conditions: 1. The Applicant shall update the plat to provide drainage and utility easements over Outlot A. 2. The Applicant shall execute and record easement agreement in a form and of substance acceptable to the City Attorney for the shared driveway for all lots, at time of recording the plat. 3. Upon construction of the driveway for Lot 3, the owner of Lot 3 shall install culvert(s) in such location(s) and specifications determined necessary by the City Engineer to accommodate drainage across Lot 3. The Owner shall also grant to the City drainage easements for such drainage crossings prior to issuance of a building permit. Resolution No. 2023-29 March 7, 2023 4. The stormwater improvements to be constructed have been designed to accommodate a projected amount of impervious surfaces on each lot. If an owner proposes to construct improvements which exceed the projected amount of impervious surfaces, the owner may be required to construct additional stormwater improvements to comply with relevant regulations. 5. The Applicant shall pay cash-in-lieu of park land in an amount of $32,000.00. 6. The Applicant shall enter into a development agreement with the City, which shall include the conditions described below as well as other requirements of city ordinance or policy. 7. The Applicant shall install all improvements shown on the plans dated February 24, 2023, except as may be modified herein. 8. The Applicant shall execute and record a Stormwater Maintenance Agreement in a form and of substance acceptable to the City Attorney to describe the responsibility of the property owners to maintain the private stormwater improvements. 9. The Applicant shall meet the requirements of the wetland protection ordinance including but not limited to: execution and recordation of Upland Buffer Easement Agreement in a form and of substance acceptable to the City Attorney, planting of appropriate vegetation, and installation of signage. 10. The Applicant shall obtain all permits required by Pioneer-Sarah Watershed District. 11. The Applicant shall address the comments in the City Attorney’s plat opinion and abide by the City Attorney’s recommendations related to recording procedures. 12. The Applicant shall pay to the City a fee in an amount sufficient to reimburse the City for the cost of reviewing the preliminary plat, construction plans, and other relevant documents. 13. The plat shall be recorded in the office of the Hennepin County Recorder within 180 days of the date of the resolution or the approval shall be considered void, unless a written request for time extension is submitted by the applicant and approved by the City Council.
