PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR MILLER President Oler called the meeting to order and the following business was conducted: ROLL CALL Present were: Doug Goss, Kelley Cruse - Nicholson, Bruce Wissel, Clayton Miller, Larry Parker, Misty Hollis, Ron Oler and Phil Quinn. Absent was Don Winget. Also in attendance were Wait Chidester, City Attorney; Sally Hutton, Mayor; Karen Chasteen, City Clerk; Kim Vessels, Assistant City Attorney; Lisa Lee, Ice Miller; Buzz Krohn, O.W. Krohn & Associates; Police Chief Kris and Linda Wolski; Elijah Welch, Sanitary District Engineer; Fire Chief Jerry Purcell; Mike Reece, AFSCME; Nick Wilson; Dakota Collins; Stephanie Alexander; Scott Alexander; Tony Foster, Department of Metropolitan Development; Bill Thistlethwaite, Parks and Recreation; Dave Bums; Alisha Estabrook, Park Department; Larry Habschmidt; Sue Roberson, Human Resources; Ron Deane; Sergeant at Arms; and, Media. APPROVAL OF MINUTES Councilor Hollis moved to approve the minutes of the meeting held March 2, 2015, supported by Councilor Parker. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS A. RESOLUTION NO. 1-2015 — SLUM AND BLIGHT AREA DECLARATORY RESOLUTION This Resolution is a requirement of the Indiana Office of Community and Rural Affairs Community Development Block Grant portion of our Stellar Communities projects — specifically the Downtown Facades project. Resolution No. 1 -2015 was held until the April 6, 2015 meeting. B. RESOLUTION NO. 2 -2015 — A RESOLUTION OF THE CITY OF RICHMOND COMMON COUNCIL RE: ISSUANCE OF SANITARY DISTRICT BONDS AND PLEDGE OF STORM WATER REVENUES BY THE STORM WATER MANAGEMENT BOARD Councilor Miller moved to approve, supported by Councilor Parker. Upon a vote viva voce, the motion carried. COMMUNICATIONS FROM THE MAYOR • A Human Rights Conference celebrating Diversity is scheduled for Richmond in June, 2015 and it is the hoped a volunteer Commission will be re- established. The following Proclamation was read into the record: Common Council Minutes March 16, 2015 Page 2 of 5 WHEREAS, the City of Richmond, Indiana recognizes our citizens as our most valuable asset, that is enhanced by the sum of individual differences, life experiences, knowledge, inventiveness, innovation, self - expression, unique capabilities and the talent our citizens invest in Richmond, Indiana represents a significant part of not only our culture, but our achievements and reputations, and WHEREAS, the City of Richmond embraces and accepts our citizens' differences in age, color, disability, ethnicity, family and marital status, gender • Phil Lottich will be 90 years old — please send birthday wishes to him. • Congratulations to the Richmond High School basketball team for their win at Regionals. • The 2015 Spring Clean Up will begin April 18, 2015. REPORT OF THE BOARD OF PUBLIC WORKS AND SAFETY Minutes of the February 26, 2015 meeting of the Board of Public Works and Safety were accepted as presented. REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and /or ORGANIZATIONS • Mr. Foster reported on the activities of the Department of Metropolitan Development in 2014. MISCELLANEOUS BUSINESS The American Federation of State, County and Municipal Employees fact finding will be proceeding. The deadline for commencing has been waived. Councilor Cruse - Nicholson encouraged residents to "Paint the Town Red" to support the Richmond Red Devils in the Semi -State Basketball Championship Games. ORDINANCES ON FIRST READING Councilor Parker moved to suspend the rules and read Ordinance Nos. 12, 13, 14, 15, 16, 17 & 18 -2015 on first reading by title only, supported by Councilor Hollis. Upon a vote viva voce, the motion carried. ORDINANCE NO. 12 -2015 — AN APPROPRIATION (TRANSFER) ORDINANCE AMENDING THE 2015 BUDGET (Park) The Clerk read Ordinance No. 12 -2015 on first reading by title only. This Ordinance is a request to transfer Twenty Thousand Dollars and zero cents ($20,000.00) from the Parks and Recreation Salary to Other Contractual Services. A position has been vacated and the funds would be transferred for contract mowers can be hired. Councilor Miller moved to advance Ordinance No. 12 -2015 to second reading, suspend the rules and read by title only, supported by Councilor Cruse- Nicholson. