RESOLUTION NO. 18-9576
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF OPA-LOCKA, FLORIDA, ADOPTING RESOLUTION(S)
PURSUANT TO SECTION 4.5(B) OF THE CITY OF OPA-
LOCKA CODE OF ORDINANCES, DIRECTING THAT THE
AMOUNTS APPROPRIATED FOR CURRENT OPERATIONS
FOR THE CURRENT FISCAL YEAR (FY 2017-2018) BE
DEEMED ADOPTED FOR THE ENSUING FISCAL YEAR (FY
2018-2019) FOR A PERIOD OF FIFTEEN (15) DAYS AND
RENEWED BY RESOLUTION EACH FIFTEEN (15) DAYS,
WITH ALL ITEMS PRORATED ACCORDINGLY, UNTIL
SUCH TIME AS THE STATE OF FLORIDA FINANCIAL
EMERGENCY BOARD FOR THE CITY OF OPA-LOCKA
REVIEWS AND APPROVES ANNUAL BUDGETS FOR THE
ENSUING FISCAL YEAR (FY 2018-2019); PROVIDING FOR
INCORPORATION OF RECITALS; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City Commission held its second reading and public hearing for the
proposed Millage Rate and the adoption of the Budgets for Fiscal Year 2018-2019, on
September 26, 2018; and
WHEREAS, the City Commission adopted a budget for fiscal year 2018-2019 on
September 26, 2018; and
WHEREAS, the City Commission adopted resolution 18-9575, pursuant Section
4.5(B), extending the FY2017-2018 budget to November 29, 2018, to allow the State of
Florida Financial Emergency Board time to review and approve the City's FY 2018-2019
budgets; and
WHEREAS, the State of Florida Financial Emergency Board for the City of Opa-
locka requires 20 days after the adoption of the Fiscal Year 2018-2019 Budgets to review and
approve the Budgets proposed by the City of Opa-locka.
NOW THEREFORE BE IT RESOLVED THAT THE CITY
COMMISSION OF THE CITY OF OPA LOCKA, FLORIDA:
Section 1. RECITALS ADOPTED.
The recitals to the preamble herein are incorporated by reference.
Section 2. AUTHORIZATION
The City Commission of the City of Opa-locka hereby adopts a resolution pursuant to
Article IV Section 4.5 of the City Charter, directing that the amounts appropriated for

current operations for the current fiscal year (FY 2017-2018) shall be deemed adopted
for the ensuing fiscal year (FY 2018-2019) for a period of fifteen (15) days and
renewed by resolution each fifteen (15) days, with all items in it prorated accordingly,
until such time as the Commission adopts an annual budget for the ensuing fiscal
year.
SECTION 3. SCRIVENER'S ERRORS.
Sections of this Resolution may be renumbered or re-lettered and corrections of
typographical errors which do not affect the intent may be authorized by the City
Manager, or the City Manager's designee, without need of public hearing, by filing a
corrected copy of same with the City Clerk.
Section 4. EFFECTIVE DATE.
This Resolution shall take effect immediately upon adoption and is subject to the
approval of the Governor or his designee.

Section 4.5. -Annual Budget Adoption.
(A) Balanced Budget. Each annual budget adopted by the Commission shall be a
balanced budget and adopted in accordance with Florida law.
(B) BudgetAdoption. The Commission shall by ordinance adopt the annual budget on
or before the thirtieth (30th)day of September of each year. If it fails to adopt the
annual budget by this date,the Commission may by resolution direct that the
amounts appropriated for current operations for the current fiscal year shall be
deemed adopted for the ensuing fiscal year for a period of fifteen (15)days and
renewed by resolution each fifteen (15) days,with all items in it prorated
accordingly, until such time as the Commission adopts an annual budget for the
ensuing fiscal year.An ordinance adopting an annual budget shall constitute
appropriation of the amounts specified therein.
(C) Specific Appropriation.The budget shall be specific as to the nature of each
category of appropriations therein. Reasonable appropriations may be made for
contingencies, but only within defined spending categories.
