HomeMy Public PortalAbout2006-087 Resolution Granting Amended CUP to Alpine FarmsMember Weir introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.2006-87 RESOLUTION GRANTING AN AMENDED CONDITIONAL USE PERMIT TO ALPINE FARMS WHEREAS, on April 6, 2004, the Medina city council (the "City") adopted Resolution No. 04-019 granting Parkview Equestrian LLC dba "Alpine Farms" (the "Applicant") a conditional use permit for the construction of a commercial horse facility at 2182 Homestead Trail (the "Subject Property"), which the property is legally described on Exhibit A attached hereto; and WHEREAS, the Applicant has applied for a conditional use permit amendment to revise the legal description of the property to reflect the new legal description of Alpine Farms resulting from subdivision; and WHEREAS, this matter was reviewed by the planning commission on November 14, 2006, and the city council on December 5, 2006; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that a conditional use permit amendment be granted to the Applicant for the new legal description on the property, subject to the following terms and conditions: 1. The conditional use permit to operate the horse facility shall apply only to the 50.19-acre parcel to be known as Lot 1, Block 1, Parkview Knoll. 2. Approval of the conditional use permit amendment is contingent upon approval of the final plat and the rezoning of Lot 2, Block 1, Parkview Knoll. 3. Hard surface coverage on the lot shall not exceed 25% of the lot as allowed by the shoreland overlay district requirements. 4. The parcel is subject to all requirements of the Shoreland Overlay District (Section 827 of the Medina City Code). 5. The parcel is subject to all requirements of the Floodplain Management Ordinance (Section 826 of the Medina City Code). 6. City staff recommends that the landowner review the MPCA document "Applying Manure in Sensitive Areas" and consider implementing the wetland separations recommended by the MPCA. 7. The manure management plan shall be updated to reflect the new legal description and new site boundaries of the Subject Property. Resolution No. 2006-87 December 19, 2006 1 8. The Applicant must pay to the City a fee in the amount determined by the staff to represent the actual cost to the City of reviewing this amended conditional use permit application. 9. Except as set forth above, the conditions, numbered 1-31, of the original conditional use permit adopted April 6, 2004 shall remain in full force and effect.