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 12 -2015 on second reading by title only. Council President Oler declared Ordinance No. 12 -2015 on second reading and public hearing. Speaking to the Ordinance was Mr. Wilson. There being no comments against the Ordinance, Councilor Cruse - Nicholson moved for engrossment of Ordinance No. 12 -2015, supported by Councilor Quinn. Upon a vote viva voce, the motion passed. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 12 -2015 on third reading by title only. Ordinance No. 12 -2015 was adopted with an 8-0 roll call vote. ORDINANCE NO. 13 -2015 — A GENERAL ORDINANCE AMENDING SECTION 94.03 OF THE RICHMOND CODE COMMONLY KNOWN AS THE WEED ORDINANCE (Metro) The Clerk read Ordinance No. 13 -2015 on first reading by title only. This Ordinance would amend the portions of the City Code 94.03, commonly known as the Rank Weed and Vegetation issues that will assist with mail costs that the Department of Metropolitan Development incurs. This Ordinance would also include language that would allow the City to require improved sidewalks to be kept free of weeds and require minimum height clearance to be maintained. The Street Tree Ordinance will be reviewed before the next meeting. Councilor Parker moved to advance Ordinance No. 13 -2015 to second reading, suspend the rules and read by title only, supported by Councilor Quinn. Upon a vote viva voce, the motion failed with a 7 -1 vote. Dissenting was Councilor Hollis. Ordinance No. 13 -2015 will be heard on second reading on April 6, 2015. ORDINANCE NO. 14 -2015 — A SPECIAL ORDINANCE AUTHORIZING THE CITY OF RICHMOND TO RECEIVE A DONATION FROM WELLS FARGO BANK, N.A. TO PASS THROUGH TO RICHMOND NEIGBORHOOD RESTORATION, INC., A NON - PROFIT DOMESTIC CORPORATION The Clerk read Ordinance No. 14 -2015 on first reading by title only. This Ordinance would authorize the City of Richmond, Indiana, to receive a cash contribution in the amount of $3,000.00 at the closing to transfer real property located at 36 South 19th Street in Richmond, Indiana, from Wells Fargo Bank, N.A. Both the real property and cash contribution would be passed through to Richmond Neighborhood Restoration Inc. upon closing of said real property. Councilor Miller moved to advance Ordinance No. 14 -2015 to second reading, suspend the rules and read by title only, supported by Councilor Cruse - Nicholson. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 14 -2015 on second reading by title only. Council President Oler declared Ordinance No. 14 -2015 on second reading and public hearing. Speaking in favor was Mr. Bums. There being no comments against the Ordinance, Councilor Quinn moved for engrossment of Ordinance No. 14 -2015, supported by Councilor Hollis. Upon a vote viva voce, the motion passed. Councilor Wissel moved to advance Ordinance No. 14 -2015 to third and final reading and suspend the rules and read by title only, supported by Councilor Miller. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 14 -2015 on third reading by title only. Ordinance No. 14 -2015 was adopted with an 8 -0 roll call vote. ORDINANCE NO. 15 -2015 — AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE ANED APPROPRIATION OF A GRANT FROM EMPLOYMENT AID READINESS NETWORK INDIANA (Park) A recording of this meeting is on file in the Office of the City Clerk. S:common council/minutes/2015 /mar 16.docx Common Council Minutes March 16, 2015 Page 4 of 5 The Clerk read Ordinance No. 15 -2015 on first reading by title only This Ordinance would authorize the City of Richmond Parks Department to submit a grant application to the Employment Aid Readiness Network and to accept said grant funding in an amount up to Sixteen Thousand Dollars and Zero Cents ($16,000.00). If awarded, these funds would shall be appropriated to fund or reimburse the hiring of up to five (5) temporary interns to assist with office work and help with summer camps for the Parks Department. There is a 50% local match required. Councilor Miller moved to advance Ordinance No. 15 -2015 to second reading, suspend the rules and read by title only, supported by Councilor Hollis. