HomeMy Public PortalAbout1988-03-08 Regular Meeting121 COUNCIL MINUTES MARCH 8, 1988 - WORKSHOP MEETING The regular monthly meeting of the Bal Harbour Village Council was held on Tuesday, March 8, 1988 in the Village Hall Council Chamber. The meeting was called to order at 9:07 a.m. by Asst. Mayor Estelle Stern and the roll was called. Those present were: Asst. Mayor Estelle Stern Councilman Matthew B. Blank Councilman Sol M. Taplin Absent: Mayor Richard H. Olsen Councilman James E. Boggess Also present: Louise K. Miller, Village Manager Richard J. Weiss, Village Attorney Carole S. Morris, Village Clerk As a quorum was found to be present the meeting was commenced. II. Discussion: Mrs. Stern explained that this is a workshop meeting, for the purpose of continued discussion of the proposed ocean front zoning ordinance. The Village Clerk read the proposed ordinance by title: ORDINANCE OF BAL HARBOUR VILLAGE AMENDING APPENDIX A, SECTIONS 6-9(G), 6-9(K) AND 6-9(M) OF THE BAL HARBOUR VILLAGE CODE BY: DECREASING THE PERMITTED BUILDING COVERAGE AND INCREASING THE MINIMUM FRONT AND SIDE SETBACKS FOR BUILDINGS EXCEEDING SEVENTEEN (17) STORIES IN THE OCEAN FRONT DISTRICT; PROHIBITING CABANAS IN THE SIDE SETBACK AREAS; INCREASING THE PERMITTED BUILDING HEIGHT IN THE OCEAN FRONT DISTRICT FROM SEVENTEEN (17) TO TWENTY-TWO (22) STORIES; PROVIDING FOR SEVERABILITY; INCLUSION IN THE CODE AND AN EFFECTIVE DATE. Mrs. Stern then opened the floor for discussion. Mr. Shepard Broad, attorney representing the Regency Spa,was recognized. Mr. Broad called on the Council to delay any zoning changes until after the completion of construction of Bal Harbour Tower. At that time, the situation facing the Regency property, with the 101 on one side and the Tower on the other, will be clearer. Mr. Broad stated that while there are several buildings which may eventually be demolished and replaced, he is aware of no active plans at this time. In response to inquiries from Mr. Taplin, Mr. Broad indicated that while he is not satisfied with the Council Minutes - 3/8/88 1 122 current zoning restrictions, which would require a 55' side setback on a 200' lot, he would prefer that to the proposed ordinance. Mr. Taplin stated that he believes a 55% setback to be too great. Further, he expressed opposition to leaving the Code as is, noting that it would only continue to encourage construction of the long block type building. Mr. John Lang Looby, 220 Bal Bay Drive, agreed with Mr. Taplin that the proposed side setbacks would be too stringent. He urged the Council to be "reasonable and consistent" in their guidelines and suggested a figure of 40%. Building Official George Desharnais explained that the proposed ordinance would offer a developer more options in development of the property. He, too, expressed concern regarding the side setback requirements, noting that in the case of a 200' lot the building could not exceed 90' in width. Mr. Weiss, noting that the attorneys who had contacted him regarding the proposed ordinance were not present, presented their concerns to the Council. These attorneys suggested that a minimum side setback should be established, and that as long as this requirement is met - there should be no requirement that the building be centered on the property. The need to clarify the portion of the proposed ordinance relating to the prohibition of cabanas in the side setbacks was also discussed. Mrs. Miller reported that in accordance with Mr. Taplin's request, she had contacted Mr. Drummond, of Harland Bartholomew and Associates, to ascertain his views relative to the side setbacks. Mr. Drummond stood by his prior recommendation of a 55% side setbacks and rejected the idea of a trip to the Village to attend a workshop meeting as superfluous. III. Other Business: Mrs. Stern announced that hearing on this ordinance will be held on Monday, March 5:15 p.m. in the Council chambers. IV. Adjourn: There being no further business before the council a motion was offered by Mr. Taplin to the meeting. The motion was seconded by Mr. Boggess and unanimously.
