RESOLUTION NO.2006-88
RESOLUTION GRANTING PRELIMINARY PLAT APPROVAL FOR
BEANNACT FARM
WHEREAS, Douglas F. Often and Cheryl K. Bazinet and David J. Dalbec and Debra A.
Dalbec (the "Applicants") have applied to the city of Medina (the "City") to plat certain property
located at 3003 and 3085 Hamel Road collectively (the "Subject Property"), which the property is
legally described on Exhibit A attached hereto; and
WHEREAS, the plat of the Subject Property, to be known as Beannact Farm, was reviewed
by the planning commission at the meeting on November 14, 2006 and, following public hearing
thereon as required by law, the planning commission recommended approval thereof, subject to
certain terms and conditions; and
WHEREAS, the city council on December 5, 2006 reviewed the preliminary plat for its
conformance with the City's ordinances, considered the recommendations of the planning
commission and heard comments from the Applicants and other interested parties.
NOW, THEREFORE, BE IT RESOLVED, by the city council of the city of Medina,
Minnesota that preliminary approval be granted to the Applicants for the plat of Beannact Farm,
subject to the following terms and conditions:
1. The development is subject to all development standards in the RR (Rural Residential)
zoning district.
2. The landowner shall comply with the Wetland Conservation Act approval.
3. Best Management Practices (BMPs) for erosion control shall be employed.
4. Approval is subject to the review and approval of the Minnehaha Creek Watershed District.
5. Development within the plat is subject to the Shoreland Overlay District requirements
identified in Section 827 of the Medina City Code.
6. Development within the plat is subject to the Floodplain Management Ordinance
requirements identified in Section 826 of the Medina City Code.
7. The plat shall dedicate a minimum 33-foot %2 right-of-way for Hamel Road.
8. The Applicants shall be required to obtain all necessary permits for the proposed driveways
from Hennepin County, as noted in the August 17, 2006 memo from the County.
9. The final plat shall be revised to identify drainage and utility easements over all ponding
areas, drainageways and wetlands, including the existing pond on Lot 1.
10. The Applicants shall comply with all City requirements as noted in the comments from the
City Engineer, dated October 18, 2006.
11. The Applicants are subject to the standards in the tree preservation ordinance (Section
828.41 of the Medina City Code).
12. The existing conditions map must be revised to show all sides of the boundaries of the
wooded areas.
13. The application for final plat must be submitted to the City within 180 days of preliminary
plat approval or the preliminary plat shall be considered void, unless a written request for
time extension is submitted by the Applicants and approved by the City Council.
14. The park dedication shall be cash in lieu of land for the one new lot ($8,000). Prior to
release of the final plat for recording, the applicant shall pay the required park dedication
fees.
15. The application for building permits must include grading, drainage and erosion control
plans with each building plan submitted.
16. The Building Inspector must approve the soil percolation tests and septic system designs
prior to issuance of building permits. Septic sites must be staked prior to beginning any
construction on site.
17. The Applicants shall pay to the City a fee in an amount sufficient to reimburse the City for
the cost of reviewing the plat and any necessary documents.