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 15 -2015 on second reading by title only. Council President Oler declared Ordinance No. 15 -2015 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Cruse - Nicholson moved for engrossment of Ordinance No. 15 -2015, supported by Councilor Hollis. Councilor Parker moved to advance Ordinance No. 15 -2015 to third and final reading and suspend the rules and read by title only, supported by Councilor Cruse - Nicholson. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 15 -2015 on thins reading by title only. Ordinance No. 15 -2015 was adopted with an 8-0 roll call vote. ORDINANCE NO. 16 -2015 — AN APPROPRIATION ORDINANCE AMENDING ORDINANCE NO. 40- 2014 KNOWN AS THE 2015 SALARY ORDINANCE (Metro and Street) The Clerk read Ordinance No. 16 -2015 on first reading by title only. This Ordinance would amend the 2015 Salary Ordinance to reflect a change in title and salary in the Department of Metropolitan Development Director to Executive Director, Metropolitan and Economic Development and increase the salary to Sixty Nine Thousand Seven Hundred Sixty Three Dollars and fifty nine cents ($69,763.59); and, eliminate the position of General Laborer in the Street Department and increase the Laborers from two (2) to three (3). Councilor Parker moved to advance Ordinance No. 16 -2015 to second reading, suspend the rules and read by title only, supported by Councilor Quinn. Upon a vote viva voce, the motion failed. Dissenting were Councilors Oler and Hollis. Ordinance No. 16 -2015 was held was held to be heard on second reading to allow time for discussion by the Finance Committee. ORDINANCE NO. 17 -2015 — AN APPROPRIATION ORDINANCE AUTHORIZING AN ADDITIONAL APPROPRIATION (Clerk) The Clerk read Ordinance No. 17 -2015 on first reading by title only. This Ordinance would authorize an additional appropriation of One Thousand One Hundred Forty Dollars and zero cents ($1,140.00) from the General Fund into Litigation for the Clerk's Office. Ordinance No. 17 -2015 was held to be heard on second reading to allow time for discussion by the Finance Committee. A recording of this meeting is on file in the Office of the City Clerk. S:common council/minutes/2015 /mar 16.docx 1� Common Council Minutes Match 16, 2015 Page 5 of 5 ORDINANCE NO. 18 -2015 — ORDINANCE ADOPTING A CHANGE TO THE NON - RECURRING CHARGES FOR SERVICES RENDERED BY THE CITY OF RICHMOND'S MUNICIPAL ELECTRIC UTILITY, RICHMOND POWER & LIGHT The Clerk read Ordinance No. 18 -2015 on first reading by title only. The Board and Management of the Richmond Power and Light believe that adding a $15.00 trip charge to the list of non - recurring charges is in the best interests of the Utility as well as its customers. This Ordinance would authorize the necessary and appropriate officials of the Utility to file with the Commission, a request for approval of the $15.00 trip charge. Councilor Parker moved to advance Ordinance No. 18 -2015 to second reading, suspend the rules and read by title only, supported by Councilor Hollis. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 18 -2015 on second reading by title only. Council President Oler declared Ordinance No. 18 -2015 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Parker moved for engrossment of Ordinance No. 18 -2015, supported by Councilor Miller. Upon a vote viva voce, the motion passed. Councilor Wissel moved to advance Ordinance No. 18 -2015 to third and final reading and suspend the rules and read by title only, supported by Councilor Cruse - Nicholson. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 18 -2015 on third reading by title only. Ordinance No. 18 -2015 was adopted with an 8 -0 roll call vote.
