Iq 1 V( 5 AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, IMPLEMENTING A CRIMINAL BACKGROUND CHECK FOR ALL CITY OF JEFFERSON CITY EMPLOYEES; AND FIXING AN EFFECTIVE DATE. BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The City Council of the City of Jefferson City believes it is in the best interest of the City to implement a mandatory criminal background check for all City of Jefferson City employees. Section 2. The ordinance is enacted pursuant to RSMo 43.535 to regulate the employment of those engaged in the function of a municipality. This Ordinance is only applicable to persons offered employment by the City of Jefferson City and does not apply to those merely interviewing for employment. Further, a person's status as a City employee is conditional until the results from the background check are reviewed and approved by the City Administrator or his designee. • Section 3. For a name search, the Director of Human Resources or his/her designee will submit the necessary information to the appropriate state agency or bureau. The appropriate state agency or bureau will compare the information against its criminal file. Upon completion, the appropriate state agency or bureau will disseminate the results to the Director of Human Resources. Section 4. An applicant, employee, or volunteer seeking employment with the City of Jefferson City shall submit a set of his/her fingerprints. Upon receipt of the fingerprints the appropriate state agency or bureau will compare the subject's fingerprints against its criminal file and, if no disqualifying conduct is found therein, submit the fingerprints to the Federal Bureau of Investigation for a comparison with nationwide records. The results of the Federal Bureau of Investigation check will be returned to the.appropriate state agency or bureau, which will disseminate the state and national results to the Director of Human Resources. Section 5. The City Administrator shall render a fitness determination based upon the results of the criminal background check and communicate its fitness determination to the appropriate Department Director. S:\Myfiles\Council\Ordinances\2007-004.wpd I whether the record subject has been convicted of, or is under pending indictment for (a) • a crime which bears upon his/her ability or fitness to serve in a particular position as a City employee; (b) any felony or a misdemeanor which involved force or threat of force, controlled substances, or was a sex-related offense; or(c) any other violation which would disqualify the employee from the particular job duties assigned to that prospective employee. Section 7. A record subject may request and receive a copy of his/her criminal history record information from the Director of Human Resources. Should the record subject seek to amend or correct his/her record, he/she must contact the appropriate state agency or bureau for a Missouri state record or the Federal Bureau of Investigation for records from other jurisdictions maintained in its file. Section 8.
